    US insists on Pemberton’s custody

    On Wednesday, the US rejected the Philippine government’s request to have custody over Pemberton, who is facing a murder charge before the Olongapo City Regional Trial Court in connection with Laude’s killing.

    In a statement, the US Embassy in Manila said the Visiting Forces Agreement between the US and the Philippines gives American authorities "the right to retain custody of a suspect from the commission of the alleged offense until completion of all judicial proceedings.”

    Under the VFA, the custody of a US soldier accused of committing a crime on Philippine soil “shall immediately reside with the United States military authorities, if they so request, from the commission of the offense until the completion of all judicial proceedings.”

    The same agreement states “confinement or detention by Philippine authorities of United States personnel shall be carried out in facilities agreed on by appropriate Philippine and United States authorities. “

    Pemberton is now being held at a US facility inside Camp Aguinaldo, "under guard of US military personnel, with perimeter security provided by the Armed Forces of the Philippines."

    Police in Olongapo City have finalized security preparations for a possible court appearance on Friday of Lance Corporal Joseph Scott Pemberton, the Marine charged with murder for the killing of transgender woman Jeffrey "Jennifer" Laude.

    Olongapo City police spokesperson Inspector Vivian Reyes said uniformed police, including anti-riot teams, are prepared to deal with protesters and potential trouble.

    "Regarding the security preparations, prepared na kami for that. We are expecting (rallyists) kasi noong nakaraan meron na. This time we are expecting mas marami sila," Reyes told radio dzBB's Divine Reyes.

    According to Reyes, they are not discounting the possibility several militant groups will show up Friday to demand that Pemberton be placed in Philippine custody.

    She also said they will coordinate with the US Naval Forces in securing the court where Pemberton will be presented.

    According to Reyes, the Olongapo police will deploy more than 100 uniformed personnel, including the Special Action Force, Explosives and Ordnance Division, Special Weapons and Tactics, and Public Safety Battalion.

    They will work with "force multipliers" including the Philippine Red Cross, City Disaster Risk Reduction and Management Office, and traffic management officials.

    Earlier, representatives from the US Naval Forces inspected the Olongapo Regional Trial Court Branch 74.

    It's going to be a problem for the Flips. If he's convicted, his custody goes to the Flips. They've been making so much noise about getting custody that if ANYTHING happened to him while in their custody, it would be a HUGE loss of face for them.

    So......private cell (which they would have to build); separate exercise area; additional guard possibly for suicide watch, etc, etc.

    I think after an appropriate (short) passage of time, that the Flips will be delighted to dump him on the US for the rest of his sentence.

    ^Don't think so. Don't think he's technically AWOL. He's in custody. He's not absent without leave, he's where they told him to go....doing what he was told to do.


    It now appears that Pemberton does have his first scheduled court appearance tomorrow. Should be good TV (no pun intended).

    If it was a courts martial no choice - uniform.

    Civilian court? I don't know. If I was a defense lawyer I'd be pushing hard for civvies so he looks like a teenager and not a "Jarhead Killer".

    Knowing where he is isn't the point. he is absent from his unit and they certainly didn't give him leave to be so. If he was arrested and held by the flippas he would be, the US custody of him is an anomaly.

    He returned to his place of duty following the murder. He cannot be declared absent. His present duty, determined by his superiors is awaiting trial. Until that trial reaches a verdict of guilty, he is an innocent man carrying out his orders.
    In less fractious and highly charged circumstances, he would be at his duty station under house arrest, awaiting trial by civilian authorities.
    Until a guilty verdict is reached he is presumed innocent, and entitled to the pay and privileges of his rank and appointment.

    I agree, but there will be those that say it was all about the job. He was not here on a visa of any kind, but as an American serviceman. He was not a tourist, but a Marine on shore leave.

    In any case he should wear civies in spite of what the wanker lawyer spouts.

    Pemberton quietly arrived at the Olongapo Regional Court early this AM in a convoy of diplomatic vehicles. No uniform; grey suit.

    He was booked for murder, but the arraignment was postponed.

    The convoy headed back to Camp Aguinaldo prior to 10AM.

    Next court appearance will be for the arraignment - date unknown. Could be a while, as the country is already shutting down for Xmas, which will be followed by a mid-January visit by the Pope, which should fuck all travel in the Luzon area for about ten days.

    Just in: Next court appearance for arraignment will be on 22 December.

    This case is very sad. This young Marine's life has truly ended. I don't know what was going on in his head to kill this lady boy but for now i will still give him the benefit of doubt, until all the evidence is brought out in court. When i was a young E-2 pulling liberty in subic way back in the 70's this did not happen first there was very little if any what we called billy boys back then not that i seen anyway. If you did happen to get that drunk that you would have brought a he/she to a hotel room you sure would have got ribbed by your shipmates for ever, but to kill the he/she is just plain stupid. Did he not realize that he is not in Kansas (USA) anymore. Prisons in the PI are not survivable especially for westerners and a US service man to boot. He is truly F@#K.

    I have been retired for the past 3 years now and every year since been going to the PI on vacation Manila and Angeles City. This year i was going to spend time in Subic. Davis should i go to subic or just stay away ? I would not want to be jumped and beaten to death by a bunch of he/she's looking for revenge on Americans LOL. What is the atmosphere over there toward westerners and especially Americans. Thanks in advance.

    Scum lawyer Roque has now filed a petition for press coverage to be allowed inside the courtroom during the trial. Anything to turn it into an anti-VFA circus. Doubt it will be allowed.

    As the Pemberton convoy left the Olongapo courthouse this morning, Roque rushed out and joined the handful of protesters, pumping his chubby fist in the air and screaming "Junk VFA!"

    And they wonder why people hate lawyers?????

    I have heard nothing about problems anywhere. Most Filipinos don't give a shit about trannys. Most social media comments reflect the opinion that the tranny, in many ways, brought it upon himself.

    All the vocal protests are from a few, small, anti-VFA or pro-fag organizations.

    I don't think you will have any problems except being mobbed by bimbos looking for a payday.

    When myself and a few friends some 25 years ago one of which was a squaddie got charged with being drunk and disorderly he wore civvies to court as did the officer from his regiment who came along to the court, that's the UK though.

    I think you'll find anyone with a modicum of intelligence would realize, in fact that it ended it's own life .
    Literally, when it tried to trick the young teenager, Joseph Scott Pemberton, but in reality years earlier, that is on the day it embraced homosexuality - it was already nominally dead inside and had being for years.

    The case is a bit like a burglar climbing up the side of a house to break in and the surprised home owner knocks him to his death.
    No big deal.

    The coroner should return a verdict of suicide, as Jeff laudes homo self loathing and self disgust probably led it to seek situations where it might end up dead .
    A bit like those 'suicide by cop' cases in the USA.

    3 things need to happen:

    1 Free Pemberton.
    2 Reinstate shore leave so the honest people can earn some coin.
    3 Employ security guard at the bars with specially trained dogs to sniff out the homosexuals.
