In a Philippine prison, unless the Filipinos decide they want to turn him over to the US for incarceration - it's up to them.
Personally, I believe there would be a huge outcry if the Filipinos relinquished custody if he's convicted. I think they will have to keep him, at least for a few years, before turning him over to the US to complete his sentence. They may never relinquish custody....as is their right under the terms of the VFA.
The Olongapo Court Judge today dismissed the remaining nuisance motions filed by fat, scum lawyer Roque.
The Pemberton trial will kick off on 23 February in Olongapo with his arraignment.
And, after the commercial break, we'll be back tomorrow with the start of the trial.
Interesting that the savage murder of a 17 year old Flipina by 'Australian' convict Ali Ali stayed in the news for two days only.
It's all about the VFA.......

It will be interesting to see, after a two-month hiatus and with the enhanced VFA agreement no longer in the courts, whether scum lawyer Roque is able to fan the flames of anti-Americanism to their previous level.
This should be a simple murder trial. The courts have upheld the prosecution's request for a charge of murder vice manslaughter. But, if Roque can turn this - again - into a three-ring circus, the fat fucker will.
There has been no word on the military's legal action to have Roque disbarred or otherwise sanctioned - this issue, as far as I know, is still out there.
Also still out there is Marc, the German homosexual 'fiancee' of dead Jeff, who has been deported, but will probably resurface - at least in the press.
Dead Jeff's family, stupid and venal as ever, will continue to act as pawns of filth lawyer Roque in his efforts to keep his name and personal agenda in the press.

Court was in session early this morning. The courthouse was secured by 150 cops - no idea why. A group of anti-VFA rent-a-protester folks showed up with a mock-up of a Philippine jail cell. Scum lawyer Roque was not visible.
Pemberton was arraigned on the charge of murder. He refused to enter a plea (not sure why). The court entered a plea of not guilty on his behalf.
That's it so far.

Little doubt that the strangulation was intended to kill as it was being done. So, yes at the time of it happening he intended to kill her.
Should plead guilty, try to spin it that he is so sorry, that he was deceived into believing that she was a woman, and that she suddenly became a man and tried to copulate with him, he suffered complete and utter shock and was not in control of his senses when the unfortunate event took place.
Is there a murder with diminished culpability charge in the Philippines?
Next court appearance will be pre-trial on Friday for both sides to present witnesses.
Actual trial will not start until the third week of March or so.
So, hurry up and wait...........
When the actual trial does start, weekly court hearings will be held two days a week, on Monday and Tuesday.
