    an establishment promoting, selling and encouraging the consumption of alcohol can hardly turn round and violently attack a customer when he becomes the worse for wear due to that alcohol.

    they should have the ways and means of defusing such situations.

    it is just another example of unprofessional and thuggish behaviour shown by those who run and those who are employed by these establishments.

    when bufty fortescue-dumpington got a bit squiffy after one too many cognacs in the reading room at brooks on st.james's late one friday night, old scrotum, the wrinkled retainer employed there solely to deal with such incidents just gave the fellow a black coffee and a cucumber sandwich, covered him with a blanket and let him sleep it off, no need to black the fellows eye.

    The medical costs are not that big by insurance standards, if the CCTV shows the attack and the bouncer is to blame, they will pay.

    Chances are he was a gobby little twat mouthing off to the wrong guy pushed the right buttons and bingo!
    Not to say that what the bouncer did was right but bad things happen if you let your mouth run off at the wrong guy.

    James, the club already accepted liability and sacked the bouncer. That they may wish to wriggle out of the financial compensation that flows from that is entirely another matter. Plus, any insurance liability is mitigated, if not entirely invalidated, by the insured " or his agents, servants etc" acting unlawfully in giving rise to a claim.

    Assaulting a member of the public in such a disproportionate and violent manner outside the premises is clearly a criminal act in anyone's book and therefore no insurance company would consider their contract to be binding unless said contract contained a clause indemnifying such an act.
