That he saw a penis where he expected to see an orifice? You think that's a mitigation to a murder charge?

I have never condoned Pemberton's alleged murder of Jeff Laude. In fact, I have repeatedly said that he should pay for his crime if found guilty. And I have also said repeatedly that I believe Pemberton killed Laude.
I feel no sympathy for Jeff Laude. He was a very confused man who thought dressing up as a female and selling sex was a great life choice. It wasn't.
I have also said, repeatedly, that Pemberton could have dealt with the situation in any number of ways short of killing the guy.
Do I put the blame on Laude for engineering the scenario that led to his death? Yes.
Do I think Pemberton should be charged with murder? No.
A manslaughter conviction carries a twenty-year sentence. There is no evidence of premeditation.
Get it right Moog, or zip it.
Sexuality is a core part of a persons psych. You should know that, homo's virtually live by their sexuality.
Discovering you have been deceived into having sex with a gender not of your natural choosing is probably a pretty traumatic moment.
Simple fact, if Laude had not pretended to be female and had not knowingly engaged to deceive a hetero male he would not be dead.
The overarching theme in this entire topic is
'Davis hates fags '
Which is fine. It's up to him what issues bamboozle or horrify him.
Blue is an ancillary character probably written by Buriram Boy as a humourous satire, so that can be set aside.
What is ludicrous are those whose knowledge of jurisprudence is so pitiful that they consider that being dissatisfied with one's prostitute, or some failure by their prostitute under a genital Trade Description Act can be trotted out in a Courtroom as a provocation defence.
But i'm sure if they don't know a country where that would work as a defence, they will soon make one up.
Legalities aside, the idea is horrifying that any monger can endorse a situation where a prostitute somehow 'asked' or deserved to be slaughtered.
^You keep trying, week after week, to make this tread about me. If that turns you on, fine.
You have a tremendous amount of sympathy, or perhaps empathy, for the sad, dead man. It appears very few posters share your sentiments.
Fags don't "horrify or bamboozle" me; can't say I ever even give them a passing thought other than when I read a story like this in the news.
I have provided a running commentary on this story simply because I live here; 15,000 or so views indicates there is interest.
Only you repeatedly come out as a supporter of boys dressing up as girls and attempting to trick men into paying for sex with them. I have to wonder why?
A reasonable axiom is in my estimation.
'It is never justifiable for a sex worker to be killed in the line of duty."
And if they are slaughtered on the job, due to crabs, herpes, over-charging, that is as equally unacceptable as because they have unexpectated delights in their Y fronts!
It is the John's fault, not the sex worker's.
I feel sorry for any sex worker who is found beaten to death in some alleyway. I don't feel sorry for the client who went on the attack.
Now - usually, western men in the third world are pretty comfortable with the idea of dealing with sex workers who have elected to take their lousy career option - whatever the boudoir outcomes are.
I realise there are people who are more conservative about sexual matters. Middle aged lady schoolteachers in Omaha hate prostitutes and their clients, ISIS extremists who hate poofs so much that they execute them by throwing them off buildings.
Such as what?
And no - the 'but he dressed up as a woman' is not a mitigation to murder.
Getting blindly incandescently angry might be a mitigant - but it has to be for something that merits it
eg
' I saw him whacking a child with an iron bar and I went nuts and hit him with the bar' = yes, mitigant
'He spilt my pint, I went crazy and strangled him' - no. not a mitigant.
'He came at me with a knife when I flushed his ID card down the toilet' might be a satisfactory mitigant here.
^Laude is dead. Pemberton is in jail. WTF do you want, a memorial ceremony?
^Give it time, Harry. There has to be a trial first. I think Pemberton is looking at a minimum of 20 years, and a maximum of 40. To be served in a Filipino prison if that is what the Filipinos desire.
I totally agree. He could have turned and walked out. He could have punched Laude and walked out. He allegedly chose to brutally murder Laude instead. If that is proven in court, and it almost certainly will be as he as much as admitted the murder to his liberty buddies upon his return to his ship, then he deserves serious prison time. As I have said previously - repeatedly.
I think he could have given him a going over , but to kill him was over the top and he will pay for that , he is a very stupid man.
He had option's and he choose the wrong one (understatement) I think alcohol played a major role in his actions but that is not a viable legal defense. The Kid screwed up and will now have to answer for his actions.
There are no winners here just losers !
What i would like to know is where was his buddies ? When i was in the Navy on liberty in Subic we watched each others back's to make sure we did nothing stupid like getting drunk and being duped by a ladyboy or being robbed. Different time and for sure a different Military back then.
Yeah...Interesting comments...I've seen the guys watching their buddies...But shit still happens...Too many twists to the plot to speculate...Quote:

I believe I read something at the early stages of this story that said his liberty buddies had picked up real girls and gone off to another nearby short-time hotel with them. They did come back to pick him up to return to the ship, but, by that time, he had already done the deed and fled for the ship.
To bad if they all would have left for the short time hotel together maybe one of his buddies would have seen the ladyboy for what he was, an impostor.
Again still no excuse for Pemberton's action's
Laughing at it and chalking it up as a life's learning experience and just leaving the hotel room would have been a good way for him to go.
OK i came across this on another site. If you believe that this young Marine committed murder this might have you re-evaluating your stance. Is it True i can not say. I am just posting it for information purposes, you have to make your own determination on these statement's.

My thoughts on this case:
1) A young soldier, inexperienced, naive, away from home, but a US Soldier with all the ego that entails (would be the same for a UK marine...) is very likely gonna be troublesome when out drinking in a foreign land.
2) A sex worker who deceives men into having sex under a false premise (i.e. that he is a woman) is playing a very dangerous game with Nigel the Nerd from Basingstoke, nevermind Keith the Paratrooper from Newcastle.
3) 2+2, in this case, does indeed make 4.
I feel more sorry for the sex worker than the soldier because: a) the sex worker is dead; b) the soldier had many other options to choose from and choose the worst option.
Terrible choices by both participants, but both were young, and young people make bad choices (I know I did...); it's a shame there's such a terrible ending here.
I will add that I don't know for sure that my points 1 and 2 above are true. Maybe the sex worker was not deceiving the soldier, maybe the soldier did not kill the sex worker. I am basing my thoughts on the news reports in this thread and my life experiences.
Now, I don't like ladyboys because I like women. But, I have been in ladyboy bars in Bangkok and the sexworkers clearly identified themselves as men pretending to be women in a number of ways (actions, words, self-satire, etc). I'm not sure if that happened in this case, but any sexworker who deceives somebody into having sex with them is asking for trouble. It's funny when you see a young drunk bloke, likely in Thailand for the first time, hand in hand with a katoey, thinking he has pulled a great looking woman. But, there is a something very wrong in that situation that can turn deadly.
