May well?? That's not a point, that's a presumption. Of course that's why we have courts and forensics departments. They may not be perfect but they're probably a little better than a bunch of forum pundits who think with their dicks.

Of course my point was, a point that you completely missed, that if she DIDN'T consent then she WAS raped. Have you go that? It's not complicated, if she DID NOT consent then she was raped. NO CONSENT = RAPE. And contrariwise, if she DID consent then she was NOT raped. CONSENT = NOT RAPE. Is that clear enough for you? If you still have difficulty understanding these difficult concepts then ask the nearest 8 year-old. I'm sure they'll be able to clarify it for you.
So... Do you get explicit consent from a woman every time you have sex ? You
ask "can we have sexual intercourse ?" every time ?

If not... THEN YOU ARE A RAPIST eh..

Delhi rape: juvenile raped woman twice and ripped off her intestine
    Jatin Anand
    January 03, 2013

The law may bestow leniency on him but according to the Delhi Police, the juvenile associate of the men who executed the gangrape of December 16 was the most brutal of them all.

According to the chargesheet, the juvenile had subjected the 23-year-old physiotherapist to sexual abuse twice, once when she was unconscious.

He extracted her intestine with his bare hands and suggested she be thrown off the moving vehicle devoid of her clothes, it says.

The police, who are yet to receive the report of his bone ossification test and are treating him as a juvenile on the basis of his school leaving certificate, are supposed to file its chargesheet on Thursday.

The police have also obtained the initial postmortem report from Singapore.

"Of all the persons in the bus, two had engaged in the most barbarism — Ram Singh, the main accused in the case, and the juvenile," said an officer.

"Both of them had subjected her to sexual abuse twice. Singh was the first to rape her followed by the juvenile and then Akshay. Later, when she lost consciousness, Singh and the juvenile raped her a second time."

Nabbed from the Anand Vihar ISBT on December 28 and six months shy of officially turning an adult, the juvenile had moved to the city in 2007.

That day, police said, the juvenile had landed at Singh's Ravi Das slum cluster home to demand R8,000 the former owed him. Here, he met the rest of the men.

Around 9.30 pm, he used his peculiar 'sing-song' whistle to lure the couple aboard the bus. The vehicle started moving on a different route, making the victim's companion apprehensive. They shut the only functional door of the bus.

"When the victim's companion objected, Singh passed a lewd comment which triggered an altercation," the officer said.

The first one to engage her companion was the juvenile before Singh attacked the man on his head with the blunt iron rod used as a weapon during the episode.

This story is hard to read.

Yet we still have complete morons equating this with the kraut story.

All the bullshit aside. Rape needs to be re defined or split into categories like murder is.

I am sure that the courts always take into account the varying circumstances involved in any rape, so that is hardly necessary

Lets put this retardation into perspective...

The 22-year-old woman accused Somchai Jamnongwaree, or Mor Jamnongwaree, the owner of a local liquor shop, of raping her when she met him on Tuesday night.

The alleged incident occurred at Mr Somchai’s shop which was located near the beach behind the Novotel Rim Pae Resort in tambon Chark Pong, where the tourist stayed, said Pol Lt Col Suparb Nakthong, chief of investigation at Ban Krum station.

The officer quoted the woman as saying that Mr Somchai gave her local lao khao (or white liquor), otherwise known as Thai vodka, to drink and she became drunk and passed out. She asked whether the man sexually violated her and he admitted to having had sex with her. She then went to the local police station to file a complaint against him.
    And......

"She had suffered from severe organ failure following serious injuries to her body and brain," Kelvin Loh, the chief executive of Singapore's Mount Elizabeth Hospital, said in a statement.

"She was courageous in fighting for her life for so long against the odds but the trauma to her body was too severe for her to overcome."

After boarding a bus with tinted windows on December 16, the student was attacked by six men who took it in turns to rape her and assaulted her with an iron bar before throwing her and her male companion off the moving vehicle.

So what do you do BOb? Get them to sign a consent form?
Or do you have a standard verbal question format?
    Are there stages?
I mean do you get explicit permissions for each base?
Really, I'm interested how it works.
Personally I've always worked on the by degrees system, taking it each step by step until she says stop. If she doesn't say stop I don't.
Rather than making out on the couch and suddenly whipping out the explicit consent consent forms/questions kind of kills the mood.

India victim's male friend recounts Delhi rape attack

    BBC, 5 January 2013

The victim's friend, who witnessed the attack, speaks to Zee News

The friend of a woman who died after being raped on a bus in Delhi has given his first interview since the incident.

The man, who has not been named, told Zee News how he and the victim had boarded the bus and paid a fare, before he was beaten unconscious by men on board, who then attacked her.

He also criticised police for their slow response to the attack.

The woman, 23, died of her injuries last weekend, and five men are due to stand trial for her murder and rape.

The five could face the death penalty if they are convicted. A sixth suspect is expected to be tried in a juvenile court.
A special fast-track court set up to deal with the case of the five suspects is expected to sit on Saturday.

Police 'argued' The 28-year-old friend said he and the rape victim had boarded the bus after a trip to the cinema and after failing to flag down an auto-rickshaw.
He said the bus had tinted windows, and that he believed the group of men had laid a trap for them.

"We tried to resist them. Even my friend fought with them, she tried to save me," he said.
"She tried to dial the police control room number 100, but the accused snatched her mobile away.
"I tried to fight against the men but later I begged them again and again to leave her."

He confirmed earlier reports that the assailants had thrown them off the bus and tried to run them over.
The friend said he had tried to get help from passers-by and motorists.
"They slowed down, looked at our naked bodies and left," he said.
And he also criticised the authorities, accusing them of being slow to arrive, then arguing over jurisdiction, and eventually taking them to the wrong hospital.
"My friend was bleeding profusely. But instead of taking us to a nearby hospital, they [police] took us to a hospital that was far away," he said.

Delhi Police on Saturday denied its officers were late in arriving. A statement said the first vehicle had arrived within four minutes of the distress call, left the scene with the victims within another three minutes and reached Safdarjung Hospital within another 24.

Meanwhile, police say they are investigating Zee News because Indian law bans the disclosure of the identity of rape victims. The victim's friend was not named but his face was shown.

Police spokesman Rajan Bhagat told AFP news agency that a case had been filed against the broadcaster.
A new fast-track court inaugurated this week to handle the case is expected to hold a hearing on Saturday.

Five suspects have been charged with murder, rape and kidnapping.
The case has caused a national outcry, and there have been frequent protests calling for greater protection for women.
Earlier, India's top security officials held a meeting to discuss possible reforms.

They have promised to recruit more women to the police force, and supply women staff to every police station in Delhi.

I think in this case where they are pushing for a harsh sentence it would be better to publish her name and photo with the consent of the family. This would give the victim a personal identity to focus the grief and anger and mobilise the lobby for harsher sentencing in general for these crimes.

I think that its that they have released his name with his permission and that the court case is more about musseling the press and getting this story put to bed, just like all of the other rapes. so that the politicians can get on with the importent busiess of corruption without being distracted by anything as silly as good governance.

So you stop and ask for permission eh.. Yeah right. I guess you don't have very much experience in this field of presuing women.

The father of an Indian woman whose brutal rape and torture provoked international outrage said in an interview published on Sunday that he wanted her name to be made public so she could be an inspiration to other victims of sexual assault.

Prosecutor says five men charged with murder of 23-year-old student tried to destroy evidence by burning their clothes

India gang-rape victim's blood 'found on clothes of accused' | World news | The Observer

Police in New Delhi have refuted comments made by the male companion of an Indian gang-rape victim that police officers debated jurisdiction for 30 minutes before taking the victim and her friend to a hospital.

At a news conference on Saturday, Joint Commissioner of Delhi Police Vivek Gogia said police vans had reached the spot where the rape victim and her friend were dumped within three minutes of receiving the alert.

The victim's male companion said in an interview broadcast on Friday on Indian TV station Zee News that police delayed taking her to a hospital, after passers-by neglected to help her even though she was naked and bleeding.

The 23-year-old woman died last weekend from massive internal injuries suffered during the December 16 attack.

Gogia said the police vans left the spot for hospital with the victims within 12 minutes and that time had been spent borrowing bed sheets from a neighbouring hotel to cover the naked rape victim and her friend.

"Zebra 54 [Police response vehicle] left the spot along with the victims at 10:39 [17:09 GMT]. This time was utilised in placing the victim in the van, after organising a bed sheet from a neighbouring hotel to cover the victims," Gogia said.

"Zebra 54 brought the victims to Safdarjung Hospital at 10:55 [17:25 GMT]. These findings have been ascertained through the logs generated by the multi-computer configuration global positioning system," he said.

Then personally I think he should do his best to make her name public and dare the government to prosecute. After all the former gets him what he wants and latter even more so.

I hate to imagine what I would do in his position

Victims father releases identity of daughter

Indian gang rape victim's father: I want a hospital built in name of my Jyoti

Jyoti Singh Pandey's grieving father Badri called for the 23-year-old’s life to be commemorated in a positive way after she became known simply as India’s Daughter

The grieving father of murdered gang-rape victim Jyoti Singh Pandey wants a hospital built in her name as a lasting memorial.

Badri Singh Pandey, 53, spoke out after finally deciding to reveal his tragic daughter’s identity – to give strength to other victims.

He called for the 23-year-old’s life to be commemorated in a positive way after she became known simply as India’s Daughter following her murderous sex ordeal on a public bus .

Speaking at his ancestral village Billia in the northern state of Uttar Pradesh, Badri said: “Our village doesn’t have any health facilities. It has no amenities, not even consistent electricity.

“My daughter wanted to be a doctor and help people so the best thing would be to construct a hospital in her name. I would be very proud of that.”

Badri admitted yesterday that he has found it difficult to remember any memories of Jyoti since her death. All he can focus on is his last moments with her – just minutes before she suffered a massive heart attack.

He said: “That conversation will remain etched on my heart for life.” But the distraught dad realises he must carry on for the sake of his daughter’s treasured memory. He added: “She was a brave girl and if we stopped living she would be very disappointed with us. Once we get through these first few weeks we’ll be more determined to carry on living for her.

“I will fulfill her dreams and make sure my sons get a good education and stand on their own two feet and do well. They have to fulfill her dreams now.”

Badri’s wife Asha, 46, was still too upset to talk yesterday.

    .........

A blog is carrying this picture but not sure if it is her.

The case in this thread is rape. Do you think the case involving the 22 year old kraut is equal to this ?

I comunicate in a natural way like most ppl.

I guess you carry consent forms, breath testers, lawyers, and flash cards to " communicate" with your mate about the unlikely possibility of sexual intercourse.

India rape accused seek trial, plead not guilty
    Michael Edwards

A police bus - believed to be carrying the accused in a gang-rape and murder case - arrives at court.
    (AFP)

The lawyer for three of the men accused of the gang rape and murder of a woman in New Delhi last month says his clients will plead not guilty.

Five men have been charged with kidnap, rape and murder over the attack on the 23-year-old woman in south Delhi last month.

The case has provoked such outrage that lawyers in the district where the case is being heard have refused to defend the men.

Now the lawyer for three of the men - the bus driver, his brother and another man - says they will plead not guilty to the charges.

Manohar Lal Sharma says the case must go to trial so that the evidence police have presented can be tested in court.

"We are only hearing what the police are saying. This is manipulated evidence. It's all on the basis of hearsay and presumption," he said.

A judge has ordered the proceedings to be held behind closed doors and the trial is set to be held in a special fast-track court.

Two of the other accused have reportedly offered to become witnesses for the prosecution.
