    Strange when you think about it- heroin users pay no tax on their consumption, but get free methadone treatment.
    Smokers pay heap big tax, and get nothing but ever escalating taxes, and more restricive laws.
    Anyone would think the government feels it has no real incentive to help you kick the nicotine habit...

    OMAHA, Neb. - A member of the Kansas group that has drawn criticism for protesting at soldiers’ funerals has been arrested for letting her 10-year-old son stomp on a U.S. flag during a demonstration. She promised Wednesday to challenge the state’s flag desecration law in court.

    Shirley Phelps-Roper, 49, will be charged with flag mutilation, disturbing the peace and contributing to the delinquency of a minor, Sarpy County Attorney Lee Polikov said Wednesday.


    Phelps-Roper, a member of the Westboro Baptist Church, acknowledged that she allowed her son Jonah to stand on the flag Tuesday — something she says is protected by the U.S. Constitution.

    Well, that's a good question. I believe the states have the right to limit speech because the First Amendment merely states that Congress may not limit speech.

    I think you'll find the so-called 'don't shout fire in a crowded theater' laws are state laws.

    It should be worth noting that in United States v.Eichman, 496 U.S. 310 (1990), all state flag desecration laws were overturned, and, the aforementioned case will fall down in court due to this decision (strange enough most states didn't take the flag desecration laws off their books after the decision).

    The important thing to remember is that the decision was cast by a majority of only one vote. Change that one vote and the laws stand.
