    US Execution

US court refuses to halt execution

    September 22, 2010 - 9:44AM

    AFP

The US Supreme Court has refused to grant a last-minute reprieve to a grandmother on death row, now likely to become the first woman in Virginia to be executed in almost 100 years.
The court said in a short ruling that the stay of execution requested by 41-year-old Teresa Lewis "is denied".
Lewis is now due to die by lethal injection on Thursday, the first woman to be put to death in Virginia since Virginia Christian, a black 17-year-old who died in the electric chair in 1912.
Abolitionists paint Lewis as a classic example of why capital punishment is flawed, saying the mother and grandmother has diminished mental faculties and was taken advantage of by smarter accomplices.
But with an IQ hovering at 70 or above, Lewis is considered fit for trial in Virginia and she pleaded guilty to hiring two men in 2002 to murder her husband and stepson to pocket their $US350,000 ($A367,319) life insurance policy.
Adding to the US Supreme Court's decision, Virginia Governor Bob McDonnell has also said he would not intervene to stop the execution from going ahead.
"After numerous evaluations, no medical professional has concluded that Teresa Lewis meets the medical or statutory definition of mentally retarded," McDonnell said in a statement.
"Having carefully reviewed the petition for clemency, the judicial opinions in this case, and other relevant materials, I find no compelling reason to set aside the sentence that was imposed by the Circuit Court and affirmed by all reviewing courts."

Iranian President Scolds U.S. Over Woman's Planned Execution

Iranian President Mahmoud Ahmadinejad has come out against the death penalty -- at least for one American woman.
Speaking to state-run news agency, IRNA, Ahmadinejad cited a double standard over the outcry over an Iranian woman, Sakineh Mohammadi Ashtiani, 43, who had been sentenced to death by stoning for adultery, but was suspended due to international criticism. He said despite the chiding of Iran over Ashtiani, there has been no similar protest over the scheduled execution of Teresa Lewis, 41, a Virginia woman convicted of a double-homicide.
"A woman is being executed in the United States for murder but nobody protests against it," said Ahmadinejad, who is in New York for the annual United Nations General Assembly. "There are 3.7 million Internet pages about this woman. Her case is not final yet but Iran is being heavily attacked."
It may be hard to see where the Iranian leader is coming from. After all, Iran was going to execute a woman for allegedly cheating on her husband in a reportedly lopsided case where Ashtiani may not have even understood the charges against her because of the dialect she speaks. On the other hand, Lewis was convicted of arranging the killing of her husband and stepson, a capital crime in Virginia.
However, many may agree with the point Ahmadinejad makes that Lewis is scheduled for execution despite the fact her IQ is 72, making her borderline mentally retarded by most standards. In a 2002 case, the U.S. Supreme Court found it unlawful to execute anyone whose IQ is below 70.
"We will file an official complaint to the international community against the U.S. if the sentence is administered," Hossein Naghavi an Iranian lawmaker told the Fars news agency, another state-run news organization.
Virginia Gov. Robert McDonnell has refused to commuted Lewis' sentence and barring any intervention from the Supreme Court, she is set to be executed by lethal injection Thursday morning, making her the first woman to be put to death by Virginia since 1912.

Typical Ahmadinejad. Instead of thanking the Merkans for helping clean up the gene pool, he prattles on about her IQ...like Muslims value IQ in a female. Can we take up a collection and send Jet Gorgon to castrate and kill this guy??

Yeah, criminals always pull the IQ (I'm too fucking stupid to know what I was doing) defense, black Americans are especially fond of this excuse. I never knew one had to be a genius to commit crimes to begin with. They aren't too stupid to come up with crimes though, just kill the woman and be done with it, every second she breathes is a second too long. While Ahmadinejad can make some good points at times, he can also be a hypocritical douchebag, but who isn't these days. I agree with him about all the hysteria over the Iranian slut set to be stoned, it is not like these international types really give a shit about the woman, they just want to further their own agenda, which is to rid the world of capital punishment, because they think criminals of the worst sort be given dozen of chances.

Anyone who can plot to murder their own child deserves what's coming to them, and for nothing more than pure greed.

Castrate? That's pretty pedestrian, Jools. Did you ever see that movie Hostel II?

Ach, the bleeding hearts are sobbing over this. Tough tittie. Most of the posters here think an American's average IQ is about 70, so what's the big deal? Here's what she did:

Prosecutors and police portray Lewis as the scheme’s mastermind, who plotted the killings of her husband, Julian Lewis, and his son, Charles “C.J.” Lewis, to collect insurance money. They say she gave her conspirators $1,200 to buy guns, set up an alibi for herself , and left the door to her trailer unlocked so the gunmen could slip in.

    The Crime Report

Meanwhile, did the iranian dikhead let those other two American hikers go free? Ain't seen no lefties out at the UN protesting about them.

As a retired American lawyer, I find the death penalty to be repulsive. trials in America are not always fair, and there are vast differences in competence between the attorneys a rich defendant can afford, and what a indigent defendant gets. Just one more reason why I have so little respect or patriotism left for my home country.

^ And many find it repulsive as to how many thugs, rapists and murderers go free thanks to pro bono lawyers paid by the taxpayer.

So are you advocating that people charged with an offence should be denied representation because they are poor?

Did I say that? No. But that is a real bennie to Western criminals, innit? Ever seen that in Thailand? I find it repulsive that so many get off on technicalities because the cops are over-worked, or with light sentences and go out and repeat their crimes. It seems that pro bono lawyers don't give a fek about the victims' rights, nor do the far-left judges.

What do y'all think of this new case?

INDIANAPOLIS -- A woman charged in the deaths of two of her children allegedly locked them and three siblings inside a small closet and left to visit a friend, returning about 10 hours later to find the boy and girl dead inside.
    ...
(She)..told officers she "was not in her right mind" when she allegedly put her five children in an upstairs closet about 6 a.m. Sunday and placed a large bed in front of the door so they couldn't get out.
    ...
Police and neighbors said the siblings appeared malnourished, but Ballew said that while the two children's bodies were thin, she did not consider them to be emaciated or malnourished.

One would have hoped that the great US was more advanced than a developing country such as Thailand.

You`re right they are representing their clients and it is their rights that they are concerned about.

Here's an interesting set of statistics.

According to the Espy file the total number of people executed in the US from 1608 to 2002 is 15,269.

EStiamte are that the total number of executions in France from 27 June 1793 – 27 July 1794 number some 30,000

Not much to do with the current discussion, just found that interesting.

If you're referring to pro bono work, then yes. Plenty of it in Thailand. A friend of mine is currently representing 2 red shirts accused of "terrorism". Both women in their 60s who just happened to be caught in the big roundup inside the temple in Bangkok. He and his collegues have represented uni students arrested by the authorities over the years as well.

No, it would seem you have the wrong link or the page is gone as you get a 404 error from outside Thailand.
