Conspiracy theorist Alex Jones cannot use his personal bankruptcy to escape paying at least $1.1 billion in defamation damages stemming from his repeated lies about the 2012 Sandy Hook elementary school massacre, a U.S. bankruptcy judge ruled Thursday.

Bankruptcy can be used to wipe out debts and legal judgments, but not if they result from "willful or malicious injury" caused by the debtor, according to a decision by U.S. Bankruptcy Judge Christopher Lopez in Houston, Texas.

Courts in Connecticut and Texas have already ruled that Jones intentionally defamed relatives of school children killed in the mass shooting, and they have ordered Jones to pay $1.5 billion in damages.

Lopez ruled that more than $1.1 billion of those verdicts, awarded for defamation and intentional infliction of emotional distress, cannot be wiped away in bankruptcy. But he ruled that other parts of the verdicts, including $324 million in attorneys' fees that were awarded as punitive damages in the Connecticut case, could possibly be discharged.

It was not clear whether those punitive damages were attributable to "willful" and "malicious" lies, or whether they could instead be attributed to merely "reckless" conduct, Lopez wrote. Lopez said he will hold a trial to sort out the precise amount of the damages that could be discharged.

Attorneys for Jones and the Sandy Hook families did not immediately respond to a request for comment.

Sandy Hook Elementary School shooting victims’ families proposed that conspiracy theorist Alex Jones wind up his bankruptcy by paying creditors at least $85 million over 10 years or undergo an orderly liquidation.

The Sandy Hook families, along with an official committee of Jones’ creditors, argued in court papers Wednesday that the 11-month-long bankruptcy case for the right-wing radio host should be brought to a close by February. The creditors laid out a dual-option proposal in light of what they say is Jones’ failure to advance a viable way out of Chapter 11 while continuing to enjoy an extravagant lifestyle costing up to $90,000 a month.

The plan, as described to the U.S. Bankruptcy Court for the Southern District of Texas, would allow Jones to undergo an orderly liquidation of his assets or adhere to a 10-year fixed-payment plan with distributions of at least $8.5 million a year. Under the fixed-payment plan, the creditors would agree to release their roughly $1.5 billion in state court judgment awards stemming from Jones’ repeated lies that the 2012 massacre of elementary school students and teachers was a hoax.

Both options contemplate preserving causes of actions against third parties affiliated with Jones and his "Infowars" program.

“The time has come for Jones to choose whether he is willing to pay his creditors a reasonable portion of what they are owed or would prefer to remain embroiled in costly and time-consuming litigation for years to come,” the group said. “Whatever alternative Jones chooses, the Creditors’ Plan provides a clear path out of the quagmire of these cases.”

• Sandy Hook families offer to settle Alex Jones’ $1.5 billion legal debt

Sandy Hook families who won nearly $1.5 billion in legal judgments against conspiracy theorist Alex Jones for calling the 2012 Connecticut school shooting a hoax have offered to settle that debt for only pennies on the dollar — at least $85 million over 10 years.

The offer was made in Jones’ personal bankruptcy case in Houston last week. In a legal filing, lawyers for the families said they believed the proposal was a viable way to help resolve the bankruptcy reorganization cases of both Jones and his company, Free Speech Systems.

But in the sharply worded document, the attorneys continued to accuse the Infowars host of failing to curb his personal spending and “extravagant lifestyle,” failing to preserve the value of his holdings, refusing to sell assets and failing to produce certain financial documents.

“Jones has failed in every way to serve as the fiduciary mandated by the Bankruptcy Code in exchange for the breathing spell he has enjoyed for almost a year. His time is up,” lawyers for the Sandy Hook families wrote.

The families’ lawyers offered Jones two options: either liquidate his estate and give the proceeds to creditors or pay them at least $8.5 million a year for 10 years — plus 50 percent of any income over $9 million per year.

During a court hearing in Houston, Jones’ personal bankruptcy lawyer, Vickie Driver, suggested Monday that the $85 million, 10-year settlement offer was too high and unrealistic for Jones to pay.

“There are no financials that will ever show that Mr. Jones ever made that ... in 10 years,” she said.

In a new bankruptcy plan filed on Nov. 18, Free Speech Systems said it could afford to pay creditors about $4 million a year, down from an estimate earlier this year of $7 million to $10 million annually. The company said it expected to make about $19.2 million next year from selling the dietary supplements, clothing and other merchandise Jones promotes on his shows, while operating expenses including salaries would total about $14.3 million.

Personally, Jones listed about $13 million in total assets in his most recent financial statements filed with the bankruptcy court, including about $856,000 in various bank accounts.

Under the bankruptcy case orders, Jones had been receiving a salary of $20,000 every two weeks, or $520,000 a year. But this month, a court-appointed restructuring officer upped Jones’ pay to about $57,700 biweekly, or $1.5 million a year, saying he has been “grossly” underpaid for how vital he is to the media company.

Bankruptcy Judge Christopher Lopez on Monday rejected the $1.5 million salary, saying the pay raise didn’t appear to have been made properly under bankruptcy laws and a hearing needed to be held.

If Jones doesn’t accept the families’ offer, Lopez would determine how much he would pay the families and other creditors.

After 20 children and six educators were killed by a gunman at Sandy Hook Elementary School in Newtown, Connecticut, on Dec. 14, 2012, Jones repeatedly said on his show that the shooting never happened and was staged in an effort to tighten gun laws.

Relatives, of many but not all, of the Sandy Hook victims sued Jones in Connecticut and Texas, winning nearly $1.5 billion in judgments against him. In October, Lopez ruled that Jones could not use bankruptcy protection to avoid paying more than $1.1 billon of that debt.

“This is the first time that Alex Jones has revealed any sort of plan to pay the families back for the harm he caused them,” said Avi Moshenberg, a lawyer for family members who sued Jones in Texas.

In November, the families’ lawyers proposed a settlement of at least $8.5m annually for 10 years.

The new plan filed with the US bankruptcy court for the southern district of Texas requires court approval. Final hearings in the case are scheduled for late February.

Last weekend, he blubbered on air that he was being “targeted for abuse” by “deep state” actors who wanted to shut down his show, and he begged listeners to buy his dietary supplements to support him. The next day, the Sandy Hook families asked the Texas judge overseeing his bankruptcy case to liquidate his assets, including InfoWars and Free Speech Systems.

Jones’ attorneys affirmed in a Thursday court filing that “there is no reasonable prospect of a successful reorganization” of his debts.


Avi Moshenberg, a lawyer representing the Sandy Hook families, told CNN that the liquidation move ultimately “means [Jones’] ownership in Free Speech Systems is going to get sold,” ending Jones’ hold over a conspiracy theory empire he’s held for decades.


Yet Jones was uncharacteristically silent on the Friday taping of his show. Earlier in the week in at least two shows he emotionally ranted about how the Sandy Hook families were “abusing” him, blowing off steam about their lawsuit and the enormous sum he was ordered to pay. On Friday he largely carried on business as usual, spewing a typical roundup of baseless claims.

The big picture: The judge has yet to rule on whether Jones must also relinquish control of his Infowars media platform and its parent company, which will then be liquidated to help fulfill the judgements owed to the family.

• Jones has tried to use bankruptcy to protect his personal assets and his extremist media platform in an effort to limit the defamation damages after repeatedly spreading lies that one of the deadliest mass shootings in the U.S. was a hoax.

State of play: In recent days, Jones told viewers and radio listeners that his media company was on the verge of being shut down. He directed them to a new website owned by his father to continue buying his supplements, according to AP.

• Sandy Hook families have accused Jones of attempting to reroute assets from Free Speech Systems to other entities to support future operations.
• Jones recently asked to switch his personal bankruptcy from reorganization to liquidation to pay judgments the families are owed. The families asked a judge to switch Free Speech Systems' separate bankruptcy case to liquidation, as well.

Zoom in: Because of the ruling, much all of Jones' personal assets will be sold off. But he's expected to be able to keep his home in the Austin area and other specific exempted items.

• His personal assets are valued at around $9 million and he has already attempted to sell his Texas ranch worth around $2.8 million, his gun collection, a cryogenic chamber and other belongings.

• It remains unclear whether his social media accounts will be turned over to the court, which the Sandy Hook families requested, according to Reuters.

Conspiracy theorist Alex Jones' Infowars show is likely to be shut down within a few months, after a federal bankruptcy judge ruled Tuesday that plans to sell off the assets of Jones’ media company, Free Speech Systems, can move forward.

Net proceeds from any sales will go to Sandy Hook families who won some $1.5 billion in damages from Jones for spreading lies that the 2012 school shooting never happened. Some of Jones’ followers harassed and threatened the families for years.

Attorneys for a group of the families called Tuesday’s decision “a significant step forward” toward a “fair and equitable” resolution for all of the families.

“FSS will now be sold at auction, meaning Alex Jones will no longer own or control the company he built,” said attorney Chris Mattei. “This brings the families closer to their goal of holding him accountable for the harm he has caused."

A court-appointed trustee for Jones’ personal bankruptcy case has already begun the process of auctioning off the components of Free Speech Systems, the parent company of Infowars. Listed for sale is everything from production equipment to domain names and the Infowars vitamin and supplement online store.

The bankruptcy trustee, Christopher Murray, said in court that several parties have already expressed interest in buying FSS’s assets, including specifically Jones’ X.com account. The sale process starts with sealed bids, and then open auctions are set for Nov. 13 and Dec. 10 if needed. The bidders are unknown and could be anyone from another vitamin and supplement seller, to an entity trying to “catch and kill” the Infowars brand, or one that wants it to live on.

The fact that there’s been interest in Jones intellectual property assets, including his social media accounts, might mean the latter is more likely.

“What that suggests to me is that the highest monetary bidders are going to be entities who want to take this brand and run with it in some way,” says University of Florida bankruptcy law professor Chris Hampson. That would mean someone “in the right wing media ecosystem that would have a ready-made audience for them.”

Legally, Jones would be free to continue working for a new entity, but talks are continuing between Jones’ team and some of the Sandy Hook families seeking a deal that would bar Jones from continuing to speak about the school shooting.

A U.S. Justice Department lawyer — acting as a kind of bankruptcy watchdog — had tried to stop the sale, arguing that the bankruptcy trustee appointed in Jones’ personal Chapter 7 bankruptcy has no authority to sell off FSS’s individual assets since Jones’ company is no longer in bankruptcy and the company’s assets are “not the property of the Jones estate.” But U.S. bankruptcy Judge Christopher Lopez rejected those arguments Tuesday, saying he would clarify his order so the sale can go ahead as planned.

But as Hampson puts it, the court “has saved some big fights for later.”

That includes the fight over Jones’ “RealAlexJones” X.com account. Jones’ attorneys argue that’s “the exclusive property of Jones’ natural person” and cannot be sold. Doing so, they argue, would violate their client’s right to publicity, his privacy rights and would amount to “involuntary servitude” under the 13th Amendment.

Meantime, the Sandy Hook families remain divided about how any proceeds should be distributed. But no matter how they slice it, court filings suggest the total payout will be under $8 million, a mere fraction of the $1.5 billion they’re owed.
