    I had this raised back in 2008 just prior to getting my plot of Villa land and began constructing with an Aussie-pooled Wellness targeted Villa aimed at long-term Renters and this is a safe option despite what is now causing some other "illegal" owners with their scheming maneuvers to land ownership and worst of all, avoiding local taxes. Never avoid paying taxes, its what that builds an economy and they will catch up with you someday... unless its in a country run by that "bad-mouth" Chavez...

    In Thailand, they are just asking for it.

    Our Villa village is OK and not a sand or dirt to worry about esp. with my Villa sighted just 80meters from the Royal family's domain perimeters.

    I'm sure glad I didn't listen to all this 'free advice' (from guys who never owned a square meter of land or made any real money in Thailand) dispensed by all the bar-stool experts back in the nineties.

    People who have managed to do well over here (like Loy Toy) might actually know what they're talking about...

    Scare tactics work if you have bent the rules.I cant condone exploitation by farangs as it is not our country and we should play by their rules.
    However I do shake my head when they start talking about confiscating or fining those who have bought a normal residence in their wifes name because the wife was not the one providing the funds.
    It would be interesting to know how many fall into that category.
    Regardless of what transpires I stick to my orginal belief that money spent in such manner needs to be disposable income as the rules are easily changed as we know.

    90% of beach front land is owned by farang, I'd like to see where he gets that statistic from. I lived here for 10 years and I don't know one farang who owns beach front land.
    Certainly not around this area and if they did it's to expensive at least 20 million a rai.

    A normal residence in the wifes name is safe, I believe, because the property is in the name of a Thai and will continue to be so after the falang passes on. So far I don't know of anyone who has ever lost their home this way. Also it is not legal for the falang to own land so if you are married, whoses name you going to put the house and land in? - Your wife of course.

    As for those who do things illegally - I hope they catch you, break you, and thrown your ass out of the country - you are the kind that mess up a good thing for all people.

    I hate to differ but That would have to be one of the most common ways a loved up falang has lost his money.

    Silly falang places his faith in his Terak buys the friggin house in her name because they are in love and he trusts her to never kick him out but unfortunately the next thing he knows he's kicked to the curb.

    Lets be sensible about this and just tell it like it is bro, that being nothing is safe in Thailand as everything relies on the honesty of the Thai.

    That's extremely safe -------------

    Until your relationship goes tits up.

    There's only one safe way around this issue and that is be prepared to right off your investment if things go south.

    If you can afford to do that then go for your life mate but if you lose it all please don't start a new thread about it as these stories are a dime a dozen.

    Actually that method is fool-proof and even if the relationship broke down the lessee still retains full legal right to live in the house for the full term of the lease contract and take up the option on the second 30 years if so desired.

    That is why, and as I suggested before a proper lease agreement has to be prepared with an attached will and testament in the event anything happens to the lessor during the term of the lease agreement.

    The lease has to be prepared in triplicate, in both Thai and English with one copy registered at the relevant land office and attached to the land title deed (Chanoite).

    I suppose Terry57 has never heard of anyone getting bumped off for what is in the Thai wife's name then?

    I personally know one who was killed, and another who was lucky to survive. And I don't even live in Thailand.

    Anyone dumb enough to buy a house or business in their Thai BG's wife's name better look over their shoulder.

    And yes, I'm sure there are exceptions, before those in loving relationships decide to jump down my throat. <yawn - cue violins>

    I even know one bloke who has just built his teerak and her parents a lovely little country house EACH. Her other farang b/f stays in it when he's not there.

    I've never understood why anyone (other than leasing from your spouse) would agree to the leasehold "purchases" that are alternatively offered farangs in resort areas (and Bangkok).

    Effectively they are paying "rent" - but they're paying it all at once and all up front.

    If you really insist on ownership, then buy a condo. They are overpriced, but perhaps not so bad if you've cashed in on over-inflated Western markets (ebfore the crash in some places). That way you get the freehold.

    Why people insist on trying to skirt around the property laws of Thailand when there is so much to lose (for most people) if they change the retirement income visa requirements or other rules is beyond me. Just rent. It's cheaper and you have much more flexibility

    The price-to-rent ratio here is a clear indicator of why renting is better. In Bangkok (and places like Phuket), a three bedroom condo will cost you around 12-14 million baht, a 'decent' house and land (that you will never "own") is around 30 million. So 500,000 - 1,000,000 USD.

    If 70,000 USD is the average western income (I'm being generous I know) that's between 7 and 14 times earnings. Most people shouldn't be buying anything more than 4 times earnings - and a bank would not likely lend you money on anything more than that anyway.

    To rent a similar place it would be around 60,000 - 120,000 THB (2,000 - 4,000 per month), but you can easily get something big (but maybe not really modern) in a good location for far less (like 30,000 - 60,000).

    In other words you could rent for 20 years - and invested your money in property or anything else back in your own country to finance your lifestyle.

    Not quite, the lease can be in Thai or English, only one will be accepted in a court of law, that will be the Thai one unless it states on both that English is the governing language.

    I paid 3,000.00 Baht up front and when my wife put my name on the chanoit as the lessee plus 5,000 Baht legal fees.

    Foking cheap as chips I reckon covering 30 years rent for the family home.

    Not really safe at all ,,infact if what is proposed IS passed then surely a lot of the wives would loose it all anyway being unable to substanciate where she obtained the money from to begin with ie . husband ,,,,,,,,,, but pretending it was,nt his money .
