    There are foreigners making a lot of money speculating in real estate- it's not all about owning your own home.

    These days I use my wife as a proxy (which also saves on taxes, and is a great way to go as long as your relationship is solid- if it goes south you could be in trouble)- that's the best way to go for a foreigner, but I wouldn't be too worried about using my company.

    Land reclamation apparently isn't merely restricted to Phuket. There was a meeting yesterday in the grounds of the local police station in the village where i reside. (Close to a National Park).

    The Thai residents in the area were duly informed that those who lived within the confines of the park, despite having houses constructed by their forefathers would have to move. I've no more info relating to government assistance etc: but isn't it a wee bit strange that government policy has been promulgated just 2 days prior to a general election

    I reside in Issan btw.

    The Hi-So Thai hold grudges. Surayud lost face when he had to hand back the forest land he bought from a rightful peasant owner (who wasn't allowed to sell). It could be related to that. (Surayud was a military appt PM after the Coup and a (ret) General himself with a history of putting down democratic rallies).

    If you have the land in your company name just transfer the title back to yourself and based upon the 30 year lease agreement.

    It will cost you about 3,000 Baht to be a totally legal land lease owner.

    Not bad - but that doesn't get around the fake company name in the first place does it? I mean unless you really have a Thai company that is a going concern and not just some shell company to own a house/land.

    You can't transfer the title deed to yourself, you can at most be registered in it as a lease holder but there need to be an owner of the land as well.

    If you don't want your company to be the owner then you'll have to find a trustworthy Thai who can own it.

    Any company that does not submit 6 month reports and pay taxes will be a target. That's what most farangs forget when they purchase properties this way and end up in the shit.

    I would suggest that farangs should then remove their names from the company shareholder list after they have taken up the lease option.

    And the lease contract should be prepared by a knowledgable lawyer and registered at the land office.

    Normally no mate but those that have broken the laws in the first place can correct their error by taking up the lease option.

    That doesn't answer the question about shell companies that aren't doing shit - other than owning a property. That's the real problem for foreigners using this system. Show us the money as they say.. otherwise it's just a nominee/proxy to hold property (illegally).

    Something called a "usufruct" - there's a german guy here (or maybe on thaivisa) that talks a lot about it. Basically means that she owns the land and youa re entitled to full use without eviction or harrassment of your life and enjoyment on the land til you die. That seems to be the best bet.

    But hey - if you break up the last place you're gonna wanna be is there. Believe me. R-E-N-T.. keep you money back in Canada or wherever you said you were from. Best (unbiased) advice I think you'll find.

    The Thai Government cannot prove a thing if this company is paying it's taxes and all the documents are in order.

    Don't be so sure Loy Toy - they've been working on this for a while now - and very specifically have said they'd go after fake companies. But I agree with the reasonable assumption that nothing may come of it.. we'll see.

    Tom, I would never suggest that any foreigner should buy a property in a Shelf Company name as it is clearly illegal.

    But if they have I would suggest that they do some small trading through that company, pay taxes and keep out from under the microscope.

    They will always talk about clamping down, even though they have always known about the nominee company loophole and in spite of this are still allowing it today.

    No it does'nt. It has nothing to do with farang. The OP is refering to large Asian companies buying up huge tracts of land and growing crops to be exported.

    Yip live in Canada. Hard to break the idea of owning your own place in the sun. I wonder if the mrs would go for that? No rush at the moment so will be watching what happens very closely.
