    Criminal Court convicts for tax evasion









    The Criminal Court hands down a guilty verdict on the tax evasion case involving Khunyin Pojaman Shinawatra and two fellow defendants.

    The court sentences the three defendants to serve three years in jail.

    Positive though, at least they have had to nuts to tell them their guilty even if they will never spend a well deserved night behind bars.

    Following the guilty verdict on the tax evasion case, the defence team has rushed to apply the bail applications for Khunying Pojaman Shinawatra and two other defendants pending the appellate review.

    Pojaman, Bhanapot Damapong and Kanchanapa Honghern are being detained in the court building to await the bail review.

    Former prime minister Thaksin Shinawatra, his three children and his sister Yingluck Shinawatra left the court room right after the verdict session.

    That will be the bit that lets us know exactly how serious they are about this. If they deny bail the gloves are really off......

    The wife of ousted Thai prime minister Thaksin Shinawatra has been found guilty of evading millions of dollars in taxes and sentenced to three years in prison.
    The landmark ruling against Pojaman Shinawatra strikes a major blow to Thaksin, who was ousted in a 2006 coup, and has long denied any wrongdoing by his family in the tax case and several other corruption cases against his inner circle.
    "The defendants are high-profile and wealthy citizens," the judge said.
    Pojaman's husband "was the leader of the country and she is obligated to pay taxes as a model for society".
    "But the defendants lied, cheated and conspired to evade taxes, which is regarded as a serious crime," the judge said.
    The 51-year-old former first lady, in a pale blue suit and strand of pearls, looked stunned as the judge pronounced the verdict. She was promptly released on 5 million baht ($A158,000) bail and walked out of the Bangkok Criminal Court with her family into a waiting car.
    Thaksin's spokesman, Pongthep Thepkanjana, said lawyers planned to appeal.
    "Thaksin is not disheartened," he said.
    "They respect the court ruling but it is not the end. We will fight until the end."
    Pojaman, her brother and secretary were convicted of evading millions of dollars in taxes in 1997 through a complicated transfer of shares in the family's flagship business that involved placing stocks in the name of one of the family's maids.
    The court also sentenced her brother, Bhanapot Damapong, to three years in prison and the secretary to two years.
    All three had pleaded innocent.
    More than 300 police were deployed in the area amid concerns of possible protests by both Thaksin's supporters and opponents. More than 1,000 supporters mobbed the family as they exited the court.
    Thaksin was ousted after being accused of massive corruption and abuse of power during his two terms as prime minister. Four corruption cases have been filed in the courts against Thaksin, two others against his wife, and three cases against two of his children. Many others are under investigation.
    The latest case centred on a 1997 transfer of shares in Shinawatra Computer, the company that later became Shin Corp - Thailand's biggest telecommunications company - before it was sold in 2006 to a Singapore state-owned company for $US2.2 billion ($A2.3 billion).
    The share transfer was valued at 738 million baht - about $A23 million at the current exchange rate - and deemed tax-free. The family had listed the deal as a transfer of shares carried out within the stock market, which is exempt from capital gains taxes.
    After Thaksin's ouster, an investigation was launched into the deal that prompted the family to change its story.
    Pojaman, through her lawyer, said she bought the shares from a family maid and transferred them to her brother as a gift, which under Thai law is not taxable.
    Thailand's Assets Examination Committee determined last year, however, that a cheque issued to the maid was later deposited in a new bank account belonging to Thaksin's wife.
    The committee said Pojaman and her brother had misrepresented the nature of the transaction to avoid paying taxes and should pay back taxes of about 546 million baht ($A17 million). Thaksin was not implicated in the tax evasion case.
    Thaksin was known to have transferred shares in Shin Corp, his telecommunications empire, to his maid, chauffeur, relatives and others to shed holdings before becoming prime minister in 2001 to sidestep the conflict of interest laws.
    Thaksin was deposed after months of street demonstrations in Bangkok demanding he step down because of the allegations.
    He returned to Thailand earlier this year after his political allies in the People's Power Party set up a coalition government.

    Thaksin lawyer saying that he has applied for bail for all 3 and they will appeal. If they can get the sentence below two years they would qualify for a suspended sentence.

    Can't really deny bail on in this case, but now that she is a convicted crim does she still get to travel to all these countries that won't allow convicted criminals in?

    Pojaman should not be able to leave the country. I know it's easy for her to go through any border but she basically is tied to Thailand now for years. There's absolutely no reason why she should have to leave this countyr. She tied down through the appeals and possible retrial. he hubby and kids may be able to go so long as there are no convictions against them for anything.

    I'm sure the wickedness of the S family will kick in at this point. They are going to have to call up all their demons scattered around the country to free themselves from Batman.

    She has been found guilty so why is she out on bail?

    She should be behind bars until her appeal, and only if it is successful, then she should be released.

    Thai legal process allows you to appeal all the way up. Only when you lose the final appeal need you serve your time as long as you have paid the requisite bail all the way through
