There are a couple of people at my place of work we would love to get shot of - and we can't. Even if we followed a well documented process (warning, second warning, final warning, termination), they could still appeal to the labour courts, and would most likely win.
It is so difficult and protracted a process that the policy is to let them run their contracts out. Seven years more in one case.
