    In a post on the Thai Visa Forum, a document purported to be a pending police order details strict new measures as part of a crackdown on foreign nationals in the kingdom.
    "Today, Thaivisa.com has been given access to a new Police order proposal that is due to be signed and released imminently, detailing tough new measures for foreigners who overstay in Thailand," reads the post.

    According to the details posted, foreigners who surrender to authorities will receive lesser bans on travel to Thailand.
    Those who've overstayed their visas more than 90 days will receive a one-year ban, while those with more than one, three or five years on their expired visas will be blacklisted for three, five and 10 years, respectively. Been laying low more than 10 years on an expired visa? Lifetime ban.
    Those caught by authorities will receive a five-year ban for overstays less than one year, while anything longer will receive a 10-year ban.
    As the post stresses, none of this is final nor has been announced, and the authenticity of the police order could not be substantiated.

    Starting from the moment they pass the order?

    I wonder if those on an overstay right now will get their act together and get the proper visas sorted out?

    .....doubt it. Will make the "i'm on an overstay" threads more boring I guess - leave, pay the money, and see you in a few years time.

    How do you work that out?

    Caught under a year, 5 yrs ban. Caught over a year 10 years. If over 10 years? I would assume ban for life - not clear. Anything under 10 yrs then you are considerably better off handing yourself in.


    Just something else, apparently they have stopped issuing Visa On Arrival at land crossings. So if you exit and expect to get another 15 days walking across, then no, you will not be let in.

    It isn't just immigration. This government is going through every aspect of the law applying new interpretations, and it isn't wasting any time.

    We are having to waste an enormous amount of time on the latest ideas on taxation.

    The motorsai taxi vest scheme is being totally changed.

    Farangs are already being denied visas on arrival and some nationalities are being denied visas totally.

    Nobody cares whether these ideas are practical, they are just interested in keeping their jobs...which means doing what they are told.

    Our glorious leaders know that Thailand can manage very well thank you without illegal farangs. I say get them out, not like Europe where they are housed and fed and paid not to work for ever.

    When they run out of illegal Farangs the present administration can always increase the income requirement for retirement visas with no grandfathering for existing holders. That would make even more Farangs illegal. Even more property to be "fairly" distributed.

    Reading the new regulations I suspect the maximum overstay fine is going to increase to ThB 45,000 (90 days at ThB 500).

    Fuk them off I say. Way to easy to get legal , many different Visa options and if one cant be bothered to stay or get legal one deserves to be banned.

    In Most other countries one would be in Jail if staying in country Illegally.

    Try doing that in Australia.

    Ive always been amazed that Thailand's overstay laws have been so lenient.

    Times had to change EH.

    They have had a blinding run though same as the Visa runners.

    Not sure why you object to it. They are tightening the loop hole that illegals have used in the past. Those working here can get a work permit and stay legally. Those that can not will have to go somewhere else. These will not be a huge loss to Thailand, especially if they sweep up the ne'er-dowels at the same time. Just do things properly, and nothing to worry about. Break the laws, they are saying that it is going to stop.

    I've not heard of people having there houses confiscated just because they are not allowed into Thailand through having no visa. The property would still be theirs, so that is a pretty daft thing to insinuate. If they do raise the retirement visa limit then this is only to reflect inflation - might result in less old timers falling out of buildings or jumping off of road bridges.

    As for the increase in OS fine - how do you deduct that?

    It does surprise me Terry what people are upset with. They seem to be saying "well, I broke the law, using tourist visas for ages when I am not a tourist, but living here and working illegally, and it's unfair of them to enforce the law". Just bizarre.

    What I don't get is the outpouring of hatred and bile over those who overstay How does a person overstaying affect anyone else here ? It has no bearing or effect on my visa or work permit so why should it be any concern of mine what other people choose to do.
    I wonder how many of those spouting this bile stick to the exact letter of every law here ? How many ride their bike without a helmet, Thai license etc. drive after a few beers ?

    The word is deduce.

    A) Many long-term "tourists" have bought cars, electrical goods, even property. So someone who is prohibited from re-entering Thailand for, say, three years, is going to be either have those things stuck here which he cannot use, or sell them.

    They are going to have to be sold, and fast. Not confiscated. Where did I say confiscated? No, the owners will sell them voluntarily.

    B) Indeed, raise the retirement visa income limit by the level of Thai inflation since the last increase. How long do we give those retirees who no longer meet the requirements (the newly illegal ones) to get out? 24 hours? No need to confiscate their property, they too will want to sell....voluntarily of course.

    C) Work permits. Yup if your work permit allows you to carry out your duties in Bangkok and work arises in Phuket nobody was really bothered previously. Now it's a fine if you're caught. Nasty illegals. Work permits are highly restrictive as to location and duties permitted.

    D) The new overstay proposals do not impose any new "harsh" sanctions until the overstay exceeds 90 days. Between 40 and 90 days there is no difference in the penalty...yet. 90 days overstay and you are banned from re-entry for one year. There is clear scope to extend the maximum fine to ThB 45,000 ( ThB 500 x 90 days).


    I'm not saying I disagree with any of the new regulations. I have not bought anything more expensive than a 3D TV in eleven years here. No intention of doing so either. We are all guests here, and have to re-apply for a new visa every year. The Thais are perfectly entitled to change the rules at any time.

    Nothing, so long as you don't complain when the laws, or their application, change overnight and you have to leave. It's the people on retirement visas I feel sorry for, the ones who just manage to scrape the ThB 800,000 every year. They will be the next illegals to be affected, once they become illegal.

    Mate, you have got that wrong.

    Its all about taking the piss out of the punters who consider they are being hard done by and discriminated against because at last they are being made to abide by Thailands Immigration rules.

    Us who are legal don't really G.A.F.Fuk about their Visa problems.
