    My employment came about from the Aussie company i was employed with, they set-up a joint venture out here, i was confident the work permit would arrive.

    My second work permit came about after my first contract was done, i holidayed here for 3 months before i was heading home, the two companies from the original joint venture separated with the Thai company buying out the Aussie one, they offered me another job, this second time round it still took a month or two to get the work permit sorted.
    Ive just had my work permit extended by two years, even this took nearly a month for HR to sort out.

    As to the OP, yeah fuck working for 5 months without pay or work permit, money aside the mere fact you was/is on a Non-O and they had not made arrangements to convert it to Non-B should have raised serious alarm bells.

    Do you have any recourse, I doubt it, situation licks balls but unless your willing to engage a decent (expensive) lawyer i reckon your just gunna have to cop it on the chin.

    Try with Marmites advise, go and have a talk with a lawyer, get a grip on your risk's and your possibilities, maybe a couple of nasty letters from a lawyer will be all it takes, this guy might have many other reasons why he would not want any Thai authorities looking to closely at his business.

    Thailand is incompetent farang scammer heaven, they set up as proffesionals in every trade imaginable and they all deliver crap service and work, they rely on gullible tourists and newcomers and bar/golf farang "friends" they can cheat and rob. To be fair many set out with the best intentions, but when their initial capital has gone and their fantastic business scheme starts to go down the drain, they become a danger to everybody, they lend and never pay back they cheat new costumers ect. ect. It's an old story out here and you have to always be very careful and vigilant.

    I was inquiring every month because if you recall I also wasn't being paid. I was repeatedly told not to worry everything will be sorted. I'll be the first to admit that I was stupid for believing him, but I'm not accustom to having someone I believe to be a friend lying to my face, and to be honest it's not something I want to become accustom to.

    Actually that's a good point. That same thought had occurred to me because at the time the industry was in a slump. Had things been more optimistic, perhaps I wouldn't have been burned in the first place. Had I been the Boss in that situation I think I would have been more sincere with my staff rather than lead them on.

    Firstly, TimTang, you have my deepest simpathies but you have ended up with an arsehole like an engine off a jumbo jet... It happens to us all, but surely after the first month you should have seen something going wrong? You said you have a family to support, what sort of education are your kids getting?

    Secondly, The comments about the Labour Department... I would be surprised if they give a shit about a farrang in the chocolate syrup?

    Lastly, What's wrong with earning less 50,000 baht per month, I earn that and live quite comfortably? I know other poor fuckers earning 25k and they are perfectly happy too.

    A letter from a lawyer "reminding" the employer of his obligation under the law may get him to pay the salary.

    Yes I know I'm not in a very strong position but I just thought I'd throw it out there to see what kind of feedback I get. I do have a retirement fund but I don't really like drawing from it when I'm quite capable of working. Finding a job in Thailand is the hard part; I like working if I'm doing something I find interesting. I'll keep pursuing that albeit wiser but poorer.

    I never complained about my wage, I was responding to someone else's post asking why I would work for such a small wage. Believe me! I'd be happy to be making 50,000 right now. Like I said before, I don't lead an extravagant life style

    That's a very informative post. I have actually gone through the labour laws but I'm still not really sure where I stand. I was hoping someone else might have had a similar experience but my searches didn't amount to anything.

    I came here initially because of the Legal section but I couldn't start a thread. I just had a feeling this was a better site with regards to legal matters. I guess I could be wrong, I only discovered this site recently, maybe Thaivisa is better with legal matters. I suppose the more advise the better.

    Maybe that's why some of you are lucky enough to have left your home countries to live in Thailand.
    And maybe that's why on the last 5 of my 10 trips to Thailand I only hang with my Thai friends, and want to live there maak maak!

    For many foreign nationalities (outside of teaching) it's illegal in Thailand and a WP will not be issued.
