    What happened to Sebastien? I never saw this topic as I work a lot and don't come here often!!!!!!

    Sorry and don't hesitate to send me email or private message if you have questions. That one is easy for me!

    I'm a Canadian registered lawyers and know about divorces in Canada. It's a federal law and there are 3 grounds.

    The law is here:
    Divorce Act

    And a divorce in Thailand can be recognized by Canada under article 22 with some conditions (one of the parties is resident of the country, etc.)

    Second, we do divorces here in Thailand and there are 2 ways to divorce:

    A) Mutual consent. Can be done EASILY and QUICKLY. But article 1514 seems to say that the 2 parties must be here in Thailand. I can't confirm. We had a similar case in Korat and the Amphur ASKED and IT WAS A CONDITION HERE that the two parties were present. No power of attorneys or documents signed...

    B) The other option is going to Court with ONE of the grounds mentionned in the link. A 3 years separation in that case would be a reason to go to Court and ask for divorce. (see article 1516). In that case, the foreign husband must be notified according the procedural regulations but doesn't have to be here.

    a friend of mine was asked for a divorce from his thai wife before she would sign she wanted 200,000 baht he told her to go away and he would wait the 3 years

    It is not so easy. International family law is very difficult and confusing. Believe me, I just went through it. Divorced in Thailand, turned out I should have been divorced in Germany, just got divorced again at the court.

    So maybe the woman in question has to get a divorce in Canada. If she just get a divorce in Thailand she may be able to marry again but not someone from anotehr country as they actually check as my ex experienced.

    Best to ask a lawyer, preferentially a canadian lawyer.

    1. Where did they get married? Thailand or Canada

    2. Does he have any assets in Thailand? Maybe sue him for child support later as the Thai court order is not enforceable in Canada out of a Thai court.

    Speak to a Thai divorce attorney called Jeed(?) at this place Siam Legal: Thailand Lawyers, Attorneys, Solicitors - Visa, Property, Business, US UK her English is excellent and she would be able to give you possible solutions as she does a fair amount of divorces in these cross border marriages. I attended a talk she gave a few months ago in Bangkok on Family Law.
