    Samsung Galaxy Nexus back on sale in US thanks to Google Android workarounds

    The ongoing patent war between Apple and Samsung continues to generate new drama, with the United States Court of Appeals for the Federal Circuit now lifting the sales ban recently imposed on the Galaxy Nexus smartphone.
    On 30 June, US District Court Judge Lucy Koh embargoed the Galaxy Nexus smartphone by issuing a rare pre-trial injunction and preventing the device from being distributed Stateside.
    Making that ruling, Judge Koh ventured that the Samsung mobile infringed on four patents held by Apple, and that the Cupertino-based tech giant stood to lose substantial market share in the absence of a preliminary retail prohibition.
    On Friday, the Appeals Court overturned this decision, apparently satisfied with Google's announcement that the Galaxy Nexus would now ship running the most recent incarnation of its operating system, Android 4.1 'Jelly Bean,' which contains software tweaks designed to address the disputed patents - and that version 4.0 'Ice Cream Sandwich' would also be updated with the workarounds.
    However, patent blogger Florian Mueller has noted the temporary nature of the ruling and the burden it puts on Samsung's manufacturing arm.
    "Samsung can now sell some more of the Nexus units it already has in its US warehouse, but the temporary stay could go away within a matter of days or a very few weeks. Samsung will need to build, and ship to the US, some non-infringing Nexus units anyway to avoid or minimise disruption in case this temporary stay is not extended," Mueller wrote.


    The legal onus is now back on Apple, who has until 12 July to register an objection to the latest ruling. The Appeals Court stopped short of lifting the ban on the Galaxy Tab 10.1, which at present remains banned from shelves until the trial, scheduled for 30 July. As a result of the decision, Samsung's Galaxy Nexus has now reappeared as available for purchase in the Google Play store.
    Samsung and Apple are among the companies currently locked in tense, patent-related legal battles across the globe, as leading firms vie to expand their share of the smart device market amidst projections of continued growth.

    It's a win for Samsung Electronics, which hasn't fared so well in the legal arena lately. The decision affects three Galaxy Tab models.

    After several legal defeats resulting in a product ban, Samsung finally get a court to side with it. The company said the High Court of England Wales ruled that its Galaxy Tab did not infringe upon Apple's tablet designs, and found 50 different recognizable traits.



    The victory is a measure of relief after a few rough weeks in which a U.S. judge ordered a ban on the Galaxy Nexus, resulting in Google pulling it from the Google Play store before putting it back up Saturday. Samsung has filed an appeal and the ban has temporarily lifted.


    The moves are part of a broader legal skirmish between the two largest smartphone makers in the world, and part of Apple's legal campaign against Android and any company supporting the operating system. Apple and Samsung have lawsuits filed in different courts around the world, and are looking for a ban or decision so devastating that both companies will be forced to sit down and work out a resolution. So far, both sides have only seen minor victories.

    CNET contacted Apple for comment. We'll update the story when the company responds.


    Today's ruling affects three versions of the Galaxy Tab, the Galaxy Tab 10.1, Galaxy Tab 8.9, and Galaxy Tab 7.7. Differences the court cited were the thickness of the devices, front and rear surface designs, and lack of physical buttons.


    Samsung said it had requested this voluntary trial to get ahead of Apple's claims its tablets copy the iPad and its design. Samsung said it welcomed today's ruling.

    It's funny you "forgot" to include the actual statement by the judge, regarding his ruling:

    The design for three Galaxy tablets doesn’t infringe Apple’s registered design, Judge Colin Birss said today in London in a court fight between the world’s two biggest makers of smartphones. Consumers aren’t likely to get the tablet computers mixed up, he said.
    Oh, and in closing:

    The Galaxy tablets “do not have the same understated and extreme simplicity which is possessed by the Apple design,” Birss said. “They are not as cool.”
    Wow, even the law agrees.

    A new, inexpensive game console built on the Android ecosystem has been funded by gamers clamouring for a change in the games industry.
    The console, called Ouya, aims to get developers working on projects for the TV again, rather than smartphones and tablets, and intends to offer exclusively 'free-to-play' games.
    What that means is the there will at least be free demos of games, and many will employ a free-to-play model funded by completely optional microtransactions.
    The creators of Ouya were asking for $950,000 to fund the project on crowd-funding website Kickstarter. At the time of writing, the project had raised $1,045,170 in twelve hours

    Despite Motorola's patent portfolio being universally regarded as useless, for that purpose? Contains a ton of patents unrelated to mobility. Kudos to the Moto guys for putting the fear of God into Rubin and pressing him to green light the purchase and making out like bandits, but as a GOOG shareholder I'd call to replace Rubin.

    Not that it matters, seeing as how Moto consistently builds the worst devices, in the current mobility space. The days of RAZR are long gone.
