Man jailed for urinating on woman

A man who urinated on a woman as she lay dying and shouted "this is YouTube material" has been sentenced to three years in prison.
Anthony Anderson also covered Christine Lakinski with shaving foam after she collapsed in a Hartlepool street.
The 50-year-old, who suffered from a number of medical conditions, was later pronounced dead at the scene.
Anderson, 27, and from Raby Road in the Teesside town, had earlier admitted outraging public decency.
The court heard how, on 27 July, Miss Lakinski was making her way home with a box of laminate flooring when she fell ill and stumbled into a doorway.
Totally shocked
Anderson, a former soldier, had smoked a cannabis joint and been drinking when he and two friends spotted her.
He tried to rouse her by throwing a bucket of water over her, before urinating on her and covering her with shaving foam.
A crowd had gathered around, watching and laughing, and the incident was filmed on a mobile phone.
She was later declared dead at the scene, the cause of death being given as pancreatic failure.

Magistrates in Hartlepool had referred the case to Teesside Crown Court so a longer jail term could be handed out.
Judge Peter Fox, the recorder of Middlesbrough sitting at Teesside Crown Court, said: "You violated this woman in an incredible way, and the shocking nature of your acts over a prolonged period of time must mean that a prison sentence of greater length is appropriate in this case."
Outside court, Miss Lakinski's family said in a statement: "We remain totally shocked that anyone could behave in such an appalling way.
"The fact that Christine was dying makes this man's actions even more sick and inhumane.
"However, those who stood by and did nothing to stop Anderson are also guilty in our eyes. "It beggars belief that these people chose not only to condone his cruelty, but also to walk away from a neighbour who was clearly in distress and needed help." The family statement added that Christine had "faced immense challenges throughout her life", yet still had managed to "forge an independent life for herself".

Its pretty dreadful behaviour but 3 years jail seems a bit much. The fact that she died makes his behaviour seem outrageous but if she hadn't died would he have got off without a custodial sentence since there wouldn't have been such public outrage to appease? He didn't actually cause her death and doesn't seem to have contributed to it other than by failing to render assistance.

I remember at school being with a small group of mates and we came accross an old derelict who had fallen asleep drunk in a public loo. My mate tipped a whole indian takeaway over the guy's chest just for a laugh. A very shabby thing to do to an old drunk but he would not have got more than a caution if he had been caught. If the drunk had died in his sleep through no result of my mate's actions would he then have been looking at a jail sentence?

I agree it is disgusting but presumably he didn't know she was dying. If she really had just been drunk and had woken up later and gone home and cleaned herself off what should the sentence have been then?

It was a gross act of humiliation but it wasn't violence or actual bodily harm.

On the other hand if he did know she was dying then certainly he should go to jail, but then so should the onlookers.

Even at the age of 15 I remember thinking tipping curry on a passed out drunk was pretty rotten - it was done spontaineously without discussion - I am pretty sure I would have tried to stop him if he had said anything before doing it.

The northern chav's situation is different because she was ill not drunk and she died from the illness shortly after. But I guess he probably didn't know either of these things so from his perspective his choice of actions were not that much worse than my mate's.

If he had been caught pissing and squirting shaving foam on a drunk who had later woken up and gone on their way then what should his sentence have been? I guess he would have got a fine or community service for breach of the peace.

I accept that punishment should take into account public outrage at the fact that she was not drunk she was ill and she later died. Just curious that someone's fate can turn so heavily on facts of a situation that they may not be aware of and outcomes that they possibly could not foresee.
