According to this NBC News report, the guy and his wife had both accepted $800 vouchers for giving up their seats and voluntarily left the plane, and then reboarded when they found out how long it would take to continue their journey:

Maybe the report is inaccurate, but if they accepted the vouchers there will certainly be a paperwork trail. There's usually more to the story in any case when something like this happens beyond initial assumptions.
With regards the sex and drugs allegations, the papers were referring to a man called David Anh Duy Dao. The doctor dragged from the plane was called David Thanh Duc Dao. United appear to have done a background on the wrong person.
Maybe he can bundle Jarvis in with the daily mail for his defamation case.
I suppose they could argue that if he had voluntary and for compensation given up his seat, he had no right to be on the plane at all at that point and was refusing legal orders to vacate- if that's the case, you're going to be removed one way or the other. It certainly seemed extreme no matter what the full story is.
That said, if the above scenario is incorrect, I agree with you, but if the report is correct, his ticket would have been cancelled at that point and he was essentially trespassing, and that gives the legal right of a forced removal (if necessary).
