If the British embassy had an ounce of decency left they would condemn this miscarriage of justice and arrange for the immediate return of the victims' families to the UK. Court may order retesting of DNA in Koh Tao double murder case
A court looks set to commission the Central Institute of Forensic Science (CIFS) to retest the DNA of two Myanmar nationals who are facing charges of killing two British backpackers in Thailand last year, an informed source disclosed yesterday.
The order is expected to be issued today, according to the source.
The move, if made, promises to clear doubts as to whether migrant workers Zaw Lin and Win Zaw Tun, both 22, were made scapegoats. Both suspects have pleaded not guilty in court, saying that they initially confessed under pressure from police.
So far, police and public prosecutors have cited DNA results as incriminating evidence against them, prompting their defence team to request fresh DNA tests.
CIFS chief Khunying Porntip Rojanasunan said a retesting of DNA was not common in foreign countries. So far, she said the retesting was quite rare in Thailand and hence she was not sure about the evidence storage process.
"We will have to see the conditions of the evidence first," she said.
The two Myanmar nationals are standing trial for the murder of 24 yearold David Miller and the rape and murder of Hannah Witheridge, 23, on Koh Tao in September.
Much of the defence's case revolves around a bid to retest key forensic evidence, including the DNA on cigarettes and a condom found near the crime scene as well as DNA swabs taken from the victims' bodies.
"The DNA samples taken from the bodies are not my responsibility. They are in Bangkok," Police LtColonel Somsak Nurod added.

10 Jul 2015 — Today marks day 3 of the trial. While the trial has only just begun, there have already been huge developments that point to what many of us already believe. That Win and Zaw had nothing to do with these horrific crimes and are being used as scapegoats to protect corrupt authorities and connected families in Koh Tao. The most troubling, and also probably most easily predicted, is that the Thai police claim that they have no more DNA for the defense team to test and authenticate. Since this is pretty much the ONLY evidence that they claim to have, and now admit they don’t even have, the case should be thrown out immediately and the hunt for the real killers should take place.
Also very interesting is the statement made by human rights defender Andy Hall that the defense team has received evidence from the UK investigators sent to Thailand and that this evidence contradicts what was brought forward by the prosecution. While after reading the MET report we were initially upset and believed that nothing had been done, it may seem now that there was actually some good that may have come from the investigators visit to Koh Tao. At this stage we are not sure what evidence was handed over to the defense team, but the announcement that some evidence was handed over at all leaves many of us optimistic.
With the original Thai translator quitting after being threatened by the island mafia, it has been reported that Jack Hansen-Bartel has bravely stepped up and is taking on the job of translator for the trial. He has firsthand experience of the corruption plaguing the Thai justice system and is himself a victim of it.
