    Visa Problem.

    Hi guys, me again....

    My best mate here in Thailand has a very odd problem. Apart from telling him to go to a lawyer, I don't know what else to tell him. I was hoping somebody here might have an idea.

    My friend has dual nationality, Swiss and English. He entered Thailand on his Swiss passport and is on a massive over-stay.

    His Swiss passport has expired and to be blunt, I think he owes a lot of money in Switzerland to to the government and all they will issue him with is a document to travel back to Geneva and the awaiting police.

    He has just received his new, British passport from the UK embassy. Is there any way at all to exit on this passport? He can pay the overstay, he just wants to get legal again with some kind of visa.

    I know he has only got himself to blame but going back to Switzerland is not an option at the moment. He has two children of 4 and 2. If they are separated from him they are literally fucked. Next stop for the mother would be Nana. They have nothing.

    I haven't told him this but I would be prepared to take the kids, If anything should happen.

    Really would appreciate some good advice or pointing in the right direction.

    Report his Swiss passport as lost so he gets the letter from tourist police, then go out on the English one showing the letter and his tm, gonna take a lot of explaining but should be acceptable.

    Actually he can just exit on his old swiss one I should think as he has a valid UK one.

    I think I agree with DD. In the case of an overstay, Immigration is interested in getting the money. They don't know or care about his legal problems outside of Thailand. Even with an expired Swiss passport, he shouldn't have a problem exiting the country as long as he does have a valid passport (the English one). Then, reenter later on the English one, and problem solved.

    Be interesting to hear how he gets on with this. Hope he gets sorted for his kids sake but sounds like another hapless fool on the run.

    Problem is, the guy is wanted in Switzerland, should Immigration check if there's a warrant against him he's fucked.

    I don't know how much jail-time he's looking at. If not too long I would take the kids in.

    I really do like my mate but it's hard not to be angry at him for putting himself and now his kids, in this position.

    He's in his early forties and scratching around teaching English for pennies. I can only see this ending one way if things don't change and it aint pretty...

    ^^Agree. The OP didn't clearly state that he was a wanted man. It just said that he owed the government a bunch of money. Obviously, we don't have all the facts.

    Having just spoken to him, he says he owes x amount for fines and hospital fees paid by the government. All jailable in Switzerland for non-payment.

    And a possession of narcotics charge.....It gets better.

    I think the word is fxcked.

    Overstay fine has a maximum ceiling, which I think is still 20k baht
    Just pay it, leave and get rid of the problem

    For all the shit we go through and all the hoops we have to jump through, that is one hell of an out clause that has not been closed for over 20 years. Never amended either. Hope it stays well under cover.

    What ever happens, paying the overstay at the airport would be the best plan..it's a lot easier to get in trouble at one of the walkover points..

    20k..end of problem..

    I've had a couple of big overstays..on both occasions I've walked out into the departure lounge with on the first time, the immi blokes number on my phone in order to meet up for a few beers on my return 3 weeks later (that was somet like 400 days) and the second being on the receiving end of some very flirtacious behaviour by the immi wench (another 200 days or so)..it's all about the dosh as per..

    Don't you get a black mark in your passport if you over stay?

    I seem to remember hearing/reading that said black mark could wipe out any chance of getting a new visa in certain consulates/embassies.

    ^ No..you get half a page of your passport covered in the relevant ink (the amount of days etc you overstay) and a pat on the back from the immi chap for financing his kids next term in school..

    Then you get a new passport to hide the discrepancy if you are worried about it..

    The overstay stamp should go into the Swiss passport because that is the one with the visa

    It used to be a max of 10k baht and 200baht perday, now 500 baht perday and 20k baht ceiling.

    Agree. They will stamp his Swiss passport with departure stamp. Questions though, will immigration let him leave on expired passport? Assuming he is entering the UK, will they let him enter with a UK passport issued in BKK with no departure stamp from Thailand?
