    The Trump case has been assigned to U.S. District Judge Tanya S. Chutkan, according to the court docket. Chutkan, an Obama appointee, is the only federal judge in Washington, D.C., who has sentenced Jan. 6 defendants to sentences longer than the government had requested.

    Here are the four Jan. 6 charges against Trump and what they mean

    What are the charges?


    • Conspiracy to defraud the U.S. government: Conspiracy is a catchall crime covering any scheme between two or more people to break federal law or defraud the U.S. government. Conspiracies don’t need to be successful to be criminal, and perpetrators can be held responsible if they join the conspiracy at any stage.


    In this case, prosecutors allege Trump conspired with six others to “overturn the legitimate results of the 2020 presidential election.” The co-conspirators are not named — nor are they charged — but five of the six descriptions match attorneys Rudolph Giuliani, John Eastman, Sidney Powell and Kenneth Cheseboro and Justice Department official Jeffrey Clark. The sixth is described as a political consultant.

    The indictment says Trump attempted to overturn the election results in myriad ways: by pushing state officials in certain swing states that broke for Biden to ignore the results and take steps to make Trump the winner; by organizing slates of “fake electors” who falsely certified that Trump had won seven states; by pushing the Justice Department to endorse the false claims of election fraud; by pressuring Vice President Mike Pence to change the election results; and by exploiting the violent riot on Jan. 6 to try to keep lawmakers from confirming of Biden’s victory.

    Prosecutors will have to prove deceit was used to undermine or interfere with the work of the federal government. The indictment repeatedly says that Trump knew his fraud claims were false, having been told by campaign staff, White House officials and state government representatives that there was no evidence for them. He is specifically accused of lying to the Georgia Secretary of State about supposed ballot tampering after being told by the Justice Department that it never happened. Giuliani is accused of lying to the crowd at Trump’s rally on Jan. 6, falsely claiming that five state legislatures had written “begging” for a review of their election results. Giuliani is also accused of telling the Arizona House Speaker there was enough evidence of fraud to justify switching the state’s votes from Biden to Trump; eight days later Giuliani allegedly admitted, “We don’t have the evidence, but we have lots of theories.”


    • Conspiracy to obstruct an official proceeding: For the same conduct used to charge him with conspiracy, Trump is charged specifically with conspiring to obstruct the congressional confirmation of Biden’s victory on Jan. 6.



    • Obstruction of an official proceeding: Trump is also charged with a substantive obstruction count for attempting to block Congress from confirming Biden’s victory on Jan. 6. The same charge is the most common felony charge used against rioters who stormed the U.S. Capitol. The U.S. Court of Appeals for the D.C. Circuit has split on how to define this crime, but a majority of judges who have weighed in agree that at least some conduct at the Capitol counts as illegal obstruction.


    The dissenting judge, Gregory Katsas, argued that the crime had to include tampering with documents. Prosecutors allege Trump committed the crime in part orchestrating the creation of fake election certificates and trying to get Congress to accept them, as well as by pressuring the Justice Department to send out a letter falsely claiming there were problems with the vote in Georgia or other states.


    • Conspiracy against rights: This charge criminalizes any joint effort to “injure, oppress, threaten, or intimidate” people to stop them from enjoying their constitutional or federal rights. It was passed after the Civil War, when White vigilante groups such as the Ku Klux Klan were terrorizing Black southerners who sought to vote or otherwise enjoy their rights under the Thirteenth, Fourteenth and Fifteenth amendments. Its use was limited for many decades by Supreme Court decisions, but prosecutors brought the charge in the 20th century in cases involving racist attacks on civil rights activists and ballot-box stuffing. It was also used against a Nixon aide who authorized the burglary of a psychiatrist’s office after the Pentagon Papers leak. Here, prosecutors argue Trump conspired to stop people from exercising “the right to vote, and to have one’s vote counted.” They must prove that was Trump’s intent.

    His appearance is slated for 4 p.m. before U.S. Magistrate Judge Moxila Upadhyaya at the E. Barrett Prettyman Courthouse in Washington, D.C.

    And of course, trump’s lawyer will request the trial for the Jan. 6 charges to be held after trump loses the election.

    To make sure everything runs smoothly the Capitol Police will be ready, this time.

    In the end, if trump is convicted, he’s screwed.

    No mugshot will be taken.

    TRUMP PLEADS NOT GUILTY. TO ALL CHARGES IN FEDERAL JAN. 6 CASE

    Former President Trump pleaded not guilty Thursday to all federal charges alleging he plotted to overturn the 2020 election.

    Why it matters: The GOP presidential frontrunner has now been indicted three times since launching his 2024 campaign.


    • The former president was charged with conspiracy to defraud the U.S., conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding and conspiracy against rights.
    • The latest charges will force Republicans to reengage with the Jan. 6 Capitol riot and Trump will appear at the same courthouse where more than 1,000 Capitol rioters charged with crimes have had hearings.


    Driving the news: He arrived Thursday shortly before 4PM at the Elijah Barrett Prettyman Federal Courthouse before Magistrate Judge Moxila Upadhyaya.


    • The former president traveled from his golf club in Bedminster, New Jersey, to D.C.


    Catch up quick: Trump was indicted Tuesday by a grand jury convened by special counsel Jack Smith.


    • He has denied wrongdoing following every indictment against him.


    What's next: Trump's next hearing in the case will be Aug. 28. Chutkan intends to set Trump's trial date then.

    Trump accused President Joe Biden of orchestrating the “persecution of a political opponent” as he departed D.C. following his not guilty plea.

    “This was never supposed to happen in America,” Trump said on an airport tarmac before boarding his private jet. “We can’t let this happen in America.”

    Calling it a “sad day” for the country, Trump also claimed that there was more “filth and decay” in the nation’s capital than when he was president.

    “This is not the place that I left,” he said.

    Trump also touted his lead in the GOP primary and claimed he is “beating Biden by a lot” in polls of the prospective 2024 general election.

    “If you can’t beat him, you persecute or you prosecute,” he said.

    Trump took no questions.

    The magistrate judge handling former President Trump’s arraignment on charges related to trying to overturn the 2020 election warned him Thursday against bribing or influencing witnesses.

    U.S. Magistrate Judge Moxila Upadhyaya reminded Trump during the arraignment proceedings that bribing, influencing or retaliating against witnesses is a crime.

    While Upadhyaya will oversee Trump’s arraignment, she will not oversee the trial. The case has been assigned to U.S. District Judge Tanya Chutkan, an Obama appointee who has handed down strong sentences to Jan. 6 defendants.

    The warning to Trump is notable given the House committee that investigated the Jan. 6 attack on the Capitol alleged the former president and his allies tried to contact and influence a witness in that probe.

    Former Rep. Liz Cheney (R-Wyo.) said at a hearing last summer that Trump tried to call an unnamed witness. She separately described a case of a witness describing receiving phone calls reminding them that Trump was paying attention to who said what.

    Transcripts released last December detailed how Cassidy Hutchinson, a former White House aide, dealt with efforts by what she referred to as “Trump World” to diminish the impact of her testimony and withhold information from investigators.

    • 'We're ready' | Fulton County District Attorney speaks ahead of possible Trump indictment


    Hours before former President Donald Trump appeared before a federal judge in Washington, D.C. for his arraignment on charges relating to his alleged efforts to hang on to power after the 2020 election, 11Alive spoke with the district attorney currently investigating his conduct here in Georgia.

    Fulton County District Attorney Fani Willis is expected to announce the results of her ongoing 2020 election probe in the coming days. The investigation has focused on efforts to overturn the 2020 presidential election results.

    The 45th president currently faces charges in three separate criminal cases around the country. He has pleaded not guilty in all of them.

    Thursday afternoon, Willis said those other cases will not impact her plans for any potential Fulton County case.

    "I took a oath and the oath requires that I follow the law and if someone broke the law in Fulton County, Georgia, I have a duty to prosecute," Willis said. "That’s exactly what I plan to do."

    The exact timing of any announcement in the case is still unknown. Willis has previously said she will announce a charging decision no later than Sept. 1.

    In a May 18 letter, she asked Fulton County judges to not schedule in-person trials or hearings between between Aug. 7 and Aug. 14 and said that much of her staff will be working remotely on July 31 and Aug. 1, 7, 8, 10, 11, 14, 15, 17, and 18.

    Thursday afternoon, she declined to provide more specifics about her timeline.

    Willis did shed new light on the offensive messages she says she has received since her investigation began.

    "All the typical racial slurs that you can imagine," she said. "They’re very grotesque."

    When asked if these messages had impacted her personal security detail, Willis responded: "My personal security's been good for a long time now."

    Willis declined to say how many messages like that she’s received, but added she’s gotten notes of support too.

    She also addressed concerns, voiced by some, that any potential criminal case against the former president would tie up courthouse resources that are already being stretched by the ongoing YSL trial.

    "I don't believe the YSL prosecution has stopped or slowed down anything," Willis said. "We are accustomed to handling big cases."

    "I think the Fulton County court system is more than able to handle multiple high-profile cases at the same time," she added.

    When asked about whether her office is ready for the history-making nature of potential indictments, Willis said "we're ready."

    A group of 38 House Democrats penned a letter Thursday to the body overseeing federal courts requesting that former President Trump’s election fraud trial be publicly televised live.

    “It is imperative the [court] ensures timely access to accurate and reliable information surrounding these cases and all of their proceedings, given the extraordinary national importance to our democratic institutions and need for transparency,” the group wrote.

    Trump was arraigned Thursday on four federal charges alleging that he attempted to overturn the results of the 2020 election. A trial date is expected to be decided at an Aug. 28 court appearance.

    Cameras are generally not allowed in federal courtrooms.

    “Given the historic nature of the charges brought forth in these cases, it is hard to imagine a more powerful circumstance for televised proceedings,” the group continued.

    “If the public is to fully accept the outcome, it will be vitally important for it to witness, as directly as possible, how the trials are conducted, the strength of the evidence adduced and the credibility of the witnesses.”

    Among the signing members are House Jan. 6 committee chair Bennie Thompson (D-Miss.) and members Jamie Raskin (D-Md.), Adam Schiff (D-Calif.), Pete Aguilar (D-Calif.) and Zoe Lofgren (D-Calif.).

    The bipartisan Jan. 6 special committee concluded last year with a recommendation that the Justice Department pursue a criminal investigation of Trump over his involvement in the insurrection.

    Other notable signees include Rep. Barbara Lee (D-Calif), who is running against Schiff in 2024’s California Senate primary, and Progressive Caucus Chair Pramila Jayapal (D-Wash.).

    Trump’s charges include conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction, and conspiracy against the right to vote and to have one’s vote counted.

    A second federal criminal trial, over allegations he mishandled classified documents, is scheduled for May.

    Trump is also being investigated by Georgia prosecutors over his attempts to overturn the 2020 election in that state. A Georgia grand jury is expected to decide whether to indict Trump by the end of the month.

    In another possible sign that an indictment announcement could be coming – and with it a large crowd and media presence in downtown Atlanta – Fulton County announced a road closure outside the courthouse Thursday.

    Beginning Monday, August 7 at 5 a.m. and spanning through Friday, August 18, Pryor Street SW between Martin Luther King Jr. Drive SW and Mitchell Street SW will be closed to general traffic. A press release bearing the name of Fulton County Sheriff Pat Labat also gave instructions for media staging but made no mention of potential indictments or an announcement thereof.

    “Sheriff Labat and the Sheriff’s Office, it is the priority to keep the courthouse safe, and also the citizens,” said Natalie Ammons, a spokesperson with the Fulton County Sheriff’s Office. “There are thousands of people that come through this area and this footprint and that is the main goal, to keep everyone safe.”

    Indications of a forthcoming announcement have been trickling down for days. This week, orange barriers appeared outside the Fulton County courthouse and some courthouse staff began working from home. District Attorney Fani Willis indicated that if a charging decision comes, it would happen sometime in August.

    During the period of the road closures, the Fulton County Courthouse and the Fulton County Government Center will still be open to the public.

    “People still have a business to conduct with Fulton County, so we want to make it as safe as possible but still accessible to the public,” said Ammons.

    She added “we are ready” when asked how prepared officers were for any large crowds or unrest that may come with them.

    Former President Trump will have his mugshot taken if he's indicted over Fulton County's investigation into alleged criminal efforts to overturn the 2020 election results in Georgia, county Sheriff Pat Labat said to local media.

    Why it matters: Though Trump has been indicted three times and arraigned twice, he has not yet had a booking photo taken.


    • Trump is set to have his third arraignment in federal court on Thursday afternoon after a D.C. grand jury charged him with conspiracy to defraud the U.S. and other counts over alleged efforts to overturn the 2020 election.
    • He's not expected to have his mugshot taken but will likely be fingerprinted again.


    What they're saying: Labat told ABC-affiliate WSB-TV on Tuesday that Trump will be treated as anyone else accused of a crime in the county, which would include a booking photo.


    • "Unless somebody tells me differently, we are following our normal practices, and so it doesn't matter your status, we'll have a mugshot ready for you," Labat said.
    • He added that the Fulton County Courthouse is preparing for the possibility of Trump's indictment.


    Worth noting: Even though Trump has not been asked to take a mugshot in his earlier legal proceedings, his campaign has been using fake mugshots in its fundraising campaigns and merchandise.

    The big picture: Fulton County District Attorney Fani Willis said earlier this year that charging decisions over the county's 2020 election probe will be announced between July and early September.
