    Home Invasions

In the UK, citizens are not allowed to defend themselves with a proper weapon in the event of a home invasion. In fact, they are likely as not to be charged with a crime if they do so.

“It is reported that 50% of people in London are worried about security and sleep with some form of self-defence to hand, for use against intruders.

The ‘Safe Bedside Table’ has a removable leg that acts as a club and a top that doubles as a shield for self-defence. This is for people who are willing to take on an intruder, providing an extra sense of security whilst in bed”

Burglar dies after falling from top-floor window following confrontation with homeowner

by JAYA NARAIN - More by this author » Last updated at 17:49pm on 9th August 2007

A homeowner was arrested after a burglar plunged from the balcony of his top-floor flat and later died in hospital.

The intruder suffered head injuries and died in hospital after falling around 30ft on to a concrete path.
Patrick Walsh, 56, awoke to find an intruder in his flat on Corkland Road in Chorlton-cum-Hardy, south Manchester. Scroll down for more...
The burglar fell from this third floor window

Police say "following an exchange of words" the 43-year-old suspect fell from the fourth floor window on to the pavement below.
He suffered massive injuries from the fall, at around 6.10am on Monday.
The man was taken to Manchester Royal Infirmary with serious head injuries before being transferred to Hope Hospital, where he was pronounced dead at about 11am today.
Police conducted a detailed forensic examination of the flat after the incident.
Walsh was arrested on suspicion of causing serious bodily harm and bailed until November pending further police inquirers.
His solicitor, Victor Wozny, said today: "My client is not at liberty to say anything because he is under police bail.
"However we appreciate that the public view might be that this is a man arrested in his own home defending his own property."
A spokeswoman for Greater Manchester Police said, "Inquiries are ongoing to establish the circumstances surrounding this incident.
"A 56-year-old man from Chorlton has been arrested on suspicion of section 18 assault and bailed, pending further inquiries."

The pair argued and the confrontation moved towards the rear window of the flat.

It is believed the intruder then smashed the window and clambered out on to a narrow ledge and fell to the ground.

Mr Walsh phoned police and at around 6.30am officers found the man on the ground outside the smart Victorian apartment block in Chorlton-cum-Hardy,

He was taken to hospital with serious head injuries.

Officers arrested Mr Walsh on suspicion of causing grievous bodily harm with intent and are trying to establish whether the intruder was forced out of the window.

The arrest is expected to fuel arguments about the rights of householders to defend themselves against burglars.
    Under suspicion: Patrick Walsh yesterday

The issue has been high on the law and order agenda since farmer Tony Martin was jailed for shooting dead a burglar in 1999.

Following the Martin affair the Crown Prosecution Service and the Association of Chief Police Officers said any householder can use reasonable force to protect themselves or others, or to carry out an arrest or to prevent crime.

A neighbour said: "Police arrived in what seemed to be minutes and were there for the whole day.

"It's shocking to find out what has happened but people shouldn't break into other people's houses."

Another resident said: "I presume we will have to respect the burglar's rights while his victim has the nightmare of court hanging over his head. It all seems so unfair."

A spokesman for Greater Manchester Police said they had been called following reports that an intruder had fallen from a top-floor flat.

"Following an exchange of words, the alleged burglar was found unconscious on the pavement outside the flat.

"It is believed that he had fallen from the fourth-floor window."
Mr Walsh has been released on bail until November. If charged and convicted he could face a life sentence

Accused Burglar Sues Homeowner Who Shot Him

    The Milwaukee Journal ^ | 10/01/06

Posted on 10/01/2006 904 PM PDT by baldeagle390

MILWAUKEE -- A Janesville man who admitted breaking into a home is suing the homeowner who shot him.

Kurt Prochaska, 39, was on probation last fall when he admitted he broke in to a home and was shot by the homeowner, but that's not stopping him from going after cash through the courts.

Late last year, the Rainiero family awoke to find Prochaska in their home. Michael Rainiero, a doctor, ordered Prochaska to leave. He didn't and was shot in the back.

Nearly a year later, Rainiero's attorney said it's far from over because Prochaska is suing him from beind bars, saying the doctor didn't need to shoot him.

"What the doctor wants is this whole ordeal to be ended and done with," Rainiero's attorney said.

The Milwaukee County suit claims Rainiero used excessive force to deal with the intruding plaintiff and alleges severe and permanent injuries, relentless pain, and loss of earning capacity. The suit doesn't specify a damage amount.

Rainiero claims he shot Prochaska in self-defense.

"The doctor was asleep in his bed when an intruder came into his home and put his life, his wife's life, and his two kids' lives in jeopardy," Rainiero's lawyer said.

The lawyer added that Rainiero showed restraint, not excessive force, in dealing with Prochaska. Although, he had an entire magazine of bullets, Rainiero fired only once.

The Rock County district attorney agreed, long ago ruling the shooting was justified. Still, Prochaska is able to move ahead with the suit.

"Judges like to give everyone their day in court. No matter how absurd it might seem, this gentleman has a right to have a day in court. And so, my job is to make sure that that day in court is a very short day in court," Rainiero's attorney told 12 News reporter Nick Bohr.

A hearing on the suit is set for next month. Prochaska's attorney did not wish to comment on the case.
If the case is thrown out, Prochaska can be forced to pay up to $500 of the legal expenses.

In Australia, there have been several cases like this. The homeowner, (or in one case, the business owner), have been charged but not convicted or convicted and put on a bond.

I like that bit about the loss of earning capacity. "That bastard shot me, so I couldn't go out and rob other people to make a living. It's so unfair!!"

    Some people have no shame.

Tony Martin's case recieved massive publicty here. The basics of it are three pikeys burgled his house & he shot one dead & another one in the leg.

The problem (not widely reported) he had is that he shot them as they were running away from his house & would not admit to it in police interview. He insisted he remained at the top of the stairs & fired a warning shot or two. Ballistics & forensics demonstated this to be a lie, unless bullets could travel round corners & his whole testimony was deemed bullshit - which it was.

He went a little bit too far. Though he must have been at some sort of psychological breaking point after being robbed so many times, considering he lived in a remote farmhouse, alone.

Each to their own i'm not trying to tell anyone what to do!
If i had a gun and someone broke into my home i'd shoot him.
If i had a knife i'd stab him.
If i had a bat i'd batter him.

So much depends on circumstance. Someone mentioned Tony Martin he was a reclusive farmer who shot a 16 year old boy who was 50 meters away and running in the opposite direction. I'm not sure that is justifiable self defence.

British gun controls earn criticism from the London times:

"Despite the recent spate of shootings on our streets, we pride ourselves on our strict gun laws. Every time an American gunman goes on a killing spree, we shake our heads in righteous disbelief at our poor benighted colonial cousins. Why is it, even after the Virginia Tech massacre, that Americans still resist calls for more gun controls?

The short answer is that “gun controls” do not work: they are indeed generally perverse in their effects."

British attitudes are supercilious and misguided

things to do if you catch an intruder in your house,

    1. disable said intruder,
    2. kill intruder
    3. bury intruder
    4. tell no one

    no repercussions

When guns are outlawed only outlaws will have guns.

The bumper sticker phrase sums it up. Without the equalizer or the uncertainty that a citizen may have an equalizer the bullies will rule whether they be street bullies or political bullies.

When a government outlaws guns they can use the criminals to intimidate and control the public. Without citizen self-reliance the criminals become a intimidating element on the citizenry. They can be used by the government to cower a society into compliance and generate more dependence on the government. The public feels less safe so it then asks the government to provide more security and in exchange the public gives up more of their precious freedoms. So in a sense criminals become a tool of the government to manipulate and control its citizens when the citizens do not have the means or confidence that they have the means to protect themselves.

Sorry if I repeated myself but one never gets tired of hearing the truth do they? Anyone want to go out for karaoke?

A relation of mine lives in Belgium. He relates how in a certain affluent part of his city, intruders will break into homes going house to house robbing people, a la Clockwork Orange. They know the occupants won't be armed. The police won't even show up because they are afraid of the intruders.

All those who advocate gun control should be required to put a sign out front of their house:

    We believe in gun control.
There are no guns in this house.

PS. We're stupid - come rob us.
And rape my wife and daughter while you're at it.
