    Judge Strikes Down Arkansas' Same-Sex Marriage Ban

    An Arkansas judge struck down the state’s 2004 amendment prohibiting same sex marriage on Friday, ruling that the ban violates the state constitution and the Fourteenth Amendment of the U.S. Constitution.

    “Arkansas’ s marriage laws discriminate against same-sex couples in violation of the Equal Protection Clause because they do not advance any conceivable legitimate state interest necessary to support even a rational basis review,” circuit Judge Chris Piazza wrote. The case, Wright v. Arkansas, involved more than 40 plaintiffs, including a “mix of unmarried same-sex couples, families seeking respect for their out-of-state marriages, and children of gay and lesbian Arkansans.”

    Citing Loving v. Virginia, the Supreme Court case eliminating the ban on interracial marriage, Piazza argued that “It has been over forty years since Mildred Loving was given the right to marry the person of her choice. The hatred and fears have long since vanished and she and her husband lived full lives together; so it will be for the same-sex couples.”

    Last week, state Attorney General Dustin McDaniel announced that while he supports marriage equality, he will continue to defend the state’s constitutional ban. Piazza did not stay his ruling, allowing same-sex couples to marry as early as Monday, though McDaniel’s office is expected to quickly appeal the decision.

    Since the Supreme Court struck down a section of the Defense of Marriage Act in June of 2012, at least eight other judges have invalidated laws prohibiting same-sex marriage. This includes judges in Illinois, Virginia, Kentucky, Ohio, Oklahoma, Utah, Texas, and Michigan.

    In 2004, 75 percent of voters approved the state’s ban against same-sex marriage.

    Four Idaho couples filed the lawsuit challenging the marriage ban in November, against the governor and Ada County Clerk Chris Rich. The couples are Sue Latta and Traci Ehlers; Lori and Sharene Watsen; Shelia Robertson and Andrea Altmayer; and Amber Beierle and Rachael Robertson.

    Latta and Ehlers married in 2008 in California, and the Watsens married in 2011 in New York. Both couples have children and say Idaho wrongly treats Ehlers as a legal stranger to her grandchildren and requires Lori Watsen to obtain a new power of attorney every six months so she can have legal authority to consent to medical treatment for her son.

    Their attorney, Deborah Ferguson, said the ruling recognized that the families are part of Idaho's community and that they deserved the same protections and respect as other Idaho families.

    "The court's ruling is a victory not only for the courageous couples who brought this case, but for everyone who cares about freedom and fairness," Ferguson said in a statement.

    A federal judge declared Pennsylvania's ban on gay marriage unconstitutional Tuesday, saying it's time to toss such laws "into the ash heap of history."

    The ruling by Judge John E. Jones III makes Pennsylvania the last Northeast state to allow same-sex marriages, although the state could challenge the decision before the 3rd U.S. Circuit Court of Appeals.

    Several couples sued the state last July for the right to marry in Pennsylvania or to have their out-of-state same-sex marriages recognized. A 1996 state law defines marriage as a union between a man and a woman.

    "Plaintiffs suffer a multitude of daily harms, for instance in the area of child-rearing, healthcare, taxation and end-of--life planning," Jones said in his 39-page written opinion.

    He called the couples who brought the case "courageous" and said his ruling brings the court in line with "12 federal district courts across the country which, when confronted with these inequities in their own states, have concluded that all couples deserve equal dignity in the realm of civil marriage."

    Judge overturns Wisconsin's same-sex marriage ban

    MADISON - A federal judge has ruled that Wisconsin's ban on same-sex marriage is unconstitutional.

    Wisconsin's voters passed a constitutional ban against same-sex marriages in 2006, but the American Civil Liberties Union, the ACLU of Wisconsin, and the law firm of Mayer Brown filed a lawsuit on behalf of eight Wisconsin couples challenging the ban.

    Part of Friday's ruling reads:

    "It is DECLARED that art. XIII, § 13 of the Wisconsin Constitution violates plaintiffs' fundamental right to marry and their right to equal protection of laws under the Fourteenth Amendment to the United States Constiution."

    Nation’s last unchallenged gay marriage ban brought to court


    The last state with an unchallenged gay marriage ban lost that status on Friday afternoon.

    As had been expected, seven couples sued North Dakota on Friday afternoon, making it the last such state to have its ban brought to court, according to Joshua Newville, a Minneapolis-based civil rights attorney who helped file on their behalf.

    “Without any legitimate governmental interest, North Dakota has targeted a minority of individuals for discrimination on the basis of sexual orientation,” the suit reads.

    The couples in the case represent a range of relationships: old, young, adoptive parents, those asking the state to grant them marriage licenses and those seeking state recognition of out-of-state marriages. The couples hope to have the state ban overturned as unconstitutional.

    Obama Expands Government Benefits For Gay Couples

    A year after the Supreme Court struck down a law barring federal recognition of gay marriages, the Obama administration granted an array of new benefits Friday to same-sex couples, including those who live in states where gay marriage is against the law.

    The new measures range from Social Security and veterans benefits to work leave for caring for sick spouses. They are part of President Barack Obama's efforts to expand whatever protections he can offer to gays and lesbians even though more than half of the states don't recognize gay marriage. That effort has been confounded by laws that say some benefits should be conferred only to couples whose marriages are recognized by the states where they live, rather than the states where they were married.

    Aiming to circumvent that issue, the Veterans Affairs Department will start letting gay people who tell the government they are married to a veteran to be buried alongside them in a national cemetery, drawing on the VA's authority to waive the usual marriage requirement.

    In a similar move, the Social Security Administration will start processing some survivor and death benefits for those in same-sex relationships who live in states that don't recognize gay marriage. Nineteen states plus the District of Columbia currently recognize gay marriage, although court challenges to gay marriage bans are pending in many states.

    Presbyterian church recognizes gay marriages

    In what is being called a huge development, the Presbyterian church has voted overwhelmingly to permit local pastors to conduct gay weddings where they are legal.

    Religion News Service reports that the General Assembly of the church, which totals 1.8 million members, voted 76% to 24% for the change.

    RNS adds that the decision won’t go into effect until a second vote, but that with the lopsided result of the first, victory is all but expected.

    Of course, the haters had to have their say, now threatening to financially ruin the church if they don’t embrace bigotry.

    Federal Judge Strikes Down Indiana's Ban On Same-Sex Marriage

    U.S. District Court Judge Richard L. Young, a Clinton appointee, ruled Wednesday that Indiana’s state law banning same-sex couples from marrying or having their marriages from other states recognized is unconstitutional. The ruling takes effect today, though will likely be stayed as rulings in other states have been.

    According to Young, “It is clear that the fundamental right to marry shall not be deprived to some individuals based solely on the person they choose to love.” He expects that, “in time, Americans will look at the marriage of couples such as Plaintiffs, and refer to it simply as a marriage — not a same-sex marriage.”

    “These couples, when gender and sexual orientation are taken away,” he concluded,” are in all respects like the family down the street. The Constitution demands that we treat them as such.”

    Indiana is one of the few states that bans same-sex marriage in state law only, and not in a constitutional amendment. The legislature stalled efforts to pass such an amendment in 2014, delaying its consideration until 2016 at the earliest.

    Young’s decision follows an earlier ruling in the case guaranteeing recognition of the marriage of Amy Sandler and Niki Quasney due to Quasney’s fight with ovarian cancer.

    Indiana is the fourteenth state to have its ban on same-sex marriage overturned by a federal judge in the year since the Supreme Court overturned the federal Defense of Marriage Act almost exactly one year ago.

    Federal appeals court overturns Utah's ban on gay marriage

    In a decision coming from Utah, a federal appeals court on Wednesday for the first time backed gay marriage.

    The Denver-based U.S. 10th Circuit Court of Appeals upheld a lower-court decision that struck down the state's bans on same-sex marriage.

    The ruling, which was stayed, sets the stage for an appeal to the U.S. Supreme Court, which touched off the current round of legal fighting on the issue when it struck down parts of the federal Defense of Marriage Act last year.

    "We hold that the Fourteenth Amendment protects the fundamental right to marry, establish a family, raise children, and enjoy the full protection of a state’s marital laws," according to the decision posted on the court's website. "A state may not deny the issuance of a marriage license to two persons, or refuse to recognize their marriage, based solely upon the sex of the persons in the marriage union.

    "For the reasons stated in this opinion, we affirm."

    The Utah case was the first in the nation in which a federal judge struck down a state ban on same-sex marriage. Still pending on appeal is a Virginia case that also struck down a state ban.

    My brother and his partner of 35 years went to California and married a couple of months ago. The reason was if one of them had died without the marriage the other would have had to pay an estate tax of 40%. Being married, the surviving spouse would not have to give up their house or other property to pay the tax.


    Can't imagine why anyone would comment on this thread if they didn't give a fuck about gays. Some of us actually do care about gays. Very much, may I add.

    No, they are not. The rights to the deceased estate is not guaranteed unless couples are legally married. There are too many jurisdictions in the US with differing laws. Even common law marriage between a man and woman is not recognized in some places.

    You should see what kind of horrible life my brother and my brother in law have. Oh, what self loathing they are wallowing in now on that cruise ship in Alaska. It's awful what they go through. Crawling back to their multimillion dollar house to hide their shame. Oh, my! They even have curtains in their Maybach to hide from people when they ride around town. Everyone feels so sorry for them.

    It could be so much better. They could be living a lonely, poor, and miserable existence in England instead!

    You know that one one the founders of NARTH was caught vacationing in Europe with a male prostitute a couple of years ago. They met on rentboy.com, but the NARTH guy claims he just hired the man to carry luggage, didn't know he was gay. BAWHAHAHA

    And one of the methods they use to cure gayness is to hold the gay man and cuddle them in their laps for hours.

    And if you have homosexual thoughts, all you have to do is snap a rubber band on your wrist to snap yourself out of it.

    Remember the research paper I posted a while back? That people who had strong anti-homosexual feelings were just repressed?

    You and Blue can try the rubber band thing and see if it helps.

    why do homos like cruise ships so much ?

    Imagine a normal couple with young boys on those ships.
    Must be a nightmare having to watch them 24/7 , especially if the gays are doing what they normally do - ie hang around in the mens toilets, watching normal males...

    Go on then, ask any gays you know if they have ever spent more time than needed in a mens public lavatory or gym / swimming pool changing room ....
