    wife forged company papers

    I Had A House Down In Pattaya That I Had Not Lived For 2 Year And The Wife Forged The Company Papers To Take Me Off And Made Herself The Owner , I Have The Paper From The Land Office And Can Prove That I Was Out Of The Country , We Are Married But This Is Not A Man Wife Deal This Is A Company ,can I Have Her Charged With Fraud , Or Would It Be A Waste Of Time .
    jUST TO AD TO THE INSULT SHE BORROWED HALF THE VALUE ,NEVER PAYED IT BACK AND I HAVE LOST THE HOUSE .
    iF I COULD GET ACONVICTION IT MUST GO BACK TO THE OLD COMPANY AND WHO EVER GAVE HER THE MONEY WOULD HAVE TO CHASE HER RIGHT OR WRONG NOT MUCH HOPE HERE I WOULD THINK WHAT YOUR THROUGHTS

    Contact the police and get an arrest warrant, not likely you will get anything back but the boys in brown will shake her down for cash to look the other way.

    Ok, the land was in company name. Who owed the house? More detail, this ein't dead yet not by a long way. These puftas that lay down and let the Thais embugger them are twats.

    I would look into a forgery charge first. Thais like their paperwork.

    There are ways and means about dilluting one's shares in a company and I expect she may have had some expert advice.

    Stealth mate........stealth.

    Request a copy of the company registration and shareholders documents from the relevent government department and start to piece together a chain of events ie extraordinary share holders meeting, capital increase etc etc before you move too far.

    What she has done could be 100% legal and if done by a smart solicitor and as she was the clear majority shareholder of the company.

    Good luck mate and I hope it works out for you and make sure you pull out all your money transfer documents, receipts and whatever else you could use that prooves your money purchased the property.

    Also do not forget that what you and your wife done could be considered illegal and by purchasing a property using what I fear may be a non-trading shelf company.

    Anyone can be defrauded even the smartest! especially if authorities turn a blind eye or are in on it, then there is only to put your trust in the legal system, but even that can unfortunately be a dodgy affair here in Thailand, and with no assured guarantee of success unless you know somebody with influence higher up than your opponent.

    We had a similar case on our estate, a poor guy found out that his wife had taken loans out on his property's with some money lending Mafia types and then fucked off to England (the value of the property's where well over 10 million Baht), when he then came here the Mafia guys showed up and wanted the money or the houses, and not long after the man left for an undisclosed location, he told the closest neighbour that he had lost all his life savings and if he could not find a way to get the Thai wife to travel to Thailand to face the music he would take his own life, whatever happened to the guy I don't know but I really felt sorry for him and I hope he made it some how.

    i doubt that a bar-girl could be smart enough to do this.
    i think she has probably bribed or bullshitted her way through and could be nailed for it if it is challenged in court.

    I do have all the paper from the land office , company office and the one thing going is a high up lawyer has had his signaure forged as well and he is piss off with the lawyer that wrote the papers up ,I have all the paper and moneys not the object just want to get her known ,

    Might be a good idea to divorce her. Was it an official wedding (amphur office) or just a village do? Currently you are probably libel for 50% of her current and future debts. You aren't the first and you won't be the last but you were an important part of her business for a time.

    She'll be shagging or paying a low ranking local policeman though as insurance just in case her customers (you) become upset with losing their life savings.

    the problem with the land office and the land laws here is that there are so many security holes than it is very easy to commit identify theft and fraud and do all kind of stupid things,

    banks are also guilty in that regard, don't really check who is in taking the loan, little compliance

    You could empty anyone bank account with the right paper, that's how stupid the Thai system is

    Lawyers look at these things analytically and without the emotion. Sadly, you say she borrowed money against the house and that it is "lost." I assume that means foreclosure. Does your wife have any assets you can recover? Probably not or she would not have done such a crime in the first place. Forget some of the bad advice above, and don't do anything that could put you in a Thai prison. Don't make a bad situation worse. I am sorry about what has happened to you, you were not the first and will not be the last. Remember, when you talk to the police here it is important not to show anger, that goes against their culture. Be calm, polite and courteous. Act like a "nice man" they would want to help, not a vengeful angry person, and you will likely get much better results. Good luck to you. BOb

    Well the only other way is if the OP signed a company share transfer document and without his knowledge about what he was actually signing.

    She could of slipped this document into the company 6 monthly audit papers.

    The information you give is extemely basic. I have assumed that the house was owned by a company (and land associated with it), but no mention is made as to the shareholding. I have to assume you had less than 50% of that. I assume your wife has some of the other part. Also, no mention of who the directors were and their powers.

    On the information provided - this looks like a legit deal and done while you were not paying attention to what was going on.

    Sorry, but I doubt a fraud charge would hold up - based on a lot of assumptions, due to lack of real info.

    The land was in the company name? was the house in your name? if not why not, you could have signed some documents that you dont know what they where one thing I have seen before is the Farang has signed a Power of Attorney to someone not being able to read Thai and in the case I know about the Lawyer was in on the deal to cut a long story the Farang had parted with 7 million baht thinking they had bought a house when my wife read the documents they where only renting the house.
    Anyway all was well in the end they now are the proud owners of that house if you need my wifes help send me message she specilizes house and land transactions.
