    30 Year Lease

    Where in Pattaya can I obtain 1 and what should I expect to pay. Have been quoted 8k for Land registration and 5k for lady at Land office to do. Does it need to be registered at the time of the land transfer? as it is a new house. Is the lease prepared at the land registry legal. should I obtain a copy first and have it perused by a Thai .

    There is a standard booklet made up with 50 empty lease forms you can buy in most book shops, you then just fill out the details, costs between 50 and 100baht, or you could just go to a lawyers office and get them to draw you one up.

    ^he may have to pay stamp-duty on the amount of the rental (over the 30 year period). Otherwise those numbers look on the high side to me.

    The lease should be drawn up by a lawyer in both Thai and a legal verified copy in English and then the terms are worded onto the Chanoot (deed) at the land office and you will pay the taxable amount at that time for the rent for the 30 year period.

    ^ if the governing language of the document is English and you have two - one in Thai and the other in English - then, in theory, the legally enforceable one would be the English agreement.

    The Thai copy with the legal English translation i.e. endorsed with a garuda seal become the actual terms.

    Sorry to break this to you, but the courts will only accept one copy, they do not accept the best bits out of 2 copies, you got a Thai one they will love that, you got an English one that states it is the one and only they can work with that, the courts will only work with one, one is a legal document, the other is purely a translation of that document and is not presentable in any Thai court of law.

    Agreed. The one that will hold water in a Thai court will of course be the Thai contract.

    The translation is for the "sucker" errr I mean Westerner.

    Unless the Thai document specifies that the English one is the pukka contract.
