so whatever, as has been said, first wait for the village head to rule
maybe the neighbour built the wall there by mistake, maybe not
but the boundaries should be clear, after all, you seem to know them!
Fluke!
How big is the plot mate
Keep things simple and understand that Thais will take liberties if you let things slip.
If the hag has nicked a size of ground you are not happy with, make a song and dance or leave it alone.
By not bordering your land in the first place your kind of shutting the stable door after the horse has bolted!
I would not worry to much about the bullet threats others suggest if you plan to fight this.
If it can be proved your in the right the neighbour will more than likely leave it at that.
Of course you will be expected to remove the offending wall.
One side of the plot we bought was bordered by the road where our land sloped down to it.For the remainder I made a earth boundary all the way round about three foot high on our land.
The Chanote markers sit on the other side of this where I did plan to erect some fencing( hate the barbed wire )and plant some hedging.
So you or the girlfriend don,t live on this land, basically you have shelled out to house the family. Nice one, your a kind one fluke![]()
Most land plots have pegs clearly marking the boundaries but these are often shifted to gain an extra metre or so.
Most councils require that a house wall is built at least 1.2 metres inside the boundary wall.Originally Posted by Fluke
I would do as Dr Andy suggested and ask a council surveyor to measure the plots. It may also prove that your neighbour has built to close to the boundary and he may have to demolish part of his house.
Also do not forget if you are wrong and your neighbour has built the wall correctly he/she may ask you for half the cost to build the wall.
My wife's Mother gave us some land and we built a house with a wall on 4 sides. We then had the land paper changed so that the land was split up between my wife and her mother so they could have a land paper each. When the Land Office came round ,it topped up the Builders had put the wall 50cm from the road instead of 1 meter so we had pinched 1/2 a meter from the Government. My wife went to see the Head-Man , told him the score and slipped him a 1000 baht. The Head-Man then told the Land Office guys he was Happy where the wall was and they said 'OK'......Seems like the Head-Man has the final say in these matters, even when your pinching Government land !!!
Big Ol' Lucky Ol' Al.
If the wall isn't much over can you negotiate an annual rate for him to lease the bit of land from you rather than knock the wall down?
