Neighbour builds a boundary wall on my land

A neighbour build a boundary wall and the boundary wall is on my land .
It wasnt an accident , it is a hostile act .
Its in a small village in the Northern Mountains where disputes are usually settled by the village head . A family member has been to see the Village head and we are waiting for the outcome .
The wall was built on my land without permission , if there is no satisfactory outcome from the authorities, am I within my rights to take the wall down myself?

Not very much, Il have get the drawings out and a tape measure . But would nt distance be irrelevant ?
The wall was built a few feet away from the house . Also, it was built on a rainwater escape gulley . When it rains , a large amount of water runs off open land and escapes where the wall has been built . I predict that rain water will wash the wall away .
Im concerned that the wall may fall on to my house, and people use that walkway as well .

Think you are stuck with the village headman's verdict, I live in a very remote area and it's village law. You don't want to rock the boat, or things can get nasty as a friend of mine learned. He a build some sheds without the appropriate planning permission, as all the local do. He gets into a dispute with one of the locals, a month later he gets a demolition order. Nothing he could do, planning permission an not be back dated unless you have friends ] village life. Jim

in a civilised and developed country this would not be a problem at all, either the wall is on your land, in which case it can be removed; or it isnt on your land, in which case it cant be removed.

sadly, in bananaland, things are not so clearcut and one must rely on the whim of the village headman, a man who obtained that title not for his sense of justice and fairplay, but probably because his father had the title or because he is connected to someone further up the rural foodchain.

hopefully this dispute will not escalate and can be resolved amicably, either by him backing down and removing the wall, or by you backing down and accepting the wall, before his brothers, his guns or the rest of the village make an appearance.

you can pay a land office surveyor to come out and mark them for you and your neighbour

my neighbours did that in CM and it was found they had built their wall 30cm onto our land

Basically as Andy says. If you have chanote then it's fcuk all to do with the village headman. It's the land office problem to sort out. And Fluke's fault for not buying chanote land in the first place. Rule one for farang when buying land to build on. Do not build on Sor Por Kor land. Google is your friend.

There's nothing worse IMO than having beef with the people you live around. Being at home is the one place in the world you should feel stress and agro free.

Try to solve it as amicably as possible would be my answer, without having the piss completely ripped out of you if possible.

Me and the Mrs dont live there, but her Family does .
The neighbour has been extremely hostile in the past .
I dont know where the hostility stems from and I dont get involved .
My gfs Mum lives the house and its another Woman living in the other house .
The neighbour is always looking for a confrontation , Shes seems to be a very unhappy person and her only enjoyment seems to be trying to make other people as unhappy as She is .

It is not nice at all when some aggressive neighbour builds walls on your land and really there is nothing you can do about it except go through the correct channels. Especially is the village head in principal agrees that she is in the wrong and has built on your land but then does nothing about it because she has more power in the region and people are scared of her.

A few meetings with the village head over a bottle of JW or two, always leaving him with a few will help, especially if the neighbour is a nasty cow.

Trouble with going outside of the traditional ways, is you upset the local hierarchy and can make enemies. Little things like poisoning your dogs, not acknowledging your presents in a local shop.
Had a woman here who built a small house, she was a local, but had spend most of here adult life near BKK working. She didn't pay the local builders what they were due. One day as she walked to the local shop, about 300 meters, all the women on the Soi turned their back as she walked by. As they used to say in the UK, sent to Coventry.
I let the family sort out any problems and try not to get my western logic or thoughts of right and wrong, fair play or the law get involved. It's their country and their ways and it's been that way for 100s of years, you except it or move to a city. Jim

The Lady in question did use to own the land . She grew up very poor and her Son acquired a lot of money and invested it in land in the village . She was then a big land owner . Most of her land got confiscated by the Government and now She is back working in the fields .
