    Thai child ownership of land

    I seem to remember DD saying that his house/land is in his girlfriend's name and leased to him for 30 years, so she can't kick him out (but kill him and return of rights?!?)

    My question. If someone has a child in Thailand with a Thai woman, and wants to buy a house, is there anything to stop the land, leased to the father for 30 years, being in the child's name, and the house in the father's name? I suppose this could get very complicated with custody rights etc if a spilt happened, but it seems to be a way at initial thoughts of kind of having land ownership, moreso than it being purely in the mother's name.

    Thought?

    Nope cant do that, the child has to have gaurdians to make the decisions for him, well i think so anyway also I got a signed empty will by her aswell just incase, and she aint the mother of my child and that little problem was sorted out years ago, my son stays with me

    If it isn't possible, how about a trust fund? Or is that getting into the dodgy are of Thai nominees?

    you cannot have a trust fund in Thailand, Thailand doesn't recognise the concept of trusts.

    you can have land in the name of a child, but with guardians. The downside is that you cannot sell the land without a court order.

    ...and I've been told children who own land can't grant leases - they have to be 20 years old to be able to do that.

    Don't know about here, but in Mexico you can't do it til the child is 18 years old.
    So I see no reason that you could give a minor anything like land.

    I would need to double-check, but I'm almost certain that the guardian can grant a lease over the land on behalf of the child (as part of managing the child's assets). Problem is, if you are both the guardian and the potential lessee of the land, I think that would be a conflict of interest situation.

    Does anyone know if there is a difference in the thai law
    regarding the full thai child vs. the half thai child regarding
    land ownership and legal guardians.
    I would like to purchase some thai land and put it in my 3yr old sons name
    without the threat of him losing this if something should happen to me.

    As far as I know if the child is born here by a Thai mother they have 100% Thai rights. Our new house was put into my daughters name

    I think you'll find that the Thai side of the family have full legal rights to do anything they want with the land until your child reaches 18.

    You must have a 30 year lease signed if you want any security (based upon current regulations and subject to change on a whim).

    it used to be the case that luk-krueng children couldn't own land in Thailand, but this rule changed in the late 1990s and now luk-krueng children, who are registered in Thailand, enjoy full rights.

    however, those of us who lived here before the change sometimes forget the change took place and still think of things the way they were
