My comment a bit tongue in cheek but agree, no government should get in the way of justice. Justice is a function of the laws of a particular country. If someone breaks the law in a country they deserve to be tried in accordance with and as punishable by the law of that country. Refusal to extradite to a particular country because another country does not like their laws is something which should not be practiced.Originally Posted by brettandlek

Experts fly out to defend jail, justice system

May 20, 2011
A TEAM of Victorian experts will leave for Thailand tomorrow to defend the state's jail and justice systems at a pre-extradition hearing for two men allegedly involved in the murder of Luke Mitchell.
The delegation, requested by Thailand, will include a Homicide Squad detective, a senior Crown prosecutor and an official from Corrections Victoria. Two Thai nationals charged with the murder of Mr Mitchell will fight extradition from Bangkok, claiming that they will not receive a fair trial in Melbourne and that the Victorian jails they will be held in are Third World standard.
Sarud Seehaverachart, 28, and Thatiya Terdputham 25, have been charged with the stabbing murder of the 29-year-old Sanctuary Lakes chef outside a Brunswick convenience store, close to where he allegedly stepped in to break up a fight outside a nightclub on May 24, 2009. It is alleged that three men involved in the murder then fled to Thailand.
Police have been unable to track down the third man allegedly involved in the murder.

The final indignity, the Australian government is forced to send a delegation to testify to a panel of monkeys that the Australian prison regime is a fit and proper place, as compared to the Thai regime which palpably isn't, in which to detain 2 homicidal chickenheads once they are extradited.
Personally, if I were the Australian premier and these thugs weren't extradited without further ado I would take Australia out of the FTA, increase visit visa fees for the Thai to $10,000 an application, exclude all Thai from student visa applications since most are bogus and used to facilitate entry into a country by means not otherwise available and down grade their embassy to consular status only.
No country in the world needs Thailand as much it needs them.
The only thing the Thai understand is money and the constant reminder that their country is nothing more than a glorified brothel run by a ragbag collection of mafiosi masquerading as politicians with a few nice beaches.
Well, yes, a reasonable point.
Luckily, I can lead a life here parallel to the little bastards and am very careful not to engage with them unless it is to transact some service or other, the terms of which are advantageous to me.
Having said that, sometimes choices are made for one but as things stand I am reasonably confident elsewhere will be a viable option.
Don't get me wrong, there are attractions but the demerits seem to be increasing not least the Thai capacity for stupidity which never fails to astonish.

Thai men fight extradition over Australian's death

Two Thai men who are fighting extradition to Australia over the murder of a Melbourne man have appeared in court in Bangkok.
Australian authorities are trying to get the pair extradited over the death of chef Luke Mitchell in May 2009.
Mr Mitchell was stabbed five times after a fight outside a nightclub in suburban Melbourne.
Sarud Seehaverachart, Thatiya Terdputham and a third man who is still at large were studying in the city.
They fled back to Thailand after the incident, sparking criticism of Australian police who failed to stop them.
The accused are fighting extradition, claiming Mr Mitchell was drunk and they acted in self-defence.
An Australian prosecutor present at the hearing has told the court that the pair would get a fair trial in Australia.

THE brother of murdered good samaritan Luke Mitchell hopes the two Thai men charged with his stabbing death face justice in Melbourne.
Shane Mitchell says his family is prepared for a long legal battle to get Sarud Seehaverachart, 28, and Thatiya Terdputham, 25, extradited from Thailand after their appearance yesterday in a Bangkok court.
Mr Mitchell told The Age he always expected it to be a protracted process, but was confident the tenacity of homicide detectives from Victoria and the Thai and Australian justice systems would prevail.
"We would like to think that the system will work in our favour," Mr Mitchell said. "It's important for the family that the matter will be settled here."
A team of Victorian experts were in court for Monday's hearing after the two alleged killers said they would not get a fair trial in Australia and they would fear for their lives in jail.
Send em to the International Criminal Court then, along with abisit![]()

Thai men fight extradition over Melbourne murder
Zoe Daniel
September 26, 2011
Two Thai men accused of murdering a Melbourne chef in a fight have asked a Bangkok court not to extradite them to Australia.
The judge at the hearing has set November 30 as the date for judgment on the extradition of Sarud Seehaverachart and Thatiya Terdputham over the murder of Melbourne man Luke Mitchell in May 2009.
The court heard the two accused would prefer to be tried in Thailand because they are Thai citizens and believe in Thai justice.
Mr Mitchell was fatally stabbed in a fight outside a Brunswick nightclub.
The two accused were studying in Melbourne at the time.
Both accused men say a third Thai man who is still at large is to blame for Mr Mitchell's death.
They have previously said that Mr Mitchell was drunk and the stabbing was in self-defence.
