    Moog. I think you are simply much more accepting of the range of gays, lesbians, transgenders, transsexuals, etc, etc than most of us.

    The bus driver has a job to do, and should have probably kept his opinion to himself. However, I would find two men kissing in public inappropriate.

    Well like we were saying a few pages back, Davis. Its a changing world now. And it's not necessarily our world anymore. Our time has come and gone.

    New civil rights don't make these sexual scenarios any less confusing for us old timers.

    But - one has to go with the flow - because people do lose their jobs over this stuff. And this defendant will lose his freedom. Any defence connected with the sexuality of the victim is going to fail.

    I prefer the 'stolen wallet' defence and a manslaughter plea.

    ^I agree that a sexuality defense will fail. I also don't recall any posters supporting the Marine's alleged actions.

    With a number of witnesses placing him in the room, I can't imagine a defense that has a prayer other than the one you suggest.

    He's done, unless he can pull a really big rabbit out of the hat.

    ^No go. The friend never went into the hotel. Room was right next to the desk clerk booth. Only two of them went in. Marine left alone after 30 minutes leaving body behind. Body was discovered about 15 minutes after the Marine left.

    Friend was with a Filipino in another room. Desk clerk went and got the friend saying her friend had fainted. Friend entered room with desk clerk and discovered he was dead.

    Shortly (minutes later) after that, Laude's friend ran into Pemberton's friends outside the hotel where they were looking for him. She said, "Your friend just killed my friend"

    Buddies grab a cab and run for the ship. Pemberton was almost certainly on the ship already.

    Trying to beat the Cinderella liberty bell. Undress, maybe shower - 5 minutes. Couple of rounds of some type of sex - 15 minutes (been on a ship for a while). Kill the guy - 10 minutes. Dressed and gone -2 minutes. Timeline works.

    OLONGAPO CITY, Philippines – The family of the slain transgender woman here may be ready to forgive the US Marine suspected of the crime, but the victim's German fiancé isn't.
    Speaking to media late Monday, October 20, at the wake of Jennifer Laude in this city, Marc Sueselbeck said he is not in the position to forgive Private First Class Joseph Scott Pemberton.
    "How can I forgive him? I'm not in the position to forgive him…I have more anger in my heart than probably most of the people here," Sueselbeck said.
    He added: "The only person who is in that position is God and Jennifer. And forgiving means understanding, and I doubt that I would ever understand what he did."
    Witnesses pointed to Pemberton as the last person seen with the 26-year-old Laude when the two checked in at Celzone Lodge last October 11 at around10:45 pm. About an hour later, Laude was found with her head slumped on the toilet. Police later said she died by drowning.
    Sueselbeck and Laude had been in a relationship for 3 years after first meeting online. They were set to get married in Thailand in 2015.
    The German national arrived in Olongapo on Monday afternoon to pay his respects to Laude and attend her interment.
    On Tuesday, October 21, the Olongapo City Prosecutor's Office will hold thefirst preliminary hearing on the case, following the murder complaint filed by Laude's family against Pemberton last week.
    Prosecutors have issued a subpoena ordering Pemberton to appear before the office and answer the complaint against him. But the US Embassy cannot guarantee that Pemberton will personally appear at the hearing, saying that his appearance rests on the decision of the American soldier's lawyers.
    A fair trial
    Despite his feelings toward Pemberton, Sueselbeck said he still wants the US soldier to get a fair trial.
    "Jennifer is for justice. Give [Pemberton] a fair trial under [Philippine] rules and that's it," he said.
    He added: "I cannot forgive [Pemberton], but again we have to honor Jennifer's name and memory. I hope he gets what he deserves."
    In calling for justice for Laude, Sueselbeck also stressed that Pemberton, as a foreigner, is a guest in the Philippines and should have to adapt to the country's culture and rules.
    "This is your country and she is your citizen. It's your law and he [Pemberton] is a guest here so he has to adapt to your country."
    "If he doesn't, then he has to face the consequences from your side and not the sweet talking he probably gets from the US," he added.
    He also expressed hope that the Philippine government will be strong enough to "claim [its] own rights."
    The Philippines has said that it wants to get custody over Pemberton, who is currently held on board the USS Peleliu.
    Under the Visiting Forces Agreement (VFA) signed between the US and the Philippines, the US has custody over its erring officers.
    Activists and the Laude family have demanded that the government take custody of Pemberton.
    Laude's sister Marilou said she wants Pemberton to appear at the hearing on Tuesday to reassure the family that he is still in the Philippines to face the complaint against him.
    Asked if he wanted to meet Pemberton, Sueselbeck said he only has one question for the 19-year-old soldier.
    "I just want him to give me an honest answer why he did it. That's the only question I have."
    'A moral question between us'
    Since news broke of Laude's killing, there have been speculations about the circumstances surrounding the incident.
    Witness Mark Clarence Gelviro, known as Barbie, had told police Pemberton had approached them at a nearby disco bar before proceeding to the lodge to check in.
    In earlier interviews, Sueselbeck denied that his fiancée had been a prostitute. A police report, however, said that Laude was a victim of a "crime of hatred" when the suspect discovered her true gender after he had engaged Laude for "sex services."
    Asked if his opinion of Laude changed since the incident, Sueselbeck said that it was a moral question that was not for the public to decide.
    "[It] is a moral moral question which would have to be discussed between me and her and her family and her, but it's not for the public. The moral part has nothing to do with the case. There could be nothing to imagine whatever happened that allows or makes understandable the act that happened," he said.
    He appealed to the public not to judge Laude and "fall to the same prejudices and discrimination" when at this point in the probe, nothing of the motive has been established yet, Sueselbeck said. – Rappler.com

    ^I don't like Germans. I just don't get gay people. I don't understand the constant flaunting of their gayness. Just seems really strange to me.

    If they want to be gay, why don't they just quietly be gay? Everything is a dramatic production.

    I've spent little time in Germany, but in general found the people dour, the guttural language offensive to the ear, and that they all smelled like Listerine.

    Food was good, though. And it was clean and everything worked efficiently.

    I spent 11 years in Germany and the only time I found them dour was when they went to the springs for their health retreats. Shifting all the beer and bratwurst was painful apparently.
    It was never spoken about in public but I think they still resented the compulsory immigration forced on them as a part of war reparations.

    Pemberton was a no-show at the Olongapo court this afternoon for the preliminary hearing.

    No surprise there, as he was under no legal obligation to appear.

    It will, of course, lead to more squeals of outrage.

    People react differently.

    I was talking to two Aussies guys on Soi 6. Good guys, mid 40s but their second trip to Thailand.

    Long story short, the night before one went to Walking Street, picked up a freelancer 'girl' and proceeded to a short time hotel. 'She' comes out of the shower, lays on the guy and he knows the score. He tells her to fuck off and the LB attacks him with stiletto heels. He beats a hasty retreat but discovers he's left his wallet in the room. He goes back with a hotel employee but the LB is screaming a yaba rant of fuck you and your mother and the guy leaves. He asks the employee to call the cops but she begs him not to, saying this LB is always a problem and it will be 'not good' for the hotel.

    Don't flame me, I'm just the messenger...

    They guy shrugs it off and moves on, even laughs about it.

    A bit like Indian tailors that won't take no for an answer. Back in the west you might get in their face or punch them. Here in SEA, I just don't acknowledge them, they don't exist.

    Although I could be wrong (I usually am), I doubt Pemberton will ever be in the custody of the Philippines, or even see the inside of a Philippines courtroom.

    Pemberton's trial will be by Courts Martial - multiple charges - with a conviction on Article 119 Manslaughter - voluntary manslaughter; Maximum punishment Dishonorable discharge, forfeiture of all pay and allowances, and confinement for 15 years. Also I expect he will be convicted of several lesser charges with the sentences to run concurrently. The sentence to be completed in a federal penitentiary. I expect the sentence will satisfy the Philippino prosecutor and courts.

    It is in the best interest of both countries that this issue fade away. At some point in time in the near future the USS Peleliu will quietly slip away, in the middle of the night with Pemberton locked up in the brig.

    The US/Philippine diplomats have already worked out the details and shook hands on how to handle this.

    There is no benefit seen in this incident/murder/case whatsoever. It will go down as a "crime-of-passion". Just the latest in a long line of altercations between the US Military and the Philippines nationals.

    As there is no benefit - this will fade away, or more than likely be quashed. Undetailed payoffs to all the "wronged" people will occur behind closed doors. "Jennifer's" family and the oh so heartbroken German fiancé will get a most reasonable payday for their "silence".

    But again, I'm usually wrong.

    ^I have to totally disagree. Pemberton will be tried in a Filipino court under the terms of the VFA. He will indeed see the inside of a Filipino courtroom, as will the four witnesses when they are called back to testify in the trial under the terms of the VFA.

    The Peleliu will not slip away; Pemberton will be in the brig there during and until the conclusion of the trial in a Filipino court.

    Pemberton will not be tried under a US courts martial, but by the Filipinos.

    The only question is, if convicted, who will incarcerate him for the term of sentence. I think there will be some diplomatic wrangling but, if the Filipinos are satisfied with the sentence, he will serve his time in a US federal facility.
