    I very much doubt it. Thais are not as desperate to get out of LOS as Flips are to get out of here. Also, in the Vietnam days, it was very hard for a trooper to marry. Basically, he pretty much had to finish his tour, and come back as a civilian to do it. It could be done, and was, but they threw up a lot of roadblocks.

    In contrast, when the USN left Subic for Guam after Pinatubo, they had teams of preachers on the gangplank marrying squids and their long-term honeys as the ships got underway.

    It's hard to believe that a year has passed since the killing and PFC Pemberton's arrest.

    Davis is it the verdict and sentencing that should be released next month ?
    Interesting indeed , I wonder how close to the Christmas holiday.

    ^Yep. Verdict and sentencing in December - I'm betting mid-month.

    The Senate managed to tie EDCA up again claiming the Supreme Court couldn't ratify it without Senate approval, so EDCA didn't get signed prior to Obama's visit here for APEC.

    Not that EDCA or no will make a difference. Under VFA, case must be done and done within a year - which is up mid-December.......although they could have very easily handled this case start to finish in a month. I have no idea why they spun it out for a year.

    I believe so, but am not certain. The terms of the VFA state that the accused stays in US custody until the case is concluded. I am also uncertain if "until the case is concluded" includes an appeal. Guess we'll see shortly. If convicted, the howling mob will demand he be hauled off immediately to Bilibid Prison.

    Davis ... What was the story on the four Filipinos who killed the Marine back in 2012? Why were two of them never charged and the other two only got probation?

    Thinking on it, in the Daniel Smith rape trial of over a decade ago, which was a set-up from beginning to end, Smith was convicted, was transferred to A Filipino prison, then released a few days later to US custody - locked in a shipping container on Embassy grounds, for the next several years while the appeal was ongoing. He was eventually released when the 'victim' admitted it was a set-up. She flew off to the US the next day...Smith was released.

    Rich kids. No witnesses other than a minimum wage gate guard. Kids claimed the Marine was drunk and started the fight. Gate guard said Marine was drunk and he didn't see who started it. Victim's wife, who was a US Embassy employee, left the country almost immediately. Embassy never pushed the case.

    Verdict is in! Guilty.....but of homicide (manslaughter), not murder. Judge said prosecution failed to prove murder.

    A very good sentence for Joe, who faced twenty years for homicide or forty for murder.

    Judge sentenced him to a minimum of SIX years, and a maximum of twelve.

    He could be out at 26......25 if he gets credit for the year already incarcerated.

    I very, very much doubt the Pemberton team will appeal. Thus, under the terms of the VFA, Joe should now be turned over to the Filipinos, and sent off to Bilibid Prison to do his time,

    We shall see.....Fair verdict all around in my opinion.

    they should put the US military on trial for "brainwashing" their rookies that "being gay is wrong"

    if the US military didn't make such a fuss about gay in the military, nobody would care and the poor kid would have enjoyed his night out with his favorite ladyboy without fear of repercursion or stigmatisation, and would have laugh about it and tell a good story to his mates who probably did the same thing before him.

    Forgot to mention: Laude's ever-venal family had filed a civil suit for 100 million Pesos (over 2.2 million USD) against Pemberton.

    The judge granted the suit, and awarded them 50,000 Peso (bit over USD1,000).

    Since the judge ruled positively for 50,000 Peso, Laudes can't appeal that either.

    I suspect he was probably homophobic before he joined the military.


    The Olongapo City Regional Trial Court has found Lance Corporal Joseph Scott Pemberton guilty of homicide for the killing of Filipino transgender woman Jeffrey “Jennifer” Laude.

    Pemberton is sentenced to minimum of six years to maximum of 12 years imprisonment.

    The court on Tuesday said the prosecution failed to establish that there was aggravating circumstances of treachery and abuse of superior strength so as to convict him of murder.

    In August, Pemberton in his testimony admitted choking Laude unconscious during a fight when he discovered she was a transgender.

    The court said that when Pemberton met Laude dressed as a schoolgirl and offering sex, he immediately agreed. While inside the motel, he got excited but “felt something different, something that was not supposed to be there and realized that [Laude] was a dude,” which he said he found revolting.

    “He was so enraged and in the heat of passion arm-locked, dragged him [Laude] inside the bathroom and dunked his head in the toilet bowl,” the court said, noting all that happened immediately after he discovered that Laude was a man.

    Such act, the court said, fell under the mitigating circumstance of “passion and obfuscation” as stated under Article 13 (6) of the Revised Penal Code. IDL/RC

    Clarification: More expenses were granted. Funeral costs, loss of income, etc. All in all, about USD 100,000. Far less than the 2.2 million requested.

    Not that they have much chance of ever seeing 100K+, which he ain't got.

    Pemberton's lawyer has said they will appeal the conviction based on "irregularities" in the trial. If so, that might keep Joe in US custody "until the case is concluded"....i.e. the appeal is ruled on. Given the speed of justice here, that could take a few years.

    This is what happened in the Dan Smith case of over a decade ago, where he appealed and was held in the US Embassy for over two years until the conviction was overturned.

    If para 1 above happens, look for huge screams of anguish from scum lawyer Roque and all the rent-a-protesters. It should also tie EDCA, which was almost a done deal, up for years.

    ^My thoughts exactly, as I said above. Great result. I can only see an appeal as a delaying tactic to keep him in US custody. It will certainly play that way here, with the gay groups, communist students, lawyer Roque, etc beating the drum.

    Court has now given the US Embassy and the Philippine Department of Justice five days to present to the court in writing the part of the existing VFA agreement that allows Pemberton to stay in his present confinement at Camp Aguinaldo vice being sent to Bilibid. Got a feeling this is going to get messier.

    A mad world, but thankfully lower than expected.

    But still an injustice and a long time indeed for the young teenager, for merely defending himself against a nasty pervert, a fully adult male, intent on premeditated, aggravated sexual assault.

    On a positive note, the protagonist and hero Pemberton will be free at 25 and still young enough to make something of his life and continue doing good .

    Maybe he can give after dinner speeches, about quickly and permanently dealing with the predatory homosexual rapists.
