    She is hardly doing anything.

    Nobody even knows what her platform will look like. She is setting up banal meetings with supporters, trying to make it look spontaneous, drinking lots of tea (probably laced with vodka) and hoping to appear Presidential.

    She is failing.

    She doesn't talk to the press, doesn't answer questions and, most importantly since you mentioned it, is pulling out all the stops to avoid testifying in front of Trey Gowdy and the Select Committee on Benghazi.

    She refuses to give access to her private server, her aides have refused to provide their e-mail correspondence to the committee and the State Department is covering for her by dragging their collective feet producing her e-mails.

    While Hillary Clinton’s lawyers are stalling Congress and “negotiating” the terms of her testimony before the Benghazi committee—an option not allowed to ordinary Americans like bankers, executives, or accountants, federal Judge Emmet G. Sullivan has hit “refrigerator rule #6: Enough is enough.”

    Earlier this week, federal Judge Richard Leon lambasted the State Department lawyers for their stonewalling. Now Judge Sullivan has chiseled a line in concrete. He has given the State Department only a week—until August 7—to get some answers from Hillary Clinton, and her top aides Huma Abedin and Cheryl Mills—under penalty of perjury.

    Last night on NewsMax TV with Emmy-award winning host Ed Berliner, I noted that Judge Sullivan recently reopened the Freedom of Information Act lawsuit by Judicial Watch to obtain emails from Huma Abedin, the top Clinton aide who is married to infamous and disgraced former Congressman Anthony Wiener.

    Judge Sullivan reopened the case when he learned that Clinton and her staff used personal email accounts to conduct government business. This is a flagrant violation of the Federal Records Act and jeopardizes national security—prompting rapidly escalating concerns of countless ramifications internationally, nationally, and criminally. Just hours ago, in that very case, Judge Sullivan entered a remarkable order, and he has given the State Department only a week to comply.

    Now the State Department must produce for the court’s docket its correspondence with and between Mrs. Clinton, Ms. Abedin, and Ms. Cheryl Mills regarding the government records in their possession; identify what servers, etc. the State Department has; require Ms. Clinton, Ms. Abedin and Ms. Mills to state under oath whether they have produced all responsive materials; and, have Ms. Abedin and Ms. Mills describe the extent to which they used Ms. Clinton’s server for government business.

    The order reads:

    As agreed by the parties at the July 31, 2015 status hearing, the Government shall produce a copy of the letters sent by the State Department to Mrs. Hillary Clinton, Ms. Huma Abedin and Ms. Cheryl Mills regarding the collection of government records in their possession. These communications shall be posted on the docket forthwith. The Government has also agreed to share with Plaintiff’s counsel the responses sent by Mrs. Clinton, Ms. Abedin and Ms. Mills. These communications shall also be posted on the docket forthwith. In addition, as related to Judicial Watch’s FOIA requests in this case, the Government is HEREBY ORDERED to: (1) identify any and all servers, accounts, hard drives, or other devices currently in the possession or control of the State Department or otherwise that may contain responsive information; (2) request that the above named individuals confirm, under penalty of perjury, that they have produced all responsive information that was or is in their possession as a result of their employment at the State Department. If all such information has not yet been produced, the Government shall request the above named individuals produce the information forthwith; and (3) request that the above named individuals describe, under penalty of perjury, the extent to which Ms. Abedin and Ms. Mills used Mrs. Clinton’s email server to conduct official government business. The Government shall inform the Court of the status of its compliance with this Order no later than August 7, 2015, including any response received from Mrs. Clinton, Ms. Abedin and Ms. Mills.

    Polls split on Hillary Clinton's favorability

    Washington (CNN)Just 39 percent of all Americans see Hillary Clinton in a positive light, while 49 percent have an unfavorable view the Democratic Presidential candidate according to a recent AP-GfK poll released Thursday.

    This is an eight point increase in her unfavorable rate since an April AP-GfK poll was conducted.

    A Washington Post-ABC News poll released just one day prior showed Clinton with a 45 percent unfavorable rating, but a 52 percent favorable rating.

    There are two factors that may be driving the different ratings. First, polls conducted online, as the AP-GfK poll was, often find lower favorability ratings for well-known figures than most polling conducted via phone. This is partly because online polling makes it easier for respondents to say they don't have an opinion of the person they're asked about. For instance, in the ABC-Post poll, just 4% say they have no opinion of Clinton, compared with 11% in the AP-GfK poll. These differences often hit the positive side of any poll question more than the negative one.

    With U.S. intelligence officials scrambling to contain damage from potentially hundreds of spy agency secrets in Hillary Rodham Clinton’s private emails, questions are mounting over why the Justice Department has not yet opened a criminal investigation against the Democratic presidential front-runner for mishandling a mountain of classified information.

    While some secrecy experts believe Mrs. Clinton will be able to build a strong case that material on her server was not classified at the time it was moving through her emails, others assert that what the former secretary of state did was far more egregious than the mishandling of information that saw former CIA Director David H. Petraeus sentenced to two years probation and a $100,000 fine.

    “I don’t see how the Justice Department would be able to avoid at least investigating this,” said Kevin Carroll, a former CIA officer and secrecy lawyer in Washington. “What Petraeus did was really small in comparison, because there was no exposure of any information to any foreign intelligence services.”

    Mr. Petraeus pleaded guilty to improperly handling hard-copy binders of classified military files and sharing them with his mistress and biographer.

    “In contrast,” said Mr. Carroll, “it’s certain that foreign intelligence services had access to the stuff on Hillary Clinton’s email.”

    “Information put on her home-cooked server and then sent around to other accounts is a very, very serious counterintelligence breach, and they’re going to have to have a really substantial look at the damage that’s been done to every agency that’s had its intelligence compromised,” he said.

    WASHINGTON – A senior adviser to Joe Biden’s late son Beau is joining the Draft Biden Super PAC to lay the financial groundwork for a potential presidential bid – a key hurdle for the sitting vice president if he hopes to take on Hillary Clinton in the Democratic presidential primary.

    Josh Alcorn, finance director and later senior adviser to Beau Biden, raised $1.2 million in six months in 2013 to fund Beau Biden’s potential bid for governor of Delaware. Alcorn moved back to Delaware from Washington, D.C., to work on Beau Biden’s bid after managing Senate Majority Leader Harry Reid’s vast national network of donors as finance director. Alcorn traveled consistently with Beau and served as a political confidante.

    Beau Biden’s gubernatorial campaign was never launched because the vice president’s son was diagnosed with brain cancer. He died in May.

    “I’m thrilled that Josh is joining Draft Biden. Biden supporters across the country know how close he was to Beau and his family,” Will Pierce, Executive Director of Draft Biden 2016, said in a statement Sunday.

    “Josh joining the Draft Biden effort only increases the seriousness nature of what to date has been an enormously successful effort,” Pierce added.

    While Alcorn’s move isn’t formally sanctioned by the Biden family, his new role lends legitimacy to a group that’s built an email list of 170,000 potential Biden supporters. And amid news reports that a dying Beau urged his father to run for president, it’s one of the first concrete and public steps from a member of the son’s inner circle encouraging a challenge to Hillary Clinton.
