18yo man charged with sexual assault of women in surf blamed rough sea conditions

An 18-year-old Victorian man has blamed rough surf and strong winds for a series of alleged assaults against girls and women on the Gold Coast.
Police allege the man assaulted eight girls and women as they swam between the flags yesterday afternoon at Surfers Paradise.

It is alleged the girls and women, aged between 15 and 24, were assaulted in a half-hour period.

They complained about the man to lifeguards, who called police.

The Pakistani national was charged with two counts of attempted rape, seven counts of sexual assault and four counts of common assault and appeared in the Southport Magistrates Court this morning.

The court heard the man allegedly sexually assaulted two of the females through their bikini bottoms.

His lawyer told the court that winds and big waves pushed her client into the women, who were swimming between the flags in separate groups.
But Magistrate John Costanzo said the man's explanation that heavy surf and wind conditions caused the alleged assaults seemed implausible.

"The Crown will argue that's the most unfortunate conspiracy of circumstances in history," he said.

Mr Costanzo denied the man's bail application because he was an unacceptable risk of re-offending.

"My view of the facts in this case is the Crown case appears to be quite strong in the allegation of eight separate, brazen and repeated sexual assaults and attempted rape," he said.

"It's an indication of a person having great difficulty controlling their sexual instincts."

Surf was 'nothing startling', police say

Outside court, detective Acting Inspector Greg Aubort said the alleged victims were asked if the surf conditions were rough and if the alleged assaults were accidental.

"We have individual reports very firm in saying these were deliberate acts," Mr Aubort said.

"If you look at the surf from yesterday, it was two to three feet, it was nothing startling in that sense."

He said other girls and women may have suffered similar experiences.
"We are encouraging any person who may have been the victim of any assault or similar to this to come forward.

"It's a terrible act to attempt to commit, particularly when you look at the age of these ladies."

The man is due back in court next month.

Anybody been caught in a rip tide or hollow tube for a period off time will understand the lack off control and disorientation this causes.

Especially if one is not used to the surf as most Pakistanis are not.

I doubt his defence will hold up on account off his Pakistani origin and the fact that most Pakistanis will avoid water like the plague unless he had a ulterior motive, firm white flesh.

^Scum might have gotten away with 'the wave pushed me into her' defense once, but EIGHT times is just greedy..

However, that Saudi got off with an "I slipped while walking by the couch and my dick just kind of fell into her snatch" defense.

Just need the right liberal apologist wanker judge.

Still, we're not talking about about 1 bird accusing him and a single incident here. we're talking a whole bunch of em, and he didn't get his arse out of the water when it became too rough either because the bluffing pervert hung around for around 30 minutes touching birds up.
The excuse of him being a land lubbing Pakistani trapped in the surf just doesn't wash..

    Yes, it is.

This fellow must have thought he was in Germany.

No bail. Straight to jail from the courthouse for this punter.

He is not going to walk free on a suspended sentence from that charge sheet in Australialand.

I can understand, though not accept him trying to touch them up in the surf, but 2 counts of rape? Did he get his todger out and try to stick it in while in the surf? or was he trying to slip his finger in?

Either way, it's pretty bloody shocking and amazing he thought he could get away with it.

With that many girls involved it's a shame just one of them couldn't have had a boyfriend / husband nearby to knock the cvnt unconscious and hopefully he'd have drowned before the Lifesavers got involved. Their defense could have been that rough surf knocked their fist into his chin, 8 times...

^Exactly. And while he was "fighting for his life" teenage girls were swimming around him without needing Lifesavers to launch the RIB . A report in a local paper said the surf was 3-4 ft.

Been wondering how long before this sort of thing would start up on the Gold Coast, it's a bit surreal walking around places like Surfers Paradise and Broadbeach where locals and western tourists wander about in shorts and bikini tops sort of stuff, right beside Arabs decked out in full Ninja. The mens eyes just about pop out. Beautiful place to live/visit.

Not likely, short sentence, intensive sex offender course, 4 weeks, then back on the dole in public housing.
Until next time, Australia doesn't deport non westerners who may face hard times in their home countries.

Done lots of immigration reports on prisoners, refugees, illegals etc, from drug trafficking to rape and murder.
They can't be sent back because their home country don't have the same rights as Australia.

If you were a war criminal in Africa, Afghanistan, Middle East or facing the death penalty in the USA, you can stay.
Taxpayers will take care of you, for life.

The judge has aired his opinion to the public before hearing the evidence and before the jury has been sworn in. Any hope of a free, evidence based trial, before one's peers, in racist Aus, or here on TD, seems a forgotten legal tradition.

Some questions to be answered, IMHO.

Is he an Australian resident, citizen or a tourist?

If one is accepted as an immigrant by the Aus authorities does the applicant immediately take AUS citizenship or does that only accrue after a period of time?

How long has the accused been a resident, citizen of Victoria?

How long has the accused been able to surf?

Any evidence to support that he is either an accomplished or an inexperienced surfer?

Any met data on the sea conditions at the time?

Any other Pakistani nationals in the water at the time?

Err, it was a jury which decided where they thought the truth lay based upon the evidence put before them, not a judge.

The group of surfers, formed to make the beach owners pay and who meet up every year at the beach in remembrance of a previous member who lost his life when an overly large woman sat on him in a state of sexual lust until he died of drowning.

Unfortunately they only had one board and one pair of trunks that day. A quick surf, dive and fumble with the target then back to shore for the replacement to go out. The frigid waters cause some problems for the older members but their libido guarantees at least one performance a day.

No wonder the original couple of complainers went from two to eight an now hundreds of women form 13 to 85 have started filing complaints to incidents going back to the 1950's.

The accused was only born in 1997!

The judge was never allowed into the club and has had a war against any club members that appear on his bench list continuing for some years. His wife however joins in the clubs actions every year, even filming some incidents. The judge is not amused at the weekly film nights his wife holds every Wednesday, after a session of "bingo" or "I'm not sure I should be doing this" held in the afternoon.
