    Oscar Pistorius sick during post-mortem evidence



    Oscar Pistorius was physically sick during the pathologist's testimony

    Oscar Pistorius vomited in court as he heard a pathologist's testimony about the nature of his girlfriend's injuries after he shot her dead.

    Pathologist Gert Saayman told the court that Reeva Steenkamp was shot three times, in the head, hip and arm.

    The judge had earlier banned live broadcast of the post-mortem examination testimony.

    The Paralympic athlete, on trial for murder, denies intentionally killing his girlfriend Reeva Steenkamp.

    Hunched over, with his arms over his head, Oscar Pistorius retched as Professor Gert Saayman gave a detailed account of the injuries the model sustained on Valentine's morning 2013.

    The court adjourned briefly to allow the athlete to compose himself but the break did not help.

    Judge Masipa, seemingly worried, asked if Mr Pistorius was coping. His lawyer Barry Roux admitted that he wasn't fine but added "nothing would change" and that Mr Pistorius wanted the proceedings to continue.

    The media has been barred from carrying a live broadcast, or publishing excerpts on social networking sites, of Dr Saayman's testimony, due to its grim nature.

    The court is yet to decided if a summarised version, agreed on by all the lawyers involved in the matter and the judge, will be broadcast at a later stage.

    Dr Saayman had petitioned the court for the exclusion, arguing that the court needs to protect the dignity of the deceased and her family.


    Mr Pistorius' body jerked and he retched as he heard the pathologist's evidence, reports the BBC's Pumza Fihlani at the court in Pretoria.

    A bucket was placed next to Mr Pistorius, who broke down in tears on several occasions, leading the judge to briefly halt proceedings.

    The pathologist described how the wounds on Ms Steenkamp's body were consistent with bullets being fired through a wooden object such as a door.

    The wounds to her arm and hip could have killed her because of the extent of the bleeding, Mr Saayman said.

    He added that the bullets used were a "black talon" type, designed to cause maximum tissue damage.

    The trial has now been adjourned and the pathologist will continue to give evidence on Tuesday.

    Mr Pistorius fired four shots at Ms Steenkamp through the bathroom door. He says he mistook the 29-year-old model and aspiring lawyer for an intruder.


    'Morals of society'

    Mr Saayman used the following arguments to persuade Judge Thokozile Masipa to ban broadcasts of his autopsy report:

    The Pistorius family sat, stiffly, holding hands in the row behind him. From my position I couldn't see the reaction further along the bench, where some of Reeva Steenkamp's friends were seated”

    • "Graphic details of the injuries have the potential to compromise the dignity of the deceased"
    • It may "harm the rights" of friends and family of the deceased

    The judge also banned coverage of the details of the post-mortem examination through Twitter and other social media, but did allow the media to summarise the evidence after it was given.

    Large parts of the trial have been televised - a first for South Africa - but there are some media restrictions in place.

    For example, there is a ban on showing the faces of witnesses giving evidence, as well as on close-up shots of people in the courtroom.

    Earlier, a security guard at the compound where Mr Pistorius lived defended his own account of phone calls made in the minutes after the shooting of Ms Steenkamp.
    Pieter Baba said he had phoned Mr Pistorius and not the other way round, as the defence team had suggested.





    • 1. Balcony


    • Mr Pistorius said in his statement at the start of the trial that he woke in the early hours and walked on his stumps to the balcony, pulled in two fans, closed the sliding door and drew curtains. He said that shortly before he had spoken to Reeva, who was in bed beside him.


    • He said he rejected prosecution claims that a witness heard arguing coming from the house before the shooting.

    • 2. Bathroom noise

      Mr Pistorius said he heard the bathroom window sliding open and believed that an intruder, or intruders, had entered the bathroom through the a window which was not fitted with burglar bars.


    • "Unbeknown to me, Reeva must have gone to the toilet in the bathroom at the time I brought in the fans," he said.


    • Mr Pistorius said he approached the bathroom armed with his firearm, to defend himself and his girlfriend, believing Ms Steenkamp was still in bed.

    • 3. Shooting

      Both sides agree four bullets were fired. Ms Steenkamp was hit three times.

      Mr Pistorius said he fired his weapon after hearing a noise in the toilet which he thought was the intruder coming out of the toilet to attack him and Ms Steenkamp.


    • He said he was in a fearful state, knowing he was on his stumps and unable to run away or properly defend himself.

    • Mr Pistorius said he rejected claims made by the prosecution that he was on his prosthesis when he shot at the door.


    • A witness told the trial she woke to hear a woman's screams and a man shouting for help. She said that after the screams she heard four shots.

    • 4. Bedroom

      At his bail hearing last year, Mr Pistorius said he went back to the bedroom after shooting at the toilet door, then noticed Ms Steenkamp was not in bed.
      Mr Pistorius said he then realised she could have been in the toilet.


    • 5. Toilet door

      Mr Pistorius said he went back to the bathroom but the toilet was locked, so he returned to the bedroom, pulled on his prosthetic legs, turned on the lights before bashing in the toilet door with a cricket bat.

    • 6. Emergency calls

      Mr Pistorius told his bail hearing he called the manager of his guarded and gated housing complex and a private paramedic service. He then carried Ms Steenkamp downstairs.
    If found guilty, the 27-year-old, a national sporting hero dubbed the "blade runner", could face life imprisonment.

    On Friday Mr Baba, a security guard working at Mr Pistorius' gated community, spoke of his shock at seeing Mr Pistorius carrying a dying Ms Steenkamp down the stairs at the athlete's villa.

    Mr Baba said he had called Mr Pistorius in response to neighbours' reports of gunfire from the house in the early hours of the morning.

    The guard said Mr Pistorius had told him: "Everything is fine," before calling him back a few minutes later and crying down the phone.

    On Monday, Mr Pistorius' defence lawyer suggested the athlete had called Mr Baba first and not the other way round, but the witness stuck to his testimony.

    Mr Pistorius' lawyer, Barry Roux, then suggested his client had said: "I am fine," and not: "Everything is fine," but again the witness said this was not true.

    "My Lady, what I just told the court is the truth," Mr Baba told the judge.
    Distraught

    During an emotional testimony on Friday, his former girlfriend, Samantha Taylor, described how Mr Pistorius fired his gun from his car. The athlete denies doing so.

    Mr Pistorius has appeared distraught as the events of 14 February 2013 have been recounted in the court in Pretoria.

    The state is seeking to convince the court that Mr Pistorius and Ms Steenkamp, a model, reality TV star and law graduate, had an argument before the athlete fired the shots that killed his girlfriend.

    There are no juries at trials in South Africa, and his fate will ultimately be decided by the judge, assisted by two assessors

    A friend of Oscar Pistorius has told his murder trial that the athlete "had a big love" for guns.

    Darren Fresco said that he had been with him on two occasions when a gun had been fired in public.

    Mr Pistorius had once accidentally fired a gun in a restaurant but made him take the blame, Mr Fresco said.

    The Paralympic athlete denies intentionally killing his girlfriend Reeva Steenkamp and says he mistook her for a burglar.

    Darren Fresco, in a black suit with shoulder-length, slicked-back light brown hair, seemed confident - some may even say cocky - as he answered defence lawyer Barry Roux's questions.

    Mr Roux has a tendency to ask the same question over and over again pressing witnesses on details, which can make them seem unsure, and Mr Fresco was no exception.

    For one, he could not explain why his statement had not mentioned Oscar Pistorius asking him to be his fall guy at Tasha's restaurant, or that he had made up a story to the restaurant owners about how the gun had gone off.

    Mr Fresco also was not sure when the Paralympian had asked him to take the blame for the incident, just that he had done.

    The lack of detail does not necessarily harm Mr Fresco's credibility. It has, however, given Mr Roux enough room to suggest he may be protecting himself and sacrificing Mr Pistorius.

    Mr Fresco's testimony has also given us a glimpse into the friends' fast life - guns, sports cars, beautiful women and a seeming disregard for police officers.


    Mr Fresco said that on another occasion, he had been driving when Mr Pistorius fired a gun out of a sunroof after police stopped him for speeding.

    He said Mr Pistorius had become angry after a police officer handled his gun, which was on the back seat of the car.

    "You can't just touch another man's gun," said Mr Pistorius, according to Mr Fresco.

    "Now your fingerprints are all over my gun. So if something happens, you're going to be liable for anything that happens," Mr Pistorius reportedly warned the officer.

    The BBC's Pumza Fihlani says Mr Pistorius was far more composed than on previous days. He sat cross-legged, looking straight at his friend and taking notes.

    Mr Fresco's testimony, our correspondent adds, has given the court a glimpse into the fast life he shared with his friend - guns, sports cars, beautiful women and a seeming disregard for police officers.

    Mr Pistorius' ex-girlfriend described the same incident in court in the first week of the trial.

    Samantha Taylor said both men had been agitated after police stopped them and had joked about "shooting a robot [traffic light]".

    Mr Fresco denied making the joke and said that the mood had been calm before the shot was fired "without warning".

    He said he had been left feeling as if his ears were bleeding and that Mr Pistorius had laughed after firing the shot.

    The trial has now been adjourned until Wednesday.

    Earlier, Mr Pistorius' defence team questioned a pathologist's finding that his girlfriend had eaten less than two hours before he killed her.

    This contradicts the athlete's account that the pair had been in bed for several hours before the shooting.

    Pathologist Gert Saayman said Ms Steenkamp had been shot three times, in the head, hip and arm but that he did not know the order of the injuries.

    If she had been shot in the hip or arm first, screaming would have been expected, he said.

    Neighbours have previously said they heard a woman screaming before the shots were fired but Mr Pistorius' defence lawyers argue that the athlete was the only one who screamed.

    When pressed by defence lawyer Barry Roux, Dr Saayman said that there could be an error of "an hour or two" in his estimation of when Ms Steenkamp last ate.

    "Gastric emptying is not an exact science My Lady but I don't think we should throw out the baby with the proverbial bathwater," Dr Saayman said

    Oscar Pistorius was not wearing his prosthetic legs when he smashed a locked door to reach his girlfriend, an expert told his murder trial.

    The forensic evidence contradicted the athlete's claim that he was wearing his artificial limbs at the time.

    The damaged bathroom door is in the court to be examined during the trial


    Mr Pistorius denies intentionally killing Reeva Steenkamp in February last year, saying he fired after mistaking her for a burglar.

    There is also a toilet cubicle in court, says the BBC's Pumza Fihlani at the court in Pretoria.

    It is a replica of the room in which Ms Steenkamp was shot.

    Forensic evidence on the location from which shots were fired, how they were grouped and their trajectory is being presented to the court.

    Cross-examining, Mr Pistorius' defence team asked forensic expert Police Colonel Johan Vermeulen to kneel and lift his feet, which caused him to wobble.

    The defence team claimed that Mr Pistorius therefore would not have been able to balance on his stumps and break down the door using a cricket bat.

    Defence lawyer Barry Roux also alleged that police had contaminated the crime scene by stepping on the door.

    Col Vermeulen argued that if Mr Pistorius was balanced enough to fire a gun, he could also break down a door with a bat.

    The forensics expert argued that the angle and location of the marks on the door suggested that they had been caused by someone much shorter than him.

    The defence team argued that a mark on the bottom of the door showed where Mr Pistorius had tried to kick open the door using his prosthetic legs.

    Col Vermeulen agreed that this was possible

    More importantly, they agreed with his account that he tried to smash the door in after the shots were fired - quite important to the case, as if they'd proven he had tried to smash it before the shots, it would blow his story out of the water.

    Pistorius forensic handling queried



    Police followed a "trail of blood" up the stairs after being called to Oscar Pistorius' house, a retired officer has told the athlete's murder trial.

    Col Schoombie van Rensburg said he found the South African Paralympian in a "very emotional state".

    Earlier, a forensics expert defended police handling of evidence.

    Mr Pistorius denies murder, saying he shot his girlfriend Reeva Steenkamp on 14 February 2013 after mistaking her for an intruder.

    The prosecution says he tried to beat down the door and then fired the gun following an argument.

    'Marks on door'

    Col Van Rensburg, who was initially in charge of the crime scene, said he immediately gave orders for it to be secured.

    Defence lawyer Barry Roux has said that evidence from the scene subsequently went missing


    When Col Van Rensburg arrived, he found Mr Pistorius in the kitchen, pacing up and down.

    He asked the athlete what happened, but "he was very emotional. He didn't understand", Col Van Rensburg told the court in the capital Pretoria.

    The officer, who retired in December after 30 years, described a "trail of blood" leading up the stairs and spots of blood on chairs in the living room.

    The court was shown photographs of the crime scene, which showed blood on the stair walls.

    Col Van Rensburg said there was a spatter of blood on the first floor landing, with some blood on the wall next to his trophies.

    There had also been a box with eight wrist watches on top of a cabinet, he said.

    Col Van Rensburg said he found the toilet door, through which Ms Steenkamp had been shot, locked

    He said when he entered Mr Pistorius' house, he found Ms Steenkamp's body lying in a pool of blood covered in white towels and black plastic bags.

    There was another woman there, Carise, the daughter of estate manager Johan Stander.

    She told him Mr Pistorius had phoned, saying he needed their help.

    Ms Stander also told him that she and Mr Pistorius had used the plastic bags and a towel to stop the bleeding.

    The prosecution has been attempting to cast doubt on parts of Mr Pistorius' story, including his claim that he was wearing his prosthetic legs at the time of the shooting.

    Earlier, Mr Roux asked a forensic science expert, police colonel Johan Vermeulen, why he had failed to notice marks on the bottom of the door.

    The lawyer said that the marks had been caused by Mr Pistorius trying to kick down the door using his prosthetic legs.

    However, Col Vermeulen told the court on Wednesday that the angle of marks on the door proved that Mr Pistorius was not wearing his prosthetic legs when he hit the door repeatedly with a cricket bat.


    'Missing watches'

    This contradicted testimony previously given by Mr Pistorius in which he said that he had put on his prosthetic legs before he attempted to break down the door.

    The defence lawyer showed the court a photograph of Mr Pistorius' prosthetic legs, with white socks and blood stains up to the knee.

    Correspondents say whether or not the athlete was on his prosthetic limbs when breaking down the door is important because it could match parts of his story that he shot Ms Steenkamp accidentally, or expose inconsistencies in it.

    Mr Roux seems to be also trying to raise doubts about police honesty and competence, correspondents add.

    He said a box of watches had gone missing from Mr Pistorius' home.

    Mr Roux asked Col Vermeulen about any police inventory of items from the home.

    The officer replied that he would not make an inventory of every item in a home where a crime has occurred.

    The damaged toilet door, with four bullet holes, has been in court along with a replica of the bathroom where Ms Steenkamp died.

    Before Col Van Rensburg began his testimony, photographs of Ms Steenkamp's bloodied head and face were shown in court, prompting Mr Pistorius to vomit.

    He was sick several times on Monday while evidence from the post mortem examination was presented to court and has also cried on several occasions

    A former South African police officer has said he was "furious" when two of Oscar Pistorius' watches went missing from the crime scene.

    Col Schoombie van Rensburg told the murder trial he ordered his officers to be body-searched for the "expensive" watches, but they were not found.

    He also said an officer had handled Mr Pistorius' gun without wearing gloves.

    Mr Pistorius denies murdering his girlfriend Reeva Steenkamp, saying he mistook her for an intruder.

    The prosecution says he intentionally shot Ms Steenkamp after an argument at his house on Valentine's Day 2013.

    Friday's hearing has now been adjourned and the trial continues on Monday.

    The competence of South Africa's police is often under the spotlight, especially when it comes to the handling of crime scenes, and there have been a few embarrassing moments for them at the trial.

    The court heard that two watches were allegedly stolen from the house and a ballistics expert handled the gun without gloves.

    We have previously heard shoe marks were found on the toilet door - a vital piece of evidence.

    While this does not discredit the state's entire case, it does not show the local police in a good light.

    Some have likened the Pistorius case to the OJ Simpson trial. Much like the OJ case, which was pinned on circumstantial evidence, the prosecution is relying on the police to help prove their case.

    With the world watching, local law enforcement will doubtless be feeling the pressure. They will not want to be blamed for jeopardising such a high-profile case.


    After returning to the main bedroom where a team of forensic experts was gathering evidence, he realised one watch, said to be worth as much as $10,000 (£6,000) was missing. He said he was told Mr Pistorius' sister Aimee had come into the room and removed it.

    After leaving the room again, another watch went missing, so he gave instructions for the police officers and their cars to be searched.

    Col Van Rensburg said that after that, everyone entering and leaving the scene was thoroughly searched and entered into a log, presented in court.

    He described his stunned reaction to the watches' disappearance: "I said: 'I can't believe it. We were just there. How can this watch be gone?'"

    He said he told Mr Pistorius he should file a complaint, while he opened a case of theft.

    The former officer, who retired last year, also told the court he was angry when he saw a ballistics expert handling Mr Pistorius' 9mm pistol without any gloves, and told him to put some on.

    The admissions call into question the police's handling of the crime scene, in a case that is likely to hinge on sensitive forensic evidence, correspondents say.

    Pistorius trial: Crime scene photographs shown




    Photographs of the bloody scene at the house of Oscar Pistorius have been shown to court at the South African Olympic athlete's trial in Pretoria.

    His defence team say the police crime scene photographer failed to label his pictures correctly, which he denies.

    Mr Pistorius denies murdering his girlfriend Reeva Steenkamp last year, saying he thought she was an intruder.

    The prosecution says he intentionally shot the model after an argument at his house on Valentine's Day 2013.

    Photographer Bennie Van Staden was being cross-examined for the second day by defence lawyer Barry Roux on details of the photographs and what he touched at the home of Mr Pistorius.

    Mr Roux says the images indicate that evidence was moved around in violation of procedure during the investigation of the killing

    Mr Van Staden took hundreds of images at the scene, including several of the cricket bat that Mr Pistorius used to smash open the bathroom door as well as blood-soaked towels, two mobile phones, bullet casings and a gun.

    He was called to the scene at about 04:50 local time (02:50 GMT) and took pictures of the accused and the deceased, as well as pictures of the rooms of the house.

    He described nine photographs that he took of Mr Pistorius soon after the shooting, with the athlete wearing blood-soaked shorts in the garage of his home.


    Photographs examined

    Mr Roux has challenged previous police witnesses over details of their movements in a bid to uncover contradictions that support his argument that the investigation was bungled.

    In court on Tuesday, Mr Roux painstakingly examined photographs taken by Mr Van Staden and another police officer and pointed out objects that appeared in different positions in the images

    He also used data on each photo to suggest that the two policemen were taking pictures in the same room at the same point, despite Mr Van Staden testifying that he had worked alone.

    According to times on the photographs, both Mr Van Staden and the other police officer, identified as Colonel Motha, were in the bathroom at the same time.

    "You did not see Colonel Motha?" Mr Roux asked Mr Van Staden, who said he did not.

    "How big is this bathroom?" Mr Roux replied.

    The athlete's lawyer also challenged Mr Van Staden over two images of Mr Pistorius' bedroom, which showed tissues, a CD and a remote control in different positions.

    "How does it happen that there's such a great disturbance of that scene?" Roux asked.

    Mr Van Staden said he did not know who had moved the items, but added that he remembered the CD had previously been under the bed

    Oooh another neighbour saying she heard a woman screaming between the two sets of shots, but apparently there was another inconsistency in her account so the defence lawyers is obviously trying to hammer the point home.

    Capt Francois Moller read a message to the court, in which Reeva Steenkamp said she was "sometimes scared" of Oscar Pistorius


    Oscar Pistorius' girlfriend Reeva Steenkamp sent him a text message saying: "I'm scared of you sometimes," his murder trial has heard.

    The message was sent after the couple had a row when he accused her of flirting with another man - weeks before he shot her dead.

    A police captain has been testifying about the couple's mobile phones.

    Mr Pistorius denies deliberately killing his girlfriend of three months, saying he thought she was an intruder.

    The trial has now entered is fourth week, with the prosecution expected to wrap up its case before Friday

    The court heard the couple called each other "Angel" and "Baba"

    "Angel please don't say a thing to anyone…Darren told everyone it was his fault. I can't afford for that to come out" (Oscar Pistorius, 11 January 2013 following alleged shooting incident



    Capt Francois Moller said he had been able to extract some 35,000 pages' worth of messages from Ms Steenkamp's phone.

    He told the court on Monday that 90% of the messages between the couple were loving, but he had picked out exceptions



    'Jealous and possessive'

    Mr Pistorius has said he has forgotten the password to his iPhone and investigators went to the US shortly before the trial began to meet Apple officials to try and gain access to it.

    In one message sent on 27 January 2013, Ms Steenkamp wrote: "I'm scared of you sometimes and how you snap at me and of how you react to me."

    Verdict soon and I smell another OJ, if he does get off then the media will hopefully fcuk his life up forever. - sad to lose legs but he seems such a nasty bsatard.

    Thankfully there is no jury in this case and the SA prosecution appear to be more adept than the DA attached to the OJ Simpson trial farce.

    Unfortunately no verdict on the horizon just yet as the trial is to continue until mid-May to allow defence counsel to put their slant on events. Should be interesting.

    No weepy waily PC jurors puts the onus on the judge, who, in this case, seems fairly astute, ....see how it goes.
