On Christmas Day, 18-year-old Sarah McKinley lost her husband to lung cancer, leaving her the sole caregiver to their three-month-old son.

On New Year’s Eve, the Oklahoma mother proved she was anything but defenceless after she shot and killed an intruder breaking into her home, the Daily Mail reports.
Two men tried breaking into Ms McKinley’s house, one armed with a 12-inch hunting knife.
The distressed young mother called 911 to request advice on what to do with the armed men.
"I’m in here by myself with my infant baby, can I please get a dispatcher out here immediately?"
"I’ve got two guns in my hand - is it okay to shoot him if he comes in the door?" she said to the dispatcher.
The dispatcher replies: "I can’t tell you that you can do that but you do what you have to do to protect your baby."
Ms McKinley then shot one of the intruders in the torso with a 12-gauge shotgun, killing him.

Police found the intruder, Justin Martin, 24, slumped over a floral-print sofa with a single gunshot wound. He was pronounced dead at the scene.
Authorities said the shooting was in self-defence and she will not be charged.
Detective Dan Huff told KOCO-TV that under some circumstances, shooting a person is permissible.
"You’re allowed to shoot an unauthorised person that is in your home," he said.
"The law provides you the remedy, and sanctions the use of deadly force."

10 years ago she'd have been licking out 18stone bull dykes for 12 years.

Now? The Crown Prosecution would probably let it go. There have been a couple of high profile cases in the last 6th months where intruders have been stabbed to death and although arrested the home / business owners were not prosecuted.

Homeowners and shopkeepers are to be given the right to protect themselves against burglars and robbers.
They will now be allowed to use reasonable force if they perceive a threat to their property. Previously they could act only when they feared for their lives.

It is one of a series of reforms unveiled by David Cameron in a sharp turn to the right on law and order. As well as more life sentences there will be tougher punishments for knife crime.

Boatboy: Sorry, i can't find the link article again, but it was reported by a wide range of news media in the US today. If two miscreants break into a house and kill someone, they can both be charged with murder, even if only one pulled the trigger, as can a lookout or driver who never even entered the house. They are applying this same law, even though it was one of the bad guys who got whacked. It should hold up in court with no problem, as there are loads of precedents.

Good job by the young Mother, And yes why should the other guy not get charged with his involvement in a crime that ended up costing a life, he certainly is part responsible.

Peoples homes is their sacred refuge, and IMHO anyone entering unlawfully is fair game also for the use of lethal force, you really are not given a chance to engage in a debate with the thieving possibly murderous pricks whether they are just going to rob you a bit or murder/hurt You and yours in the process.

Cop once told me, if you hear them breaking in, don't shoot until they're inside. If your shot blows them outside, drag at least part of them back inside. And, if the prick has a weapon next to him, like one of your kitchen knives, it makes my report easier to write.

Woman Kills Intruder After Asking 911 Operator For Permission To Shoot Him

For Sarah McKinley of Blanchard, Oklahoma the past few weeks have been unbelievably harrowing. First, the 18-year-old's husband died of lung cancer on Christmas. Then on New Year's eve two men tried to break in her house while she was home alone with her infant son. One of the men made it through her front door, and after checking with a 911 operator to make sure it was legal, McKinley shot and killed him.
Though McKinley didn't piece things together until after the shooting, she'd had several strange run-ins with 24-year-old Justin Shane Martin. According to CBS News, her mother says that about two years ago, she noticed Martin following McKinley around at a rodeo. Recently the two bumped into each other at a convenience store, and on the night of her husband's funeral he showed up to her door and introduced himself as a neighbor, but McKinley didn't let him in. In the past month McKinley had started locking her doors because she thought someone had moved things around in her home, but her mother thought she was imagining things due to the stress of her husband's illness.
On Saturday he returned to the house with 29-year-old Dustin Louis Stewart and the two men tried to get in her front and back door, which were locked. McKinley barricaded the front door with her sofa and went to her bedroom, ABC News reports. There she put a bottle in her son's mouth, found her two guns, and called 911. She was on the line for 21 minutes as the men continued to try to get in the house, and at one point she asked the dispatcher, "I've got two guns in my hand — is it okay to shoot him if he comes in this door?" The dispatcher said, "I can't tell you that you can do that but you do what you have to do to protect your baby." When Martin finally made it through the front door with a hunting knife in his hand, McKinley shot him in the chest, killing him. Stewart ran when he heard the gun shot and police found Martin slumped over the couch.
McKinley said after the incident:

I wouldn't have done it, but it was my son ... It's not an easy decision to make, but it was either going to be him or my son. And it wasn't going to be my son. There's nothing more dangerous than a woman with a child.

Stewart turned himself in and is facing a first-degree felony murder charge. Prosecutors say that even though he didn't shoot the gun, he was charged because the death occured during the burglary. Stewart says he and Martin took prescription painkillers before the incident and they targeted the house because they knew McKinley's husband died of cancer and might have pain medication. Authorities say McKinley clearly acted in self-defense, and she won't be charged with a crime.

(CNN) -- A man accused of trying to break in to a woman's Oklahoma home is scheduled to be in court Thursday as he faces murder charges in the shooting death of his accomplice.
But Dustin Louis Stewart, 29, didn't pull the trigger -- the woman who lived at the residence with her 3-month-old son did.
Stewart is facing a first-degree felony murder charge even though he did not pull the trigger, because if someone dies during the commission of certain crimes, such as burglary, an individual can be charged in the death, prosecutors said.
The incident has caught the nation's attention because part of the action was captured during a 911 conversation.

Home alone with her 3-month-old son, Sarah Dawn McKinley of Blanchard, Oklahoma, said she decided to make a stand when the two men tried to break into her home on New Year's Eve.
McKinley, who had been widowed less than a week before, placed a couch in front of one door and went to the bedroom and put a bottle in her baby's mouth before calling 911, she said on HLN's "Dr. Drew" on Wednesday.
A 911 operator calmly spoke with McKinley, who asked if it was permissible to shoot an intruder, officials said.
"I've got two guns in my hand. Is it OK to shoot him if he comes in this door?" asked McKinley, 18.
"Well, you have to do whatever you can do to protect yourself," dispatcher Diane Graham responded. "I can't tell you that you can do that, but you do what you have to do to protect your baby."
In the end, McKinley fired a 12-gauge shotgun and killed Justin Shane Martin after he entered her home, according to a Blanchard Police Department affidavit filed in court Wednesday. Martin was armed with a knife, authorities said.
"You have to make a choice, you or him. I chose my son over him," McKinley told CNN Oklahoma City affiliate KWTV.
First Assistant District Attorney James Walters said that McKinley will not be charged because she acted in self-defense.
"A person has the right to protect themselves, their family and their property," Walters said.
As for the 911 operator's guidance?
"I would agree with that advice," the prosecutor said.
Graham was the first of two 911 operators to speak with McKinley.
The dispatcher told HLN's Jane Velez-Mitchell on Wednesday she learned in training that she could not tell a caller to shoot someone, "(but) as a mother, I wanted her to protect her baby."
"She did a very good job in keeping her (McKinley) calm," Grady County Sheriff Art Kell said of Graham. "Her job is to make sure the person on the phone is comfortable ... to give them support."
McKinley was on the phone with a second dispatcher when she pulled the trigger.
McKinley's husband died Christmas Day of cancer, Walters said. Evidence indicates Martin and Stewart may have been looking for painkillers or other drugs taken by McKinley's ill husband, Walters said. Investigators found no such drugs, he told CNN.
McKinley said she believes the men were coming after her, rather than intending to commit a robbery.
According to the affidavit, the men approached McKinley's mobile home Saturday afternoon. Martin had devised a plan to burglarize the residence, police said.
Stewart told investigators he and Martin ingested hydrocodone about 30 minutes before reaching the rural home, the affidavit states.
Martin "aggressively" knocked on the doors of the home and gained entry by hitting one of them with his shoulder, police said. Stewart said "he heard a gunshot after Martin entered the residence," and Stewart then "fled on foot."
McKinley said she had pushed the couch against the door to deter entry.
"When he busted in the door I saw something shimmering in his hand," the mother told HLN. "I thought it was a pistol at first, but it was a 12-inch hunting knife. I didn't know (that) until after I shot and killed him."
Martin, 24, was found between the door and a couch with a knife clutched in his gloved left hand, police said.
CNN's calls to police in Blanchard, about 25 miles south of downtown Oklahoma City, were not immediately returned Wednesday.
Stewart's attorney, Stephen Buzin, told CNN he will seek bond.
Buzin would not comment on specifics of the case against his client. "We will let the facts come out at trial and feel comfortable with his innocence," the attorney said.
Martin recently had approached McKinley's home, saying he wanted to introduce himself, Walters said. The man said he worked for the owner of the property on which McKinley lived, she told HLN.
McKinley, also armed with a pistol, was on the phone with authorities for 21 minutes, Walters said.
"She remained as calm as one could under the circumstances and had the forethought and called 911, as everyone should," he said.
McKinley was asked on "Dr. Drew" whether she regretted shooting Martin.
"No. We could have been in a whole different situation if I hadn't done it," she replied.

^Have to admit, that's a long response time. But, the cops didn't initiate the criminal act. Still a long time for a terrified teenage widow to hear armed intruders breaking into her barricaded home. I still say good on her, and tough shit to the scumbags. I reckon a jury will see it the same way.
