This is going to be the crux of the matter, and bp are boxing clever imho, they will have something to fight back with, of which you can be rest assured.
Transocean would have to submit site specific method statements along with risk assesments, in some detail, these in turn would have to be scrutinized and accepted from bp, then sent to the regulatorary health and safety authority or regulator USA for scrutany, {possibly}.
If they have been accepted by all, there is a procedure that has maybe not been adhered to, apparently 7 fail safes to guard against accidents, some breached obviously.
Now whose fault is it ?

A simple statement from bam bam, could have been 'we will ensure the clean up operation will be swift and any negligence will be dealt with with the highest order'

The main issue here as far as I am concerned was to prevent an accident or incident in the GOM. It happened and there are a few companies going to carry the can not just BP.
They are the client does everyone understand this? The project for deepwater drilling is in their name.
However there are other players in the mix.. Transocean the owners and operators of the platform,whose PTW (Permit to Work System) was accepted by the US Government and as rig operators are fully responsible for their operations.
Just a point this company has moved from Delaware in the USA to the Cayman Islands and then to Switzerland (sounds like a tax dodge to me.)

The biggest US Government contractor in the world, have their fingers in all the pies. ie.Iraq, Afghanistan and a lot of other countries but moved outta the good ole US of and relocated to Dubai UAE.
