    A non-binary patient in Canada is seeking taxpayer-funded surgery to create a vagina while also keeping a functional penis.

    If a court rules in their favour, the patient, 33, from Ontario, will travel to a specialist clinic in Austin, Texas, for the procedure.

    The patient, referred to in court documents as KS, was born male but identifies as non-binary. They do not identify as one gender but “literally a mix”, according to court documents.

    They argue that forcing them to undergo binary surgery “could be considered an illegal act of conversion therapy as well as a violation of the Ontario Human Rights Code”.

    Rights group said decision was discriminatory
    Ontario’s Health Insurance Plan (OHIP) initially denied the request for the surgery in 2022 on the grounds that the procedure is experimental and is not performed in Canada.

    But KS complained to the province’s appeals board, which overturned the decision on the grounds that vaginoplasty shouldn’t inherently include a penectomy.

    LGBTQ rights group Egale Canada said the OHIP’s “interpretation (of a vaginoplasty) is exclusionary and discriminates against nonbinary people on the basis of their gender identity”.

    The decision prompted a counter-appeal and Ontario’s Superior Court of Justice is expected to issue a ruling in the coming months.

    It is unclear how much the surgery would cost, but the clinic, The Crane Center, told the National Post their surgeries range from £8,000 - £56,000.

    According to court documents, KS has suffered from gender dysphoria since they were a teenager. They are non-binary but are more “transfeminine” and use she/her pronouns.

    Transfeminine refers to people who were assigned male at birth but identify as more feminine than masculine, or tilt towards being female.

    KS’s doctor, an Ottawa endocrinologist, wrote a letter supporting the request for the surgery.

    “It is very important for (KS) to have a vagina for her personal interpretation of her gender expression but she also wishes to maintain her penis,” the doctor said.


    “(KS) is transfeminine but not completely on the ‘feminine’ end of the spectrum (and) for this reason it’s important for her to have a vagina while maintaining a penis.”

    Gender treatment ‘off the rails’
    Critics told the National Post the request illustrates “how far off the rails” gender-affirming treatment has gone.

    “Our public healthcare system is at the breaking point and really needs to focus on procedures that are medically necessary,” Pamela Buffone, founder of the parents’ group Canadian Gender Report, said.

    “The patient will not be physically healthier because of the operation, which is likely to result in complications and the need for corrective surgeries and further demands on the health system.”

    The goal with phallus-preserving vaginoplasty is to create a vagina that is “aesthetically pleasing” while “maintaining the original genital structure” of the penis, according to the Art Plastic Surgery clinic in New Jersey.

    A similar case last June saw the OHIP fund surgery for a civil servant, 41, who had a penis constructed without removing their vagina and uterus.

    I am far, far less happy to be compelled by law (or threat of prosecution) to use them (this is what Jordan Peterson has been banging on about for a few years).

    The question for me is how much do I have to buy into your fantasy? The answer is apparently, all the way.

    more complaints than JK Rowling. Mr S isn’t quite sure how much genuine hate crime has been reported but if there’s one thing the Act has done successfully, it’s stirring up a rather significant amount of hate for itself.
    North of the border, the legislation is tearing the country apart. Murdo Fraser, the Scottish Tory MSP, continues to demand answers as to why he has a non-crime hate incident on his record but the First Minister — who has also had hate crime reports made against him — doesn’t. Meanwhile, the pro-independence party Alba has demanded that the Hate Crime Act be repealed, creating a tough job for its spinners who have, over the weekend, tried to convince the public that the party’s only MSP, Ash Regan, is now firmly opposed to the new law — despite being its formal supporter on the official record and voting in favour of it at the time.
    But Mr S is particularly interested in the groups that have chosen to stay quiet on the issue — and wonders exactly why that might be…
    Scottish Labour
    A total of 15 Scottish Labour MSPs voted for Yousaf’s hate bill in 2021, which might explain why the party has kept a fairly low profile of late. Its current leader, Anas Sarwar, was a proponent of the bill at the time, voting in favour of it. But rather than explain why Scottish Labour’s politicians had supported such a controversial policy, a curious quiet from the Scottish Labour camp extended into Monday, the bill’s implementation date, before Sarwar broke his silence.
    When questioned on his position now, the Scottish Labour leader didn’t u-turn quite as much as his Holyrood colleague Regan. However, while Sarwar says he wouldn’t repeal the bill if he was First Minister, he told journalists today that he would certainly amend it, primarily by including ‘sex’ as a protected characteristic to target misogyny and protect the voicing of gender critical views. Currently the protected characteristics include disability, race, religion, sexual orientation and transgender identity.
    And could Sir Keir Starmer be facing more north-south splits over the policy? Shadow minister Pat McFadden said on Tuesday that the UK Labour party would not be introducing similar legislation in Westminster. Sarwar’s party insists that this stance is not at odds with its own, and that if Scottish Labour are concerned about anything, it’s about how the bill will work in practice. With senior police figures admitting that the force doesn’t have the capacity to cope with hate crime reports, its fears are well placed…

While the organisation’s slogan insists that it will ‘defend freedom’, Liberty has not put out a single comment or article about Scotland’s new Hate Crime Act which, er, is a cause for concern for anyone who is remotely interested in freedom of speech. Mr S has reached out to Liberty’s press office for comment but it has not yet replied.
    Index on Censorship
    Another prominent organisation that was set up to campaign for freedom of expression — by esteemed journalists no less — has been strangely quiet as Humza’s hate bill came into force. Back in February 2021, the Index published an open letter to MSPs about its ‘serious concerns’ about the Hate Crime Act. It criticised Yousaf’s decision to withdraw amendments that would have ensure further protections for free speech ahead of the second stage of the bill:
    The Cabinet Secretary decided to withdraw amendments on freedom of expression at the eleventh hour… This move has, in our view, undermined the whole process of scrutiny to date… We strongly believe that producing workable provisions on the stirring up of hatred in this parliament is now entirely impracticable. These provisions could impact upon the most precious liberties in any democratic society: freedom of speech, freedom of expression, freedom of conscience and religion. They must be handled with the utmost care.
    Index on Censorship has also been active in the past for condemning Police Scotland for stifling ‘robust debate’ by focusing on ‘non-crime hate incidents’ at the start of last year — after it emerged the force had logged over 900 incidents of ‘malice and ill will’ without criminality in 2021. But despite the previous action taken by the Index, Mr S is a little baffled as to why the free speech organisation has kept so quiet of late.

    A series of jokes about, among other things, Jews and black people has led to a 28-year-old man being sentenced on Wednesday to seven days suspended imprisonment.

    Professor of constitutional law at the University of Southern Denmark, Frederik Waage, calls the ruling at the Court of Holstebro "remarkable".

    "The courts are now apparently pushing the boundaries of freedom of expression," he told P1 Briefing on Friday.

    The court found that these were insulting and degrading statements disguised as jokes.

    Therefore, the man was convicted under Section 266b of the Penal Code, also known as the racism section, because he had published the jokes on two websites.

    Specifically, according to the indictment, 129 jokes were involved, including "What's worse than the Holocaust? - Six million Jews" and "What's three feet long and wrapped around a shit? - A turban".

    Frederik Waage calls the jokes "gross" and "distasteful", but does not believe that before the verdict they would be considered to be covered by the racism clause.

    Racism paragraphs



    • Section 266b is also known as the racism clause.
    • It provides that "anyone who publicly or intentionally disseminates any statement or other communication" by which a group is "threatened, insulted or degraded because of its race, colour, national or ethnic origin" may be sentenced accordingly.
    • The penalty can range from a fine and up to two years in prison.
    • However, the penalty may be increased if the statement is "propaganda in nature".

    'I have experienced racism myself'


    The convicted 28-year-old man pleaded not guilty to the charge.

    He explained in court that he never intended to offend anyone and that he does not believe the jokes are racist.

    He himself has an Iraqi background and came to Denmark at the age of five.

    "I've experienced racism and it has nothing to do with jokes. I got my driver's license at the age of 18 and was stopped by the police ten times in the first two years," he told the court, according to Ritzau.

    The 28-year-old's defence lawyer, Jeppe Ravn Hattens Jensen, wanted his client acquitted and said the verdict was worrying.

    "I am deeply sorry about the result and actually also a little afraid of where it might leave the legal situation if you can be convicted of it," he told TV Midtvest after the verdict.

    They have now appealed the judgment to the High Court.

    Irony may occur


    Frederik Waage doubts whether the courts, within the framework of the racism clause, are able to take into account the irony that often permeates Danish satire.

    As an example, he mentions that the satirical group The Boys from Angora could get into trouble if they sang 'The Travel Song' from 2004 today:


    In the music video, the members of The Boy from Angora are dressed up in '70s clothes and apparently make fun of the way other cultures and minorities have been talked about in the past.

    - The song is deeply ironic, and I do not in any way believe that The Boys from Angora insults a population group, perhaps quite the opposite, says Frederik Waage.

    "But when you can be convicted in the Court of Holstebro for such a collection of jokes, as is the case, then I would be very reluctant to sing, for example, The Travel Song," he says.

    Testing the framework of the racism clause


    When the Court in Holstebro now sentences prison for a number of jokes that not so many years ago might have appeared in some magazines, it is an expression of the fact that the Prosecution Service has tested the limits of the racism clause, Frederik Waage believes.

    "And that has caused the court to move a little bit on this point," he said.

    "It may well be the right thing to do, but what you can question is whether it is the courts that should take this fight or whether it should be something that politicians took up.

    Special prosecutor Ulrik Panduro admitted after the verdict on Wednesday that the Prosecutor's Office is testing the limits of the racism clause.

    - Yes, you can say that. There is some case law in this area, but this case is special, and the prosecution service intervenes and says that we should try to see whether this is covered by section 266b of the Criminal Code and the gravity criterion that lies in it, he told TV Midtvest.
