The court is now adjourning for the judges to consider their decision
Chief Justice James Allsop says the court may reconvene "this afternoon or perhaps tomorrow morning".
I bet Tennis Australia love that comment considering that the Slam starts tomorrow
Let's also not forget that he gave false information on his immigration form . . . that alone is enough to bar him entry/send him out of the country.
Djokovic's lame reasoning that his manager filled out the form counts for nothing as Djokovic signed it, guaranteeing that the information on the form is correct.
Get rid of the prick.
Yeh, agreed.
IMHO grounds for cancelling the Visa and the strength a potential argument.
But the guys with the high pay-cheques think otherwise.
Maybe the government see the best public opinion if he remains in the country.
They can say they are 'tough on boarders' but then go to say the decision was taken out of their hands by the Federal Court.
NoVax loses in the quarters due to lack of preparation* ... or fakes an injury to keep face.
That's what makes this the best Soapie going around ATM

Tennis 2022: Novak Djokovic under fresh investigation, Spain
Now Oh-Oh ... this is the story you should have picked up on ...
---
But then ...Paris (CNN)French President Emmanuel Macron has said he "really wants to piss off" unvaccinated people, intensifying a heated political debate over strict new rules for those who have refused the shot.
In an interview with Le Parisien newspaper on Tuesday, Macron said: "I'm not for pissing off the French ... Now the unvaccinated, I really want to piss them off. And so, we're going to keep doing it, until the end. This is the strategy." Macron says he wants to 'piss off' the unvaccinated - CNN
Novak Djokovic can play in the French Open even if he’s unvaccinated. The French sports minister says Novak Djokovic would be allowed to play in the French Open even if he is unvaccinated.
Tennis world number one Novak Djokovic would be granted entry to France for the French Open even if he was unvaccinated against Covid-19, the sports minister said on Friday.
French Sports Minister Roxana Maracineanu told radio station France Info that Djokovic, who has openly been sceptical about the vaccine, would benefit from a special case scenario in France for major events such as the French Open. Providing false information doesn't appear to be a part of the government's argument. They have given him a slap wrist for that but say the effect is neutral...
I guess they lost that line of argument in the first court case when the prosecution basically waved the French flag...
I do not really understand why the court is weighing the merits of the decision. They should be confining themselves to the legality of whether the minister was acting within his legal authority.
As you illustrate, the answer has already been decided.
I suspect the "grounds/merits" of the minister's decision may or may not meet the legal extents of his actions, as defined by the OZ laws.
Here is an example:
Ministerial intervention under sections 351, 417 and 501J of the Migration Act 1958
"Circumstances not anticipated by relevant legislation; or clearly unintended consequences of legislation; or the application of relevant legislation leads to unfair or unreasonable results in your case. Documents to demonstrate:
- that you have circumstances that were not anticipated by the legislation relevant in relation to the visa that you were refused
- how legislation or policy did not intend that a person in your circumstances would be refused a visa
- how the refusal of your visa has led to an unfair or unreasonable result.
- how the refusal of your visa has led to an unfair or unreasonable result."
https://immi.homeaffairs.gov.au/what-we-do/status-resolution-service/ministerial-intervention#content-index-12
As an OZ federal judge has already found that the refusal of the tennis player's visa has been found, "Unreasonable".
Is the Minister, as the PM has been shown, above and unrestricted by OZ laws?
Or does ABC commentators or readers opinion/text numbers and youtube likes/dislikes, determine the OZ legal system's decisions?
The OZ federal judge should also be aware of TD members opinions.
One hopes you are sending the daily tally.
A tray full of GOLD is not worth a moment in time.
OhOh ... it's very subtle English which you may not have recognised.
From your link, the pre-amble starts with ...
... but it has been referred to the Minister, so, the page you refer to is irrelevant.Inappropriate to consider
The Minister has indicated to us that cases that do not meet the guidelines for referral and which have the types of circumstances described below are inappropriate for the Minister to consider. If your case has one or more of these circumstances, we will finalise it without referral to the Minister and will advise you or your authorised representative in writing:
The court will reconvene at 5:45pm AEDT
The judges have reached a decision and will deliver their orders at that time.
edit: Novak Djokovic has lost his Federal Court fight to stay in Australia
His application has been dismissed with costs.
another edit: What happens if Djokovic is out of the Australian Open (and country)?
If the court does not find in Djokovic's favour and he is deported, he will also have to withdraw from the Australian Open.
If that happens, he'll be replaced by a "lucky loser" who would take his place in tomorrow night's match against Miomir Kecmanovic.
That lucky player will be randomly drawn from the top four ranked players who lost in the final round of Australian Open qualifying.
To be eligible, the players will have to sign up tomorrow.

Keep your friends close and your enemies closer.
Novak Djokovic has lost his Federal Court fight to stay in Australia
His application has been dismissed with costs.
The decision was unanimous between the three judges.
Court adjures for 30 mins for the respondents to digest the ruling
Bye, Bye NoVax
Finally the right decision. Now for the Frogs to do the same.
So what does this mean?
OK so that's the news we've been waiting all day to hear.
As Chief Justice James Allsop outlined before announcing the decision, the court's job was simply to consider whether the decision made by Immigration Minister Alex Hawke was unlawful, irrational or legally unreasonable.
The court found the grounds outlined by Novak Djokovic's lawyers failed to demonstrate that.
It means the decision made by the Immigration Minister Alex Hawke to cancel his visa stands.Djokovic will be deported from Australia, will be unable to compete in the Australian Open and may face a ban on entry to Australia of up to three years
Hilarious seeing some of the Serb community in Oz threatening to leave. Yeah fuck off back to your backwater shithole where $500 a month jobs and cabbage soup awaits.
Fucking great.
Be nice if the flights are full and he has to slum it in economy.
