    Divorcing a Vietnamese citizen

    Anybody got any experience of this?

    My research has turned up that a marriage between a foreigner and a Vietnamese is supposed to be conducted under the law of the country where both are resident.

    I'm resident in Thailand, she is now resident in the US, so how does that work?

    I can't imagine that any Thai authority is going to be particularly helpful in respect of dissolving a marriage registered in Vietnam.

    Anybody know a good lawyer?
    Scotland is wet and dreary. Don't let anybody tell you different. Even the hills are mostly just big mounds, not proper mountains like the Alps or the Rockies.     You wont be able to do it here. Where your marriage is documented is where you divorce.

    Not according to Vietnamese law, but you're right, I can't see it happening here.

    Correct. Vietnam recognizes divorces obtained in country of common residence.

    I assume you were married in Vietnam?

    If your wife is in US and you had/have a common residence there, you need to file in the US.

    Filing in Thailand is not an option.

    Speak with a lawyer in the US. Depending on the state of your US residence, you may be able to file for divorce without going to court by using a Marital Termination Agreement. Essentially a document signed by both agreeing to an equitable property settlement.

    No wonder it's confusing. The pertinent question is, where did you last have a common residence? If you never had one outside VN, then based on VN law, looks like you should file for divorce in VN.

    Consult a lawyer in the UK.

    married for life, by the looks of it, unless you both agree to a divorce and the papers are sent to Vietnam
