    A lot of the Thai "peasants" haven taken to FB and Thai forums detailing their experience with Thai justice when they are not one of the chosen. My wife showed me one story where a poor guy got 5 years for selling illegal cds, another got 8 years for theft of medicine for a sick relative and another got 15 years for selling weed - all without suspended sentences.

    Orachorn's prison sentence was suspended for three years and she was put on probation.

    The court also banned her from driving until she is 25 years old.

    Before the court made the ruling, Pol Col Saran Nilawan, the father of Thammasat University first-year student Chutiporn Nilawan who died in the crash, said the defendant had never apologised for what happened, possibly because she might be afraid that it would affect the case.

    "I hope the court's ruling will favour the prosecution and I don't think a 120 million baht compensation order would be too much when compared to the incalculable losses," the father said.

    There was no immediate comment from him after the sentencing.


    Relatives of some of the nine victims made merit before the court handed the ruling on Aug 31, 2012.

    It's very simple, those were all property crimes which the Thai justice system treats very harshly, whilst ms Na committed a crime against the person, which the Thai justice system routinly treats very leniently.

    The justice system is just another tool to keep underclasses in their place, break the law and the punishment will be harsh, likewise types of crimes committed by the classes that are very much of the establishment get treated very liently.

    It's not that different to the states, look at punishments for crimes committed by poor blacks, such as possession of crack cocaine and compare it to the rather simular middle class crime of cocaine possession.

    Yes. I know of one Thai guy who stole a truckload of wood from his employer and got three years in prison. He was the driver - with two other guys. All three had worked at the lumber yard. Their total "haul" was worth around 6,000 THB. The owner forgave them and asked prosecutors to drop the charges. The prosecutor refused and they went down the river. But it's not just Thailand that uses this lopsided form of 'justice' to keep the poor people in their place.

    You'll also notice that in the UK crimes of theft or fraud against wealthy people also result in harsh punishment (compared to crimes against the person). If someone robbed a bank or a store in London or Leeds without violence they'd receive a custodial sentence without doubt. If two yobs kick some guy's head in for a lark at closing time, they likely get a fine or probation.

    ^ A better example would be the differential sentencing between blue collar crime such as shop lifting, benefit fraud, armed robbery and compare it proportionally to the white collar crimes such as pension embezzlement and large scale investment fraud.

    the judgment is actually "fair", she got probation etc... no different from what you would get overseas for the same "crime"

    a brainless 16yr old causing an accident is not ground for a death sentence or a harsh punishing judgment

    there was no intention to kill, just careless actions, and for that she is punished in acceptable proportion. Nothing will make up for that accident, so no need to overdo the sentence. She will also have to live with the memory of killing 8 people, and that won't go away easily.

    Like overseas, financial compensation is the only option in such a dramatic accident.

    In any sane country, not a feudal pretender liker this one, a 'real' judge would have sent a 'real' message that everyone is treated the same - the girl would have received a sentence to be served in a juvenile institution, with conditions no different from any other young inmate. The sentence might well be only a few months - but in custody would be mandatory.

    The Appeals Court on Tuesday upheld a two-year suspended jail term handed down by the Juvenile and Family Court on a girl, who was then 17 years old, who drove a Honda Civic sedan that crashed into a passenger van on the elevated tollway, killing nine people, in 2010.

    The court of first instance sentenced her to two years, suspended for three years. The girl was to be under probation for three years and banned from driving until she is 25 years old.

    The Appeals Court upheld the prison sentence, but extended the suspension period from three to four years during which time she is to perform public services for 48 hours per year.

    The court also upheld the driving ban until she reaches 25 years of age.

    The accident occurred on Dec 27, 2010 when a Honda Civic car driven by the girl, who was then 17 and unlicensed, crashed into a passenger van on the elevated tollway over Kasetsart University in Bangkok, killing nine people.

    Appeals Court reduces compensation for victims’ families in Praewa road carnage case

    The Appeals Court has ordered a substantial cut of the amount of compensation ordered by the Civil Court to be paid to families of nine road accident victims by family of Ms Orachorn “Preaewa” Dhephasdin na Ayudhya.

    In a ruling read by the Civil Court on Wednesday, the Appeals Court reduced the amount of compensation from 30 million baht to 19 million baht to be paid to the families of the nine victims, claiming that the fatal accident was not only the fault of Ms Praewa, but also the fault of the van driver for speeding although the speeding was not the direct cause of the accident.

    The court also ordered the family of the van driver to pay 120,000 baht in compensation to the families of the deceased passengers who were mostly students and lecturers at Kasetsart University.

    The fatal accident took place on the Don Muang tollway in 2010 when Ms Praewa smashed her car into the van, sending it to tumble down the road below from the elevated tollway. The van driver and eight passengers were killed and four other passengers were seriously injured, but Ms Praewa escaped unhurt.

    After having heard the Appeals Court’s ruling, families of the victims said they would meet soon to discuss whether they should appeal the ruling to the higher court.

    BANGKOK — Nearly nine years after a wealthy teen killed nine people in a car crash, victims came forward Tuesday to say they have yet to receive an apology, much less compensation.


    Orachorn “Praewa” Thephasadin Na Ayudhya was 16 when she drove her car into a Thammasat University van on Dec. 27, 2010, killing nine people. Since then, she’s become a symbol of the wealthy and powerful avoiding jail after committing serious crimes. Instead of time in prison, she was ordered to serve 138 hours of community service, which was only completed in 2016.


    Now victims are saying that they haven’t even been compensated for the death of their relatives and injuries, even though the civil case against Praewa finally ended on May 8. It also emerged that Praewa’s family identified themselves as “an esteemed family in society” in a court argument to prolong the compensation dispute.

    Ordered compensation has already been slashed by one third thanks to their lawyer's effort, who is still pushing for settlement with the victims' families, stating they will have to fight if they want the compensation ordered by the court...

    And the family had the audacity to ask the public to refrain from criticizing them, stating it's illegal too and that the family clan did a lot for the country in the past...

    Now they said they don't have the cash yet to pay the compensation, that they intend to sell a land plot worth 105 million bahts but until then ask the Justice ministry to pay first and that they'll reimburse once the plot is sold. Yeah sure, 9 years wasn't enough to sell it? Just send her to jail to see if it could speed things or seize the plot and sell it on public auction to get the 20 millions + 9 years interests at 7,5%...

    If they took responsibility then their name wouldn't be tarnished, can't eat your cake and still have it
