    British Man Says He Was Scammed for Ownership of Koh Samui Condo

    A 70-year-old British man has filed a report to the Thai Central Investigation Bureau (CIB) after he bought a 15 million baht luxury condominium on Koh Samui many years ago but still has not received legal documents confirming his ownership.

    Mr. David Edward Chappelle, 70, British national, and Mr. Pattakorn Teepbunrat, a representative of the Thailand Consumers Council, filed a joint report to the CIB on Thursday (June 1st).




    Mr. Pattarakorn said, “Mr. David first filed a complaint to the Thailand Consumers Council seven years ago in 2016. He said he bought a luxury condominium from a real estate company for 15 million baht. After that, every year he visited and stayed at the condominium three times a year. He has tried to ask for a legal possession documents from the company to show his ownership but he has always failed.”


    “In April of this year, 2023, he found out that the company did not do any registration for legal possession of the condominium for him. As a result, Mr. David does not legally own the condo he paid fifteen million baht for. We found that there are many victims making complaints about this company with similar cases, most are foreigners like Mr. David, which has cost more than 100 million baht of damages.” Mr. Pattarakorn stated.

    The CIB accepted the report and stated they would review the case. The name of the real estate company in question was withheld due to pending legal action and Thai libel laws.

    The anonymity of the fraudsters is of course preserved by the authorities so that they can remain immune to the economic consequences of their crimes, a smokescreen permitted by a combination of factors prevalent in this wretched society viz. a craven fourth estate, spurious libel laws protecting self serving interests, a prosecution system that benefits from the frauds, and of course a corrupt land office working in harmony with all the shysters in the snake pit.

    Shitty people,shitty society, shitty country.

    Phuket was built on fraud and gangsterism, Samui is no different.

    You would think someone bunging 15 million baht at complete strangers (well anyone in fact) would actually perform some due diligence rather than taking their fucking word for it that he would get the paperwork "eventually".

    I mean he filed a complaint seven years ago and he's only just finding out they didn't actually do any transfer in his name?

    If he's got no paperwork, they can probably claim he just paid the rent up front.

    On the upside, he has had 21 hotel room stays for his 15,000,000 - that's better than you get from most Thai scammers; they seem like quite a kind group of scammers...

    Why I would NEVER buy a condo here. Even if you have the paperwork, they can always find some loophole so its never really yours. Plus lets be honest, when a condo is new, they are nice, well maintained, security guards at gate. Fast forward 5 years, property looks run down, no gardeners and the security guard is long gone and the gate is wired open 24/7.

    As stated on many thai fora never buy property if you expect to own it. It should be strictly regarded as the legacy you leave your thai partner and or thai children. As many have said before, buy nothing in Thailand you cant walk away from.

    one look at the permits in the windscreens of cars parked at a condo should give you a good indication of the calibre of ownership there. look for high end german saloons and those chauffeur driven korean 8 seater family wagons, a bentley or current range rover is always a good sign too.

    vehicles with parking permits from the police, government ministries, one of the palaces, the military and bangkoks better hospitals will indicate that the owners have status and like to show off their privilege and are demanding of those lower down the social ladder, they expect that standards will be maintained and that the staff ( office, cleaners, gardeners, guards and maintenance) will be on their toes and not do anything that might call for a reprimand. a crisply uniformed guard will direct into your parking slot, there will be plenty of waiing, your shopping and suitcases will be whisked up to the unit as soon as you arrive, the corridors will be spotless, the gym will be fragrant and the pool will be leaf free. very old school, and exactly as it should be of course.

    a car park littered with steroidal pickups, 15 year old camrys, motorcycles, mangy dogs, cigarette butts, noodle carts and sleeping staff should indicate to a savvy prospective purchaser that walking away from what is obviously a poorly managed concern might be a sensible course of action.

    the above guidelines are more relevant to condos in bangkok and the coastal resort town of hua hin and the smarter areas of pattaya. property in phuket and samui is, and has always been a risky purchase.

    i dont know what the situation is in either the wastelands of isaan or in retired tefler central i.e. chiang mai. but i guess its the wives who wear the trousers up there, so there will be little choice for the falang other than to do as you're told and its a thai gaff overrun by inlaws, wildlife and cousins on a few rai. happy wife happy life eh lads?

    Condos are owned freehold, either through the permitted foreign ownership limited to 49% of the project’s units or the balance of Thai majority ownership. Purchase is by attendance at the land office of both the seller and buyer, or their proxies, and on completion of registration and payment of taxes the chanote is issued confirming the buyer’s inalienable right to the property’s title specifying it’s description, size and location - no chanote means no title. The farang owner in the OP is clearly an idiot.

    I was fully cognizant about what I was signing up for when I built our "Ponderosa". In the big picture I do not have all that much outlayed for the comfortable quality of life I am living here. I am community property owner with my wife on the house, my wife owns the land. Again. No big deal. Easy to manage.

    A condo on the other hand is a full on crap shoot. Cleary you don't own the land. You own the box. Good luck trying to sell it. Again as I have said, and I know quite a few foreigners who own condos, they looked at it like I did. However when you buy a condo the property unless HiSo Thai after a few years turns into a typical run down place. All the perks they sell to lure you in, soon diminish. My wife and I looked a 2nd residence in a condo. New place. Lots of perks. We passed. We see it now and it's exactly how I said. Run down. But it's Thailand and the MO.

    Rent is GREAT option. Set up camp on a nice spread is another knowing the REALITY and always have a Plan B.

    Freehold is freehold, you dumb lummox. The chanote not only relates to the demised unit within the condominium project but also a proportion of the land upon which it is situate.
    Furthermore, it is a freely marketable instrument and has a commercial value which can capitalised and registered by due process in any Land Office , subject of course to any lien that may be held.
    All condos are subject to management by its appointed committee and juristic person. In much the same way a landed property can range from a bothy to a mansion, so do condominiums which can be modest affairs to those held in regard which are of architectural note sited within large gardens and with direct access to an adjacent beach. I live in the latter.

    We, and our neighbours, have considerable sinking funds and operate a system of continuous maintenance which is funded by annual maintenance payments sufficient to ensure the integrity and attraction of our communal areas, our infinity 25 metre pool, and extensive tropical gardens manicured daily.

    You really are a bit stupid, aren’t you Stumpy. You strike me as typical noncommissioned officer material, very much an other ranker.

    Incidentally, we have refused one offer for our gaff but are in negotiation with another putative buyer. Now a sale is likely the wingman is having second thoughts……

    I suppose living in a condo in pattaya isnt to bad an option given the fact that westerners are very well taken care of. If your lucky you can watch turds bobbing by on cerulean seas if youre near the beach, the happy hours are great and the whores are splendid. A full english breakfast can be had for peanuts, plus there is excellent hospitals should you or your wife have prostrate problems.
