This is all over the Thai TV News. They showed the woman's funeral the other day. This kid (and his arrogant parents) just may have pissed off enough people that he might actually serve a little time for this.

    But then again, probably not.

Only poor murderers goto jail, rich ones never seem to get prosecuted in Thailand.

This guy ain't doing no time, he will not even be dumped in a mental home. Reality is he might lose his driving license and do a bit of community service to counteract the public opinion.

Pretty stupid of the Dad to be trying to take action against the public that attacked his son and the car, that takes some front considering what his son and that car did.

Pretty much the same, if the Hat Yai guy had a load of dosh it would never have got as far as going to the police station.

The daughter was talking about making a full prosecution before, and I know she'll probably end up being practical and getting that family condo paid for and a wedge of cash but if she did take it further with the full public support behind her as it is now, what's the chances the guy will be doing time either in jail or a mental home? I would guess not much of a chance once it's a processed and a few baht has changed hands, but be interesting to see if she did take it to court.

Poor girl, she probably is better just seeing how much cash she can get and move on. Never fair for the little people in this country.

^in a case like this it shouldn't be up to the daughter, even if she didn't want to prosecute, something like murder should be prosecuted by the state.

Ahh, But you are assuming Nick that the state has a responsibility to provide Justice for its citizens. That may be true in developed societies, unfortunately we live in a partially developed society, where the rule of greed overcomes the normal requirement of justice equally applied.

yeah, what is the DA doing ? sleeping ? isn't killing against the law ? don't they have prosecutors in this country ?

you know an event like that, publicitized as it is, with the full support of the public, could degenerate with the crowd in the streets and the start of a revolution opportunity by some

I was told in the news that the kid kept running the wheels when the crowd was holding his car and the victims were under his car. Then instead of shutting down the engine, he turned on the radio, kept running the aircon on high and waited like nothing happened for the police to come. Then to piss off the crowd, he kept pressing on the accelerating pad while the victims were stuck under the engine. They must have been seriously burned.

Oh, to make things worse, the traffic police guy nearby saw the whole scene, but completely ignored the situation in true Thai style. Apparently, that drew the attention of an angry crowd.

Apparently, during the interview, the arrogant father was accusing the crowd of being dishonnest and if they wanted more money, it was not a problem. That didn't go too well apparently with the TV crowd, and some journalists were angry enough to be ready to throw their mics to the fucker.

Are the Thais finally waking up ?

A quote from this mornings Bangkok Post.

Mr Kanpithak was taken to Samitivej Hospital after the incident on Wednesday, when he drove his car into a group of bus passengers after an argument with the bus driver.

His father, Mr Kan-anek, said he would put up land worth about 800,000 baht to bail out his son today instead of using the position of Mr Kanpithak's uncle, former assistant national police chief Pol Lt-Gen Ukrit Patchimsawat, as earlier planned.

Three victims remain in hospital with serious injuries. One of them is Saengmanee Imsodari, a manager at the Nam Song Hotel in Laos. Her French employer has filed separate criminal and civil charges against Mr Kanpithak.

Doctors said Mrs Saengmanee was on a respirator and severe injuries to her pelvis meant she would not walk normally again.
A top police official said police would take a month to wrap up the charges and then seek prosecution.
You can bet if if it was me or Somchai the tuk tuk driver, they wouldn't be waiting a month to "wrap up the charges".
We wouldn't be biding our time in a Samitivej hospital suite waiting for the furor to die down. They would be able to bang us straight up, with charges laid in 20 mins.

Samut Prakan Mum faints at daughter's funeral

ROAD RAGE VICTIM / MESSAGES OF CONDOLENCE
    Mum faints at daughter's funeral

    SUTHIWIT CHAYUTWORAKAN

Samut Prakan _ The 68-year-old mother of the woman killed when a man drove his car into a crowd at a bus stop fainted at her daughter's funeral yesterday after hearing a message of condolence from the driver, read to her by his mother.

Thongkham Luangsaeng was rushed to hospital after hearing the message from Kanpithak Patchimsawat, 20, who yesterday denied police charges of premeditated murder, attempted murder and physical assault.

Hundreds of mourners packed Thong Khong temple to bid a final farewell to Saichon, a 42-year-old financial officer with the Bangkok Mass Transit Authority. Mr Kanpithak's mother and former Miss Thailand, Mrs Sawinee, arrived with the note and a garland to express her sorrow.

Mrs Sawinee refused to disclose the content of the note and said her son was not mentally or physically capable of attending the funeral.

She said Mr Kanpithak was very stressed and his condition had worsened. She placed sandalwood flowers at the casket and left before the cremation.

In Thai law, is the offer of personal damages a mitigant to criminal charges?

I realise it is a remedy for a civil suit elsewhere, but criminal charges are penalised differently. (eg by jail or a criminal fine)

    Sorry to get technical.

^ Question already raised before, but apparently, no DA or prosecutor have any balls to file suit against a HiSo

The mentality of all Asians is

"I have been harmed, I must be compensated financially (by someone)."

Even with this car-squashing, $$ are at the forefront of the victims thoughts.

I suppose its an American mentality too, but its not a European one. We Europeans mainly like to see culprits being put in jail/ balls cut off/burned at stake.

The problem is that with a financial settlement the Police get a substantial cut, if its just a plain simple prosectution they get nothing unless the person has real money to bribe his way out.

Paris Hilton goes free, Teddy Kennedy goes drunk driving kills some girl walks away from here not knowing if she's dead or not. He's now a senator. Could take more time. Present more shit. This happened in any other fucking country to people of similar stature, the case would not be all that different. Maybe cost him more. But he'd be in a a hospital, being found absolutely, but temporarily, nuts.

Doesn't make it right, or any more acceptable. Fact of the matter is, whatever fuckin country you're in; money and connections will get you over, where other mother-fuckers wold be locked-up, sentenced and toasted.

Paris did serve some time and probably got a harder deal for a minor infraction than the average punter. While Teddy's was a serious case still wasn't outright murder and it was 40 years ago. The worlds moved on a since then.
I very much doubt if Teddy would be able to get away with that stunt nowdays.

might be true, Might not. These were two cases that popped into mind. This guy isn;t going scott free. But he's in a hospital he'll get lawyered up real good, pay off families, do some time in mental hospital. DO you really believe the same shit doesn't happen in the West?
