A team of lawyers has been sent to help the two migrant Myanmar workers being charged with murdering two British tourists and raping one of them on Koh Tao, a prominent activist for the rights of migrant workers said yesterday.
The move came amid concerns that the arrested men may not be the real culprits.
Andy Hall, the activist for the rights of migrant workers in Thailand, tweeted yesterday that he was sending a team of lawyers to see the two Myanmar workers charged.
"We are sending the legal team [and] seek to gain access to the accused, to advise them on their rights under Thai law, and provide reliable translation," he said.
Hall pointed out that the desire to get involved stemmed from reports of physical abuse although the activist acknowledged that he had no evidence of physical abuse against the two men charged, nor was there evidence to prove a claim that the police DNA tests were inaccurate.
Thawisak Inphrom, the chief of Koh Pha-ngan district, of which Koh Tao is part, said that tourism on Koh Tao has become "busy again" following the arrests.
"Tourists now have become more confident about safety on the island, and they are confident the authorities can provide safety for them," he said.
Surat Thani Governor Chatpong Chatrapoot said the arrest of the suspects had helped restore confidence among prospective tourists to Koh Tao.
The governor said he has instructed the local authorities to provide safety to tourists "in an integrated way", with increase in the number of security officials, security cameras and lights in areas deemed risky. He said there would be increased safety for tourists with those "integrated measures".
Local residents and business operators on Koh Tao yesterday also expressed their hope that the arrest of suspects in the murder case would restore tourist confidence on the island and improve its tourism sector.

All the talk about bringing in lawyers is great, but once the DNA has been deliberately mislabeled and it's source lied about, it becomes one of those "the cop is lying" defenses, and that's about as desperate as a defendant can get. DNA is great in that it's infallible when used by truthful and honest investigators who have no agenda, but it's deadly to defendants in that it can be so easily planted or misused by dishonest cops or those with an agenda.

Koh Tao Murders: Thai Authorities Deny 'Scapegoat' Allegation
BANGKOK — Thai authorities are insisting that they have not pinned the murder of two British backpackers on "scapegoats" in an effort to wrap up the controversial investigation.
This week, police arrested two Burmese migrant workers and paraded them in public as the culprits behind the gruesome murder of David Miller, 24, and Hannah Witheridge, 23, on Koh Tao island last month.
Thai police have been under immense pressure to solve the killing of the two British backpackers, with authorities worried that the grisly murder could further damage the country’s ailing tourist industry.
According to police, the Burmese workers confessed to sexually assaulting Witheridge and murdering her and Miller on 15 September. Police also insist that their confession is backed by DNA tests and CCTV footage in the area.
"Don't say they are scapegoats,” said deputy Prime Minister and Minister of Defence Gen. Prawit Wongsuwan when a reporter asked whether he was confident that the Burmese suspects were not being framed.
“The police are doing their job. If the police hear your accusation, they will be sad," Gen. Prawit said.

Myanmar murder suspects escorted to Samui court for extended detention
Two Myanmar rape murder suspects were this morning escorted by the police from Phangan island to Samui island for permission from the court to detain them 12 more days for further questioning.
Win or Wepew, 21, and Cholin or Soren, 21, both of Arakanese ethnics, were handcuffed and taken on board a speed boat from Phangan island to Koh Samui under protection by about 10 police, both in uniforms and plainclothes.
The travel to Ban Nathon pier on Samui took three hours. Both were later put in car to the Samui provincial court.
The police sought 12 days from the court to further detain the two suspects with reason that the 48 hours allowed by law to detain them has expired while they still needed more time for questioning.
The police said they would officially indict the two suspects on October 8.
The two suspects were seen to be very exhausted as they have been questioned throughout the night.
While at Samui police station, Win, a prime suspect, who spoke little Thai as he has been working on Koh Tao for three years, admitted to the murder of David miller and raping and killing of Ms Hannah Witheridge.
Another suspect, Mao, was not escorted to the court today as the police have booked him as the witness to the case.
Mao was playing guitar with the two suspects but left to see his girlfriend before the murder took place.
Earlier he was also charged, but after the two confirmed he was not involved, and DNA test did not match the samples collected on the victim’s body, the police freed him but still kept him as witness.

It takes a unique kind of individual to be capable of killing a woman (in said manner)
while she is lying prone on the ground.
To my simple mind, the injuries sustained (especially by the female) suggest a rage and malice, normally attributed to a retribution attack - following a heated argument/altercation. Hence my conviction that this 'attack' was not random chance
my mind goes back to the incident in the bar.
Of course, I am no Sherlock Holmes, just one man's view. I don't close my mind to the possibility that it was them, just seems very unlikely to me.

Before this, the DNA test result of the foreign tourist took 3-4 days. Is this discrimination?”
The director of the Cross Cultural Foundation (CrCF) also said that now everyone is just more worried about the decrease in tourism than creating transparency justice system. The British Embassy and the legal representative of the victim are following the case closely. This might effect on the reliability of the justice system in Thailand.

A British backpacker is in hiding after naming the alleged killer of David Miller and Hannah Witheridge in Thailand.
Sean McAnna, a friend of Mr Miller, claimed in a Facebook posting which has since been deleted, that the owner of a bar on the island of Koh Tao was responsible.
The 26-year-old, from Lanark, also uploaded photos of two men who approached him in a bar after claiming the Thai mafia were trying to kill him.
‘They said to me “it was you who killed them, we know it was you”…I think they needed a scapegoat,’ he told a newspaper.
‘They said “you’re going to hang yourself tonight, we’re going to watch you hang”, so I just ran.’
He fled to a 24-hour store and has since left the island by ferry.

In an earlier tribute to Mr Miller, he posted: ‘I loved you so f****** much brother. I know you tried to save her. You are the most honourable guy I’ve ever met.’
Other ex-pats have said much of the island is in the control ‘of locally powerful mafia-like families’.
The badly beaten bodies of Miss Witheridge, 23, from Great Yarmouth, and Mr Miller, 24, from Jersey, were found on a beach on Monday last week.
Police are reportedly ready to DNA test every man on the island.
They are waiting on the results of tests on a 28-year-old speedboat driver arrested on drugs charges. Locals reported he had been acting in a ‘crazy manner’.

and hit the locals where it hurts as in the wallet,but most are only thinking of the next party i think.

He had been working illegally, and alleged to have been a dope peddler for the tourist hoards, likely flogging it for the "mafia", and with a child pornography conviction in his background.
He played guitar too; and there were reports of him having blood cleaned off his person etc.......he definitely needs attention to maybe establish a few things. He may be clean and completely legitimate in this case, but his overall profile is not exactly a defence lawyers dream witness.....
if the generals that run this country think for one moment that just because they have orchestrated a patsy conviction so things can get back to normal again quickly, in that peculiarly Thai way where they ignore reality, then they are in for a bit of an awakening.
The bogus arrests and equally fraudulent prosecution currently under way has made things that much worse but the generals are arrogant and not a little stupid. They may have suckered a dozy British ambassador into subscribing to this disgraceful farrago of deceit but no one else with a functioning brain the world over is buying it.
Thai generals are weird like that. They don't think like normal people. The British ambassador is of course plainly ill or gone troppo - perhaps he will do a Quinton Quayle after this?
They may as well re-name the island, Killer Koh Tao.
