    Victim in bad accident and what will happen?

    I apologize if I placed this thread wrong.

    Me is living in phuket even if that matter just in a few parts of this whole but sat that now so you know

    Have to ask for a little advice and what laws andgenetic such as for down here and if it becomes necessary like suggestions for a good lawyer who can bring my action in this matter.

    The fact is that I ran into a really bad accident on my motorcycle to a car driven by a very large Time share companies down here a while ago and now I'm out from hospital. I will not mention the company by name, but you can probably figure out for yourself what it is.

    I need not go into describing what happened at this time but can only say that over 30 witnesses and the police service have put all the blame on the car driver.
    I was inside the hospital for 19 days and has months of rehab to come for me to go in over time. The company implemented insurance companies paid my ill stay but this was not something that they offered but it was the relatives and friends of mine who forced this.


    But now we come to my thoughts.

    As I understand it, the more the party of all insurance down here a ceiling limit a limit on how much it can pay in individual cases. But then I wonder if the cases be counted as a total or count such as health care, things, financial loss, etc. separt or counted everything in a lump sum? If it were true that the insurance itself really only going to barely cover my hospital expenses how can I then went on to receive compensation for all full?

    Really now steaming my injury, burning pain, trauma, motorcycle injuries, lost wages and whatever else I can ask for this. Should I start a civil case against the driver or company? If so how will all costs be covered?

    Or should I go directly to the company the driver works for and demand out of them straight off? I do not think the company itself would like their names to be drawn into an accident (murder attempts, I have heard that the police themselves would take out the case that) which employs the driver, on duty, driving a company car and everything is intoxicated. Think maybe you can settle a compensation quickly this way?

    If it were true that I have to hire a lawyer to help me in this mess who is it who must pay for this? For a legal aid is not well here for a farang `? Will it be me in person or insurance company, or how does it work?
    If I would have to hire a lawyer, there is no good as the rest of you here really would strongly recommend to me?

    But all the other suggestions, sides and forums that may be helpful for me are greatly appreciated!

    The time now is late to finish this part, but hoping for answers and lots of advice and suggestions of you in this case!

    I agree with Harry, You need to seek legal help from a lawyer or maybe a embassy/consulate official in your native language would be able to point you in the right direction (or at least advise a trusted law office).

    Lawyers are only interested in settlements, i would tally up the bill to what you feel you should be compensated come to an amount that is fair and one that you woud be happy enough with but also an amount that the company can reasonably pay with out too much problem. Go to them directly talk to whoever is in charge and give them this one time offer tell them if lawyers get involved it will cost them much more time and money. This is what i would honestly do if it does not work out you get a lawyer witch it sounds like you want to do anyways, and if they are reasonable then you get your compensation and saved yourself a lot of time and perhaps upfront lawyer fees. So I see it as nothing to loose by trying to handle this yourself... But that is me others may have a much different opinion... Best of luck don't look at this as a way to squeeze money just ask for fair compensation with some room to negotiate....

    Today me actually contacted the English fillial of the insurance company, Its a world wide insurance company so this helping me out big time... The companny is QBE if anyone maybe have something to say about em?

    But today I have get all inurance policys mailed, get to know what Thai fillial already have done wrong in my case osv osv and that really i helping both me and lawyer out!

    But will let you know what happens in this mess!

    I'd have a lawyer involved personally- a proper guy, not a monkey, for a start the time share companies are in breach of all sorts of Thai laws, and just the threat of legal proceedings should make them want to expedite a settlement. If it's the timeshare company I'm thinking of, the principal and his top leutenant(s) are certainly not lacking in money or assets, plus their vested interests in Thailand are certainly not something they would like analysed in open court. QBE are quite solid themselves, so things should go pretty smoothly.
