    Renting Government Land -Ratchadapasook

    My house is built on this kind of land rented from the government(Ratchadapasook). I'm getting divorced and want the lease transferred to my name as part of the settlement. At first the office said yes, foreigners can rent the land, but when all the paperwork went upstairs to be signed by the boss i was told that he would have to check with Bangkok to see if it was allowed.

    I had a lawyer present and he asked to see the regulations and they do not say anything about foreigners being prohibited from doing this. It is renting, not ownership. I am awaiting an answer from the office.

    My lawyer is looking into this for me , but I wondered if anyone knows anything about this. The lawyer said that if they say no, I may have a case to go to the administrative court. It could also be that the boss just wants a kickback, but I'm not sure

    Any info anyone has would be appreciated. Thanks.

    Hi LC - It used to be the case that there is nothing stoping a foreigner leasing government/Crown land in Thailand. Most of the land opposite the race-couse in Silom and around Chula is on these terms. However, the lease term is much shorter than the 30 years for other land. I think it might be 20 years (but could be less) and you cannot have a renewal clause.

    Generally though, should be possible, unless things have changed

    If it is Crown Property you can lease it.
