    What can i do about defamation by an admin on a forum?

    Hello teak door

    The admin of a forum, not this one of course, has posted some very unpleasant defamatory allegations about me last week on his forum as a smear against me because i am dating his ex girlfriend, which included my full name address and work place, and keeps bumping it so that it now appears the top page of google. He also sent a link to the HR office at my work place. I don't know what to do about it, but I'm sure that this is illegal. Can anyone tell me what I can do about it or how to find out who hosts that forum?

    You can find out what country etc here, different countries have different or non exsistent laws though.

    Identifying who hosts a domain There are a few basic steps to identifying the hosting company for a domain.

    1. Obtain the Whois information for the domain using sites like http://whois.sc.
    Sometimes the hosting company's name will be under the technical contact.
    2. From the Whois information, you can obtain the base domain name for the
    name servers. Simply run this through the whois process again and see who
    is the registrant and/or contact information.
    3. It this still does not give you a good lead, you can gather more information
    from who the IP is assigned to. To do this, you'll need to get the IP of the
    domain. This can be done using the website at DNSstuff.
    4. Once you have the IP, you can find who it is responsible for it by using
    whois.sc. Simply place the IP in the search field instead of a domain. The
    information from whois.sc should be for the company who is hosting the
    domain.

    Or ask her where he live and visit him, talk to him...

    If in the UK, there are have been a number of successful lawsuits against individual posters, as in it is not the forum in the dock, just the person who made the comments/posts, so it is basically impossible to advise the OP without knowing what country both him and the person who has made the comments are in, as all countries have different laws, some a lot more easy to enforce that others.

    Also depends on what was actually said, as if it's a criminal matter as opposed to civil, say for example if someone made repeated threats to stab you then it won't cost you a penny, just a bit of your time making a statement to the police then up to them how they proceed and if they decide to charge someone or not.

    if you are boinking his ex then it sounds like you could easily find out where he lives.

    go sort things out in a "gentlemanly manner" as most men would do, and if he is twice your size, then just use the wheelspanner or jack from your car to persuade him to back off.

    Very odd OP indeed. As TD is a thai based forum are you referring to another thai based forum and asking for advice on thai internet laws ? Can't be ThaiVisa as you say ex girlfriend not boyfriend.

    Firstly, if your private details are appearing on the forum, then should you not ask the Admin/mods to delete them ?

    As far as defamation of character is concerned, it depends on what has been said.

    One thing for sure, is that if he has made a threat and you consider reporting it to the police, you should do it straight away. If you leave it for weeks, the Police will ask you why you waited so long before reporting it and if anything has happened in between to make you feel afraid.

    As far as civil case, not a dogs chance in hell. Since whoever it is uses a forum name other than his own, then investigations would have to through that forum and their server to see whether they would release the IP address. Then it is up to the provider as to whether they would release the account address of that person unless ordered by the courts. Plus it could cost a lot of money to take forward a civil case, and if you lost, you would have to pay all costs, thats their defense and your prosecution. I would try and get your address etc removed by the forum.

    The guy is obviously jealous that you are pumping his GF, maybe understandable and just wants to hurt or upset you. Let it go, it will die down eventually or as previously said, you could imasculate him in public by mentioning his lack of bedroom skills.

    Better to give him a taste of his own Meds and face him off on the forum, and I certainly would not post that you are considering legal proceedings as it may make you look a pussy, and he would probably capitalise on it.

    The first internet libel case was Godfrey v Demon Internet in 1999. The case never went to court as Demon agreed to pay Godfrey £15,000 in damages. They also agreed to pay both side's costs which were estimated at £500,000.

    Absolutely not. The OP never said what forum it was, but was not PL for sure. Such a thing would never be tolerated

    Laurence Godfrey, a physics lecturer, learned that someone had posted a message to the Usenet discussion group soc.culture.thai. That message, sent by an unknown source, had been forged to appear to have been sent by Dr. Godfrey. On January 17, 1997, Godfrey contacted Demon Internet, one of the major Internet Service Providers in the Great Britain to inform them of the forged message and ask that it be deleted from Demon Internet's Usenet news server. Demon Internet declined to remove the message, which remained on its servers for ten additional days, at which time it was automatically deleted along with all other old messages. Godfrey sued for libel, citing Demon's failure to remove the forged message at the time of his initial complaint.

    So if you are gonna sue, its a good idea to go where the money is.

    Just read the OP again, and he says that the Admin of a forum has published personal info. I wonder what forum that is, I haven't seen it. Doesnt look as if its any of the major ones, maybe he should sue the forum then,

    First thing he has to do is a cease and desist email, most sites take down the stuff as soon as a request comes in.
