    WHO to believe. Immigration or Amphur. Parental Consent to Travel.

    Another example of contradicting Thai Government Departments.

    To take a half falang child out of Thailand it makes sense that if he/she is travelling with one parent then the accompanying parent would need permission from the non-accompanying parent. Its an international standard.

    THE AMPHUR says:
    You cannot take a minor out of Thailand without the official permission slip which has been stamped and sighted here in the Amphur.

    THE IMMIGRATION POLICE at the airport says:
    You just need to bring the child's birth certificate and a hand written note from the non-accompanying parent to say that permission to travel has been granted.

    Of course i believe the Immigration police over the Amphur, because they are dealing with these things everyday.

    What I have learned though, is that the "Consent to Travel Form" from the Amphur, IS required when one would be APPLYING for a VISA for a child to go to another country (out of Thailand), as most foreign embassy's request this form to be submitted for Thai citizens under 20 when are applying for a visa.

    ie if a man had a Thai GF and he wanted to take her son (his step son, a Thai citizen) to say UK then he would need to get this Parental consent form filled at the AMPHUR to be submitted at the British embassy as proof of consent to travel.

    What I have learned also from reading countless stories of people travelling OUT of Thailand with their half-thai child is that a simple hand written note and a copy of the birth certificate are sufficient.

    I THINK the AMPHUR is confused about their roles and powers and the actual use of the "Parental Consent Form" or that the immigration laws dont actually require this to travel as there are no Parental Abduction laws and Thailand has NOT signed the Hauge treaty for Family LAW.

    OR the Amphurs are trying to Monopolize so that if every child leaving Thailand needed a "Parental Consent Form" they would get extra revenue... 50 baht a pop, etc.

    OR the official form is required by the Immigration but they are slow to adjust to new laws and from what I can see it will be years before they actually start to crack down on people etc.

    DOES anyone have any RECENT experiance with this, IE in the last six months?

    I found the Immigration police at the airport to be straightforward and knowledgeable and were able to answer all my questions easily and without hesitation. THEY seemed to be in the know.

    I found the visit to the Amphur pointless and embarrassing again, being made into the sideshow farang who was of course wrong, although they were shocked, YES, SHOCKED and could not believe that a THAI born child could have a passport from another country?
    DUAL citizenship?
    What is that?
    How did you get him an Australian Passport they asked?
    Again no, they told me a Thai born Australian Citizen cannot leave the country without this Official Amphur form...
    What i said: will you force an Australian citizen to stay in Thailand?
    Would they detain my son and I and put us in what jail?
    Or do they confiscate children and send them where?

    Though i didn't mention to the people in the Amphur what the Immigration Police at the airport said, i kept the satisfaction to myself.

    So.... Official Amphur form or Hand written note (maybe notorized)?
    I almost feel like a poll would be good.

    MY daughter is Half Thai/half American. Holds both Thai and US passports.

    Since she was 3 years old we have traveled sometimes with her mom (till she was 5 when her mom took off) most times without to Europe/the States, Bali, Nepal, Singapore. and never had anything other than her passport an never asked, This is flying out of Phuket, Bangkok and land borders to Cambodia and Malaysia.

    She also started flying alone when she was 12. First trip alone was to the states departing from Phuket. Last trip out was this last August to Laos, Cambodia and the states.

    as to this;

    No idea as holding a US passport she never needed to apply for visas in advance for anywhere we went.
    Uses her thai passport for Laos and Cambodia & Thailand ONLY as they get in visa free

    Seems alot might depend on if the child's passport is the same last name as yours. I cant see any Farang, ( no one i know here in Phuket that has a chlild only has the Thai passport) that has a child not getting her/him a passport for their country so don't know why they would only have a thai passport

    so they only ever asked for the passport? not a letter of permission?

    I know of an English guy, 2 years ago, that had a bust up with his missus and he took the child to the UK. Not a problem as far as I'm aware.
    I'd imagine if the child leaves on a farang passport there's naff all they can do as the child isn't officially Thai. Now it may be a different story if they leave on a Thai passport.
    Thailand is not a signatory to the Hague Convension regarding taking children across borders without permission. Or something to that effect.

    As I said, just the passport no matter where we, or she alone, was going

    as to the above, ( superman) she is Thai and ( and American) ALWAYS left Thailand on her thai passport, Only time they ask for her US passport is when she checks in for her flight, Immigration ONlY sees the thai passport she uses to enter Thailand.

    so you got your child an aussie passport due to right of birth. suggest a call to ausssie embassy about child leaving thailand just to cover your arse my stepdaughter had to have permission paper for her visa for aust even though her dad is dead. wife had to do the permission thing

    This must have ruined millions of vacations and made a lot of money for lawyers filing for court hearings when the non-custodial parent arbitrarily or vindictively refuses to sign.

    I've seen people turned away at the airport during check-in for exactly this reason.

    At least at home if the other parent refuses to sign without a good reason, the family law court can and will make an order permitting travel over the other parent's spiteful objection, and the only winners are the lawyers.

    There seems to be some confusing regarding the original question

    If the child is your natural child ( ie ur name is on the birth certificate, and same last name on the passports , of which they should hold two if ur not thai)
    there is no trouble taking the child out an no paperwork has ever been asked for. I and all of my friends under similar circumstances have never had problems taking our kids overseas and this is going back 20++ years. Note all our my friends are the natural fathers.

    IF on the other hand its not ur real kid but step child and he/she does not have 2 passports but only the thai passport and it not in your last name and u need obtain visas for western countries, things might be different.

    Corvette lover is combining the two, (if its the stepdaughter than i assume she does not have another passport other than the thai one an the name is not the same as yours on it)

    my wife usually travels with our daughter to the UK without me

    she enters and leaves Thailand on her Thai passport

    she checks into her flight on her UK passport

    There has never been any question of me needing to give consent

    the same goes when they travel to any other country out of the UK

    there is some confusion somewhere!

    Does anyone have any more info about this?

    I've going to the UK with my 13 year old daughter soon and would like to know if any consent letter is required.
