    Au cours de sa session spéciale sur l'immigration, le Conseil national, malgré un préavis négatif du Conseil fédéral, vient d'accepter une motion du Conseiller national Oskar Freysinger intitulée "Bas les masques!", qui exige des citoyens qu'ils se présentent à visage découvert dans certaines situations-clé comme devant un fonctionnaire pour un acte officiel, lors d'un contrôle d'identité, dans les transports publics ou encore lors de manifestations (à la notable exception de cortèges de carnaval).

    Cette intervention propose d'introduire dans la constitution fédérale une disposition ainsi libellée :

    1 Quiconque s'adresse à une autorité fédérale, cantonale ou communale dans l'exercice de la fonction de celle-ci, est tenu de se présenter à visage découvert.

    2 L'utilisation des transports publics est interdite aux personnes dont le visage est masqué. Les autorités peuvent en outre interdire ou restreindre l'accès aux bâtiments publics à de telles personnes lorsque cette mesure paraît propre à garantir la sécurité des autres utilisateurs.

    3 La participation à une manifestation sur le domaine public est interdite aux personnes dont le visage est masqué. Les cantons et les communes peuvent toutefois prévoir des exceptions pour les festivités ou célébrations comportant généralement l'usage de masques ou autres accessoires similaires.

    L'intérêt de cette motion est de proposer, plutôt que l'interdiction générale d'effets de vêtements tels que la burqa, un catalogue de situations précises dans lesquelles on demande ni plus ni moins que de traiter tous les citoyens de manière égale quelle que soit leur origine, leur culture, leur religion ou encore leur classe sociale. Elle n'a donc rien de stigmatisant ni de discriminatoire. De plus - ce n'est pas le moindre de ses mérites - son application au quotidien ne soulève aucune difficulté pratique.
    Translation:

    During its special session on immigration, the National Council, despite a negative notice of the Federal Council has accepted a motion of the National Oskar Freysinger called "the mask off!" Which requires citizens to be presented openly in some situations as having a key official for an official act, during an identity check, on public transport or at events (with the notable exception of carnival processions).

    This action proposes to introduce in the Federal Constitution a provision reads:

    1. A person who is for a federal, cantonal or communal in the exercise of the function of it is required to report openly.

    2. The use of public transport is forbidden for people whose face is hidden. The authorities may also prohibit or restrict access to public buildings for such persons where this seems appropriate to ensure the safety of other users.

    3. Participation in a demonstration on public property is prohibited to persons whose face is hidden. The cantons and municipalities, however, may make exceptions for the festivities and celebrations usually include the use of masks or other similar accessories.

    The advantage of this motion is to propose, rather than the general prohibition of effects such as clothing burqa, a catalog of specific situations in which we ask nothing less than to treat all citizens equally regardless their origin, culture, religion or social class. It has nothing to stigmatize or discriminate. Also - this is not the least of its merits - its application in everyday practice without any difficulty.
    I don't see nothing offending the muslims. They are still allowed to practice islam, go to the mosque and wear like they want.
