There's more to the story than meets they eye. The deceased was a friend of one of his friends and the deceased apaprently tagged along. Although he is charged with "selling alcohol to a minor" that is a misreport as he is not alleged to have sold, but enabled the serving of alcohol at his premises. He will be able to mount a strong defense because;
1. He was not operating a commercial enterprise
2. He was acting on the premise that because his friends were all over 21 and this person was their friend, it would have been reasonable to believe that she too was 21+
3. It was indeed an accident.
The funny part of this story is that Illan was a conservative and is reported to have led a campaign at SUNY to take on the lefties on campus. I have a feeling this is going to get hushed up fast.

The luxury high-rise where the beautiful daughter of a U.S. diplomat plunged to her death is known for wild parties that attract young revelers - and has also been the site of previous tragedies, its residents said.
Nicole John, 17, kicked off her shoes, turned her back on the wild party behind her and took a boozed-up step onto the ledge of a 25th-floor window when she lost her balance and then her life early Friday morning.
The debauchery in the Herald Towers apartment was not an uncommon scene in the W. 34th St. building, said neighbors who have long worried about such an accident.
"Something like this was bound to happen," said resident Kristen Donovan, who described seeing residents and guests having sex in the stairwells.
"It's disgusting but it happens overnight and security doesn't stop it. ... It's an out of control atmosphere."
Tenant Alex Mena said she often spots youngsters sitting precariously in their windows.
"It's so dangerous," said Mena, 39. "If you're drinking and lose your balance, it's so easy to fall."
John died after attending an alcohol-fueled party at the apartment of 25-year-old Ilan Nassimi, who was charged with handing out booze to minors. Neighbors said he frequently brought groups back from clubs for after-parties.
John's death was ruled an accident after an autopsy by the city medical examiner Saturday.
The cause of death was determined to be blunt force trauma caused by a fall but the toxicology report won't be completed for several weeks, according to officials.
Sources said the Manhattan district attorney's office is probing the circumstances of John's death, including the time she spent at the Tenjune nightclub before her tragic fall.
John's father Eric, the U.S. ambassador to Thailand, and other relatives were descending on New York last night to claim the pretty teen's broken body. "We have a big family scattered all over the place," said Betsy Jennings, the victim's aunt, from her home in Kentucky. "We are all coming together."
A digital camera was found next to the teen's body, leading investigators to believe John - who was about to start her freshman year at Parsons The New School for Design - stepped on the ledge to take pictures. She kept an online diary displaying her photos - and revealing her fondness for vodka and Xanax - but that website was disabled Saturday.
Nassimi's apartment windows did not appear to violate any regulations, officials said.
The building is no stranger to death: In 1998, lawyer Joseph Levine leaped from the 17th floor and slammed into a newsstand on the street below. Four years later, Katarina Kaurate - the sister of model Eliza Kaurate - was found lifeless on an 11th-floor scaffolding.
The Herald Towers management company did not return calls Saturday.

NEW YORK — Prosecutors dropped charges Tuesday against a man accused of allowing underage drinking at a high-rise apartment where a former U.S. ambassador's teenage daughter fell to her death.
Nicole John, 17, apparently drank before getting to Ilan Nassimi's apartment Aug. 27, Manhattan prosecutors said. While there, John, whose father was then ambassador to Thailand, plummeted 22 stories after going out on a window ledge, police said.
"The dismissal confirmed exactly what we had been saying all along," said Nassimi's lawyer, Evan L. Lipton. "They never had any evidence that she had been drinking in his apartment."
Nassimi, who is in his 20s, faced charges of unlawful dealing with a minor and procuring alcohol for an underage person.
Nassimi, who runs an Internet business and works in real estate, met John at the trendy Manhattan club Tenjune that evening and invited her to an afterparty at his 25th-floor apartment near the Empire State Building, Lipton said. Police believe about a dozen people were at Nassimi's apartment and were drinking.
Around 4 a.m., John slipped off her shoes, stepped out onto a window ledge with a camera and tumbled to a third-floor ledge, police said. The camera was found with her body, but it wasn't clear whether she had gone out onto the ledge to take a photo.
John was an incoming freshman at Parsons The New School for Design. Her father, Eric John, had been appointed U.S. ambassador to Thailand in 2007. The State Department said Tuesday that he has since moved on, but did not immediately know where he currently was.
