Mum 'Suffocated Her Kids With Plastic Bag'

A British mother admitted killing her two young children by suffocating

them with a plastic bag in a Spanish hotel, a court has heard.

Lianne Smith, 43, is currently being held in a Girona jail to await trial over the deaths, following the hearing in Blanes, on the Costa Brava, earlier.
Rebecca, five, and her 11-month-old brother Daniel were found dead at the Hotel Miramar, in the seaside resort of Lloret de Mar, on Tuesday.
The children died after Smith's partner Martin Smith, 45, was extradited to Britain to face child sex charges.

Reports in Spain suggested the siblings were killed on Monday and that their mother - now charged with murder - spent the night in the hotel room with their bodies.
Lianne Smith, who is believed to have run a nursery in Barcelona, was worried the Spanish authorities would take her children away and she had planned to kill herself, reports in Spain said.

But it was suggested she could not face being parted from the youngsters.
A court statement issued later referred to Smith's suspicion that social services would remove her children.
The statement continued: "Smith spontaneously declared that she had killed her two children." It said Smith had suffocated her children with a plastic bag.
After the hearing, the former manager at Cumbria County Council's children's services department was seen looking tired and drawn as she was led into prison in Girona.
The events unfolded just two days after her partner and father of the children appeared before Carlisle magistrates charged with 13 sexual offences and jumping bail.

    Martin and Lianne Smith

Martin Smith, originally from North Shields, was one of Britain's most wanted men until his arrest by Spanish police earlier this month.
At the time, he was suspected of a series of child sex crimes, including rape, gross indecency, indecent assault and attempted rape.
Post-mortem examinations have been carried out on the siblings, but the results have not been made public.

^^ no they have become civilized recently. They think that the state should not become a murder. Taking a possible danger out of society is the task of the state not retaliation ( eye for a eye etc ). Middle ages are over so nobody gets cooked alive lol.

It is just a fact that there are sick people and there is not much to prevent it. crazy bitch lol

The death penalty was briefly banned by the Second Republic from 1932 to 1934, when it was reintroduced for terrorism and banditry. Franco re-established fully as part of the penal code in 1938, not that this stopped it from executing tens of thousands beforehand.

Spain does NOT have the death penalty. No member of the European Union has the death penalty. If they did then they would not be members of the European Union. Abolition of the death penalty is a fundamental requirement for membership of the EU, there are no exceptions. The European Treaty of Human rights is Law throughout the European Union and, among other things, it specifically outlaws the death penalty.

Europe (not only the EU) has 50 nations. Of those 50 only 2 have the death penalty, Latvia for crimes during wartime and Belarus because it's a dictatorship run by savages.

It is explainable, but I doubt anyone needs to know why she did it.

That she did it is all that counts.

    She is not well.

From GARY O’ SHEA in Blanes
    Published: 22 May 2010

KILLER mother Lianne Smith slept in the same bed as her kids after suffocating them, it emerged last night.

The 43-year-old killed Rebecca, five, and 11-month-old Daniel on Monday night at a Spanish hotel - then raised the alarm at 2pm on Tuesday, according to reports.
Yesterday the Brit was remanded to prison after a judge ruled she was SANE and aware of her actions.
Court documents revealed she had made THREE confessions to murdering her children.
One was to a doctor after her arrest.
Another was to detectives and the third was in a note left in her Costa Brava hotel room in Lloret de Mar after a failed suicide bid.
It said: "I hope you can forgive me."
Judge Rafael Fernandez Santiago quizzed Lianne in a six-hour hearing behind closed doors at Blanes on the Costa Brava yesterday.

He said a doctor "concluded Mrs Smith was conscious, fully orientated and understood the situation". He added her statements were "coherent and display very little contradiction".
He revealed Lianne had been asked if she wanted to be present while the kids' bodies were removed from the hotel - but declined "because she had already said goodbye to her children".
Judge Santiago said: "Mrs Smith spontaneously said she had killed her two children."
He added: "The detainee's statement in the judicial headquarters ratifies the one she made earlier, she confesses to killing her two children. It also describes in details the perpetration of the crime. The suspect acted alone."
The judge added he was remanding her in custody because there was a risk she would vanish if granted bail.
    Paedo suspect ... Martin Smith

She has not been formally charged in line with Spanish law. Formal charges are made shortly before a trial.
A court statement released along with the written remand ruling said: "The judge at court No3 in Blanes has remanded Lianne Angela Smith in jail and not a psychiatric unit for two crimes of murder."
The papers confirmed Lianne had feared Rebecca and Daniel would be seized by authorities after the arrest of their paedo suspect dad Martin Smith, 45, at the family's flat in Barcelona.
The judge confirmed the children had been suffocated with a plastic bag.
Reports said Lianne slept with the kids before cutting her wrists and then asking hotel reception staff to call police and an ambulance.
Lianne was last night moved to a mixed prison in Girona, 60 miles north of Barcelona.
Held ... Lianne Smith is led away

She is thought to be in isolation over fears of attacks from inmates.

The mum has been on suicide watch after telling police: "I want to join my children on the other side."
Martin Smith vanished from the UK in December 2007 where he was awaiting trial on 13 charges of abusing a girl under 16 between 1995-2005.

Then last month, Lianne reported a burglary at their apartment in Barcelona. Investigating officers rumbled Martin, named last year as one of Britain's most wanted fugitives in Spain.
They shadowed the ex-TV psychic while British police prepared legal paperwork. Then on May 7 they swooped - sending him back to Britain on Wednesday under fast-track extradition procedures.
Martin, originally from North Shields, and Lianne, from Wallsend, North Tyneside, are not married but share the same surname.

The pair ran an unlicensed B&B from their three-bed Barcelona flat.

Previously Lianne ran a nursery school for ex-pat kids in the city, which opened in October 2008.

One mum who knew the couple said: "I thought they were very religious, Jehovah's Witnesses or Mormons, because they were such an odd couple. He was very aggressive, and complained a lot about living in Spain. It was clear he was pulling the strings.

"She was like a vicar's wife. Extremely smartly dressed and strait-laced, but she looked like a woman on the verge of a nervous breakdown, very frightened and scared.

"Rebecca was like an old woman, so hunched-up and timid."
Lianne faces 15 to 20 years in jail for each count of murder - but the maximum jail sentence in Spain is 30 years.
